In the name of God amen. I Francis Turner of Patrick County and state of Virginia, being on perfect sense tho' weak in body and calling to mind the mortality of my body knowing it is appointed to all men once to die, do make ordain constitute and appoint this my last Will & Testament (to wit, ?? commend my soul to God who gave it hoping and trusting through the mediatorial Sacrifices of my Lord and Saviour Jesus Christ to receive a full and free pardon for all my sins, and I give my body to the Earth from whence it was taken to be decently buried according to the will and desire of my Executor herein after mentioned in full assurance of its resurrection at the last day, and with respect to the rest of my Temporal affairs what it hath pleased almighty God to bestow on me, I will and bequeath as follows to wit;

Item I will first and principally that all my Just Debts that I owe to any manner of Persons be punctually paid.

Item I give and lend unto my well beloved wife during her natural life all that part of my land and plantation I now live on lying below a line beginning at a Small Branch South of Smith river at Thomas Flower[']s corner thence down said Branch to the river thence up the same opposite the lane from thence a northerly straight line to the Path that Leads to Burnetts Santee place thence the said Path to the back line, also all the slaves and their increase that I have now in Possession excepting a Boy by the name of Bolin, namely Charles, Will, Kizz, Jean, Dock, Betty.

Item I give and bequeath to my Daughter Esther Pilson twenty five Pounds her husband William Pilson owes me for a mare also the Balance of a Bond due me from Rowan and Scott whatever it may be together with the Interest thereon and at my Decease for my Executor to sell a Sufficiency of the Stock on the Plantation to make the aforesaid Band of Twenty five Pounds and the Balance of Rowan & Scott[']s Bond one Hundred Pounds & to Pay the same to her. Also I will that my Slave Bolin if living at my death be sold at 12 months credit and for my Executor to divide and pay the price of him equally to the Children of my said Daughter lawfully begotten to be to them and their heirs forever.

Item I will and bequeath to my son Adam Turner one negro Boy named Sam my Still and all vessels appurtenant thereto also at his mother[']s Death one negro girl named Jean to him and his heirs forever. Also I lend him a negro boy named Jack until his son Francis arrives at the age of twenty one years and then to his said son Francis and his heirs forever but if said Francis should die without legal issue then said Jack to be sold equally divide between the rest of his Brothers and Sisters.

Item, I will and bequeath unto my son James Turner all the original survey or Tract of Land he now lives on containing one Hundred and Seventy five acres also two tracts in Montgomery County containing together three Hundred and ninety nine acres, also at his mother[']s Death a negro wench named Kizz a girl named Betty & a fellow named Will to be to him and his heirs forever.

Item I will and bequeath to my son John Turner all that part of the tract of Land I now live on lying above the line described in the second Item which line divides between him and his mother and at his mother[']s death a negro fellow named Charles also I lend him a negro Boy named Bill until his son Francis arrives to the age of twenty one years and then to his said son Francis and his heirs forever, but if said Francis dies without legal issue then said Bill to be sold and equally Divided between the rest of his Brothers and Sisters. Also I give to my said son John a negro Boy named Dock to him and his heirs forever.

Item I give unto my sons Adam, James, and John and my son in law Robert Rowan all that tract of Land lying on the blue ridge excepting two Hundred and fifty acres belonging to Robert Rowan containing Twelve Hundred and twenty three acres to be equally divided among them and to them and their heirs forever.

Item I give to my Daughter Betsy Rowan at her mother[']s death all the Part of the plantation I now live on which in the second Item is lent to my wife to be to her and her heirs forever.

Item I will that the sum of ten pounds cash be deposited in the hand of my sons Adam and James to Pay and Support Supplies or ministers of the Old Presbyterian Denomination at four Dollars a year till the whole is expended.

Item I give and bequeath unto my Dear wife during her natural life the household furniture and farming untensils together with all kind of Stock, and all Cash that may be on hand after Esther Pilson is paid as specified in the third Item and the Price of Bolin mentioned in the said Item to be paid by my Executor to the Children of the said Esther as they arrive to lawfull age.

Item my Will and desire is that if any one or more of the legalees to my Estate shall at any time during the widowhood of my wife interrupt disturb or in any manner maltreat or misuse her my said widow or any of the Property lent or devised unto her that he she or they so offending shall be cut off from any further share of my estate but one Hundred Dollars and the balance allotted them to be sold and equally divided between the legalees not so offending as above and that the same be to them and their heirs forever.

Item, it is my will and desire that my Estate shall not be appraised.

Lastly, I do appoint my three sons Adam James and John Executors of this my last Will and Testament, requiring them to attend and Particularly see to the management of the estate which I leave in my wife[']s hand and I do hereby revoke all former Wills and Testaments.

In witness whereof I have hereunto set my hand & affixed my Seal this first day of October one thousand eight hundred and three,

The within last will and Testament of Francis Turner was exhibited in Court by the Executors therein named and proved by the oaths of Wm Hancock and Alexander Sachy two fifths witnessed thereto Subscribed to be the act and Deed of the within named Francis Turner and the same was ordered to be recorded.
