No. 167

Before me, Charles E. Greneaux, Parish Judge of the Parish of Hatchitoches, in the state of Louisiana, Notary Public ex officio, and in the presence of the undersigned witnesses, personally appeared Charles Myers and Mary Allen, both of the parish aforesaid and declared that having the intention of contracting marriage, they had regulated and established and they do by these presents regulate and establish the civil clauses, conditions and stipulations of their future marriage, as follows, to wit: Art. 1st: From and after the day of the celebration of the said marriage, there shall exist between the parties a community of property, agreeably to the provisions of the Civil Code of the State of Louisiana. Art. 2nd: The said Charles Myers brings into the said future community the following property to wit: one half section of a tract of land, situated and being in the said parish, on the West bank of Red River, opposite the boggy Bayou and confirmed in the name of Louis Soufigne; a negro woman named Tabitha aged about twenty and five years; four hundred head of horned cattle, thirteen head of horses. Art. 3rd: The said Mary Allen declared that her property consisted in a sum of money amounting to twelve hundred Dollars which she also brings into the said community, and which the said Charles Myers hereby acknowledges to have received. Art. 4th.: The parties further declared that they had lived together for several years past, as husband and wife, and that during that period, they have had together three children, viz: Riece Allen, James and Francis Cicero, that they acknowledge the said children to be theirs, and that this acknowledgement is so made with a view to legitimatize the said children. In testimony whereof the said Charles Myers has signed these presents, and the said Mary Allen, declaring she knew not how to write, has hereto affixed her ordinary mark of a cross, in presence of me the said Judge and Notary, and the undersigned witnesses, at my office in the Town and Parish of Natchitoches, this twenty ninth day of November, in the year of our Lord one thousand eight hundred and thirty three.
