WOMAN IS FOUND
GAGGED; FEET AND
HANDS ALSO TIED

     With her hands and feet tied, her mouth gagged and in almost an unconscious condition, Mrs. Margarette A. Stokes was found late Monday night in the family apartments at 411 1/2 North Ervay street by Allen Thorndike, of the Charles F. Weiland Undertaking Company and two others from the undertaking company. The apartments were over the undertaking establishment.
     Mr. Thorndike heard faint calls for help. He began an investigation and located where the sounds were. Rushing with the other men to the direction of the sounds, he found the door to the room locked and the key missing. Breaking the door open, Mrs. Stokes was found tied and almost unconscious. It was some time before she was able to tell what had happened.
     Tuesday morning, Mrs. Stokes appeared at the county attorney's office and a charge of assault to murder was filed against James Edward Stokes. It is alleged the assault was made on Mrs. Stokes. The defendant has not been arrested.
     The alleged assault, it is said, followed family troubles. Several days ago, a petition for a divorce was filed by Mrs. Stokes, through Attorneys Allen and Allen. A temporary injunction was granted at the time to prevent James Edward Stokes from interfering with plaintiff. The case was called Monday in Judge Foree's court and passed until 2 o'clock Tuesday. Mrs. Stokes, it is alleged, was assaulted about 6:30 o'clock Monday afternoon, and she was not found for nearly two hours. She said she was knocked unconscious, after having completed a telephone conversation, and that was the last she remembered until rescued.
     Tuesday morning, Attorneys Allen and Allen appeared before Judge Foree, representing Mrs. Stokes. A commitment was issued for the defendant.
