Susanna Foster was the sister of Charles H. Foster and the Aunt of Frank A. Foster who also lived in Cedar Township, Cherokee County Iowa. She was born in Canterbery New Hampshire in 1822, daughter of Jeremiah C. Foster and Susannah Bradley. The will was written in St. Joseph County Indiana. Susanna Foster
April Term Circuit Court 1878

In the matter of the Estate of Susanna foster, deceased

Noro.to wit: this 23d day of April 1878 It being the day set for the hearing of this cause. It comes on for a hearing before the court: And it appearing that due notice has been given of the time of final hearing on this application for admission of the will to probate. To all parties interested by publication thereof as required by law. And no one appearing to resist the probate of said will, and the instrument purporting to be the last will and testament of said deceased being produced and the testimony of the subscribing witness thereto being heard, the court finds that the said instrument was duly signed and executed by the deceased Susannah Foster at the time it purports to have been. As and for her last will: that at that time said deceased was of sound mind: that she then declared the said instrument to be her last will, in the presence of Ransom Hubbard Mariette Hubbard and John Luther the subscribing witnesses thereto, who then, and in the presence of the said deceased. And in the presence of each other and at the special bequest of the said Susannah Foster deceased signed their names as witnesses thereto.

It is therefor ordered and adjudged by the court, that said will be admited to probate as and for the last will of the said Susannah Foster deceased. And that said will be recorded in the proper record of wills in Cherokee County Iowa:

It is further ordered that Charles H. Foster the person named in said will as the executor thereof be appointed and confirmed as such executor.

Last Will and Testament:

I Susannah Foster of Elm Coupe St. Joseph County Indiana being of sound mind and Memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish and declare this to be my last Will and Testament. That is to say first; after all my lawful debts are paid and discharge I give and bequeath to my Brother Charles H. Foster all my personal property and effects of every kind and description and all my real property which I may have or be entitled to at my decease to have and to hold the same to him and his heirs forever. And in case said Charles H. Foster should not b e living at my decease, I give and bequeath all the said property absolutely to my nephew the son of said Charles, Francis A. Foster. Likewise I make constitute and appoint the said Charles H. Foster to be executor of this my last will by me made.

In witness whereof I have hereunto subscribed my name and affixed my seal this 7th day of January in the year of our Lord Eighteen Hundred and Seventy (1870)

Susannah Foster

The above instrument was subscribed by the said Susannah Foster in our presence and acknowledged by her to each of us and she at the same time declare the above and foregoing Instrument to be her last will and Testament. And we at her request and in her presence have attested its execution and signed our names as witness's hearto and written opposite our names our respective places of residence.
