Last Will and Testament of Edward Martin

In the Name of God, Amen.

Know All Men, That I, Edward Martin, of Portland, in the State of Oregon, of the age of seventy-eight years, being of sound and disposing mind and memory, and not acting under duress, menace, fraud or undue influence of any person whomsoever, do make, publish and declare this my Last Will and Testament, in the manner and form following, to-wit:

FIRST. It is my will, and I do order, that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be done after my decease.

SECOND. I give and bequeath unto my son Edward E. Martin the sum of five hundred ($500) dollars, to re-imburse him for moneys heretofore loaned and advanced to me, with the interest theron.

THIRD. I authorize and direct my executors hereinafter named to collect all moneys due or owing me, whether on notes, contracts or mortgages, as soon after my decease as can conveniently and economically be done and convert the same into cash, and I also further authorize and direct my executors hereinafter named, as soon after my decease as can conveniently be done, to sell and dispose of all real property belonging to me at the time of my decease, either at public or private sale, as to them shall seem best, at such time and upon such terms and for such prices as they may see fit, without being required to secure any order of court therefor.

FOURTH. I further order and direct my said executors to divide the proceeds arising out of the collection of notes, contracts or mortgages due or owing to me and sales of real property belonging to me at the time of my decease, into five equal shares, and that they turn over and pay to my wife, Nancy Martin, one-fifth of said proceeds; to my daughter, Clara E. Carpenter, one-fifth of said proceeds; to my son Edward E. Martin, one-fifth of said proceeds; to my daughter, Frances S. Wheeler, one-fifth of said proceeds after deducting the sum of five hundred ($500) dollars, being the amount heretofore advanced to her by me for the purchase of a lot in the City of Portland; to my daughter, Mamie L. Bullock, one-fifth of said proceeds.

FIFTH. I give and bequeath said sum of five hundred ($500) dollars deducted from the bequest of my daughter Frances S. Wheeler, to my said Wife, Nancy Martin, and to each of my three children, Clara E. Carpenter, Edward E. Martin and Mamie L. Bullock, to be divided equally between them, share and sharealike.

SIXTH. The bequest herein before given to my wife, Nancy Martin, is given and accepted by her in lieu and instead of dower.

AND LASTLY, I nominate, constitute and appoint my son Edward E. Martin and my friend John P. Lipscomb, to be the executors of this, my Last Will, hereby revoking all other Wills, Legacies and Bequests by me heretofore made, and declaring this, and no other, to be my last Will and Testament and request that no bond be required of them in the performance of their trust.

IN WITNESS WHEREOF, I have hereunto set my hand, this 27th day of May in the year of our Lord, One Thousand, Nine Hundred and Nine.

The above instrument was at the date thereof signed, sealed, published and declared by the said Edward Martin as and for his Last Will and Testament, in presence of us, who at his request and in his presence, and in the presence of each other, have subscribed our names as witnesses thereto.
