??, ?? petitioner R. A Myers ?? citizen of Orange County ?? Court that ?? Mary Myers Dec[ease]d also ?? of Orange County, who departed this life on or about the fourteenth day of December A.D. 1861, and that the said Mary Myers left a last will and testement which ?? the said R. A. Myers presents to your Hon. Court ?? and prays your Honor that the same may be duly probated according to law and that the clerk of your Honor's Court give due notice of this petition and ?? will ever ??

County of Orange

I Mary Myers of Orange County Texas being of sound mind and ?? memory but advanced in years and knowing the uncertainty of human life and wishing to make a ?? disposition of all my earthly effects do make & publish this my last will and testament hereby revoking all others.

Item first - I commit my soul to my Heavenly Father from whence I came.

Item Second - I resign my body to mother Earth from whence it came to be Buried by my Relatives and friends according to the Rites of the Christian Church.

Item Third - I will and bequeath that my property be so disposed of as to first pay all my just debts which I may owe at the time of my decease in the most economical manner & that all my funeral expences be first paid.

Item Fourth - the remainder of my property or all of my worldly effects of which I may ?? seized should my children ?? all the debts and expenses above alluded to. I will and bequeath in the manner following to wit.

Item Sixth - I will and bequeath to my oldest Son Reese A. Myers one half League (continued)

(continued from previous page) of Land of the Headright of John Allen, the Headright situated upon Sabine River. The ?? half I will and bequeath to my Said Son upon the terms and Restrictions hereinafter mentioned. That during my lifetime my Said Son shall contribute fifty dollars per annum for my Support and should I during my lifetime make any disposition or sale of any such Land there my Said Son shall enjoy and have the proceeds of such sale, the same being at all times subject to and under my control during my natural lifetime.

Item 7th - I will and bequeath to my sons James Myers my 2nd Myers son and my third Myers Son Robert Myers one certain tract of Land now occupied by me as a homestead, the headright of William Allen containing four hundred and seventy seven acres of land situated in said Orange County in the place known as Duncan's Woods. Upon the terms and conditions following to wit ?? that my said two sons, James & Robert shall constitute my support during my natural lifetime the sum of fifty dollars each yearly.

Item 8th - I will and bequeath to my said three sons Reese, James & Robert all my horses, cattle & hogs. Cattle & Horses branded (continued)

(continued from previous page) thus R3 and marked ?? in the right ear and swallo[w] fork in the left. Hogs marked a slope in the right ear and swallo[w] fork in the left, hereby confirming to my said children all such property, but to be used and enjoyed by me during my natural lifetime.
