Great House Indenture 1734/5


This document is basically a mortgage. It refers to a mortgage the previous year for £1,000 secured on properties mainly in Llangattock Lingoed and then to a further £1,000 secured against  properties in Abergavenny, Grosmont, Llangybi, Llantilio Crossenny, Whitecastle and Skenfrith purchased by Edward Morgan the Elder or Charles Morgan. It is in fact a copy of the original, made in 1733, when it was then in the hands of Capel Hanbury. This suggests that the mortgage was never redeemed and that the various properties came into the possession of the Hanbury family. Only the first part of the document, dealing with properties in Llangattock Lingoed, is reproduced below.

 

This Indenture made the Twenty Seventh day of January in the year of our Lord one Thousand and Seven Hundred and Thirty four and in the Eighth year of the Reigne of our Sovereigne Lord George the Second by the Grace of God King of Great Brittaine France and Ireland Defender of the Faith and so forth Between James Tuder Morgan of Langattock Lingoed in the County of Monmouth Esquire (Eldest son of Richard Tuder late of London Gentleman Deceased and Devisee named and appointed in and by the last Will and Testament of Charles Morgan late of Langattock Lingoed aforesaid Esquire deceased who was Brother and Heir of Edward Morgan who was Son and Heir of Charles Morgan who was Son and Heir of Edward Morgan the Elder late of the same place Esquire deced) and Martha the Wife of the said James Tuder Morgan of the one part and Bridget Hanbury of Ponty Poole in the said County of Monmouth Widow (Relict and Sole Executrix of the last Will and Testament of John Hanbury of Ponty Poole aforesaid Esquire deceased) of the other part Whereas by Indentures of Lease and Release the Lease bearing date the day next before the day of the date of the Release and the Release bearing date the Twenty Seventh day of October which was in the Year of our Lord One thousand Seven Hundred and thirty three and made between the the said James Tuder Morgen and Martha his Wife of the one part and the said John Hanbury deceased of the other part It is Witnessed in the said Indenture of Release that in Consideration of the sume of One Thousand Pounds of Lawfull Money of Great Britain to the said James Tuder Morgan and Martha his Wife in hand paid by the said John Hanbury They the said James Tuder Morgan and Martha his Wife did Grant Release and Convey unto the said John Hanbury and his Heirs All that Capital Messuage or Mansion House wherein the said James Tuder Morgan did then Inhabit with all Houses Outhouses Barnes Buildings Gardens and Orchards thereunto belonging with their Appurtenances And all those several Closes or Parcels of Lands Arable Meadow and Pasture Grounds to the same Capital Messuage belonging and therewith Enjoyed Called and known by the several Names of Cae Iscallog Containing by Estimation Twelve Acres Cae Maine Containing by estimation Thirteen Acres Cae Even containing by estimation Thirteen Acres Gworloed Aviow Containing by estimation Fourteen Acres Erro heer containing by estimation Twenty four Acres Maes Ly dan containing by estimation Twenty Acres Cae Pull Prawling containing by estimation Twenty Acres Cae Bach Y Gwent Containing by estimation Four parcells of Arable Lands with their Appurtenances called by the severall Names of Kae Pull Line containing by estimation Twelve Acres Y Tree Pedivar Cover Containing Twelve Acres Cae Duch Lawyr Tuy Monmouth and in the Tenure and Occupation of the said John Christopher as Tenant to the said James Tuder Morgan at the Yearly Rent of Nine Pounds And all that Messuage or Tenement with the Houses Outhouses Barnes Buildings Stables Gardens and Orchards thereunto belonging and therewith Held and Enjoyed with their Appurtenances called the Taverne House enjoyning to the Church Yard Wall of Langattock Lingoed Church Situate in the said Parish of Langattock Lingoed and in the Tenure and Occupation of Phillip Kinvin as Tenant to the said James Tuder Morgan of the Yearly Value of Three Pounds Ten Shillings And also all that Messuage Tenement Farme Lands Hereditaments and Premisses called George's Farme wherein Robert Christopher did then lately Inhabit then in the Possession of the said James Tuder Morgan with all the Houses Outhouses Barnes Stables Buildings Gardens and Orchards thereunto belonging and therewith Enjoyed together with Ninety five acres of Arable Land Sixteen Acres of Meadow and Nine Acres of Pasture Land thereunto also belonging and therewith held and Enjoyed with their and every of their Appurtenances be the same or either of them more or less Situate lyeing and being in the said Parish of Langattock Lingoed in the said County of Monmouth in the Tenure and Occupation of the said James Tuder Morgan at the Yearly Value of Twenty Six pounds To Hold all and singular the said Premisses with their Appurtenances unto the said John Hanbury his Heirs and Assignes Subject nevertheless to a Provision or Condition therein Contained for recovering the same Premisses unto the said James Tuder Morgan his Heirs and Assignes or unto such Person and Persons as he or they should Direct or Appoint on Payment by the said James Tuder Morgan his Heirs Executors Administrators or Assignes unto the said John Hanbury his Executors Administrators or Assignes of the Sume of One Thousand Pounds with Interest for the same after the rate of five pounds for every Hundred pounds for a Year on two days of payment therein mentioned and since past as by the said recited Indentures of Lease and Release Relation being thereunto had may more fully and at large Appear And Whereas the said John Hanbury is since dead having first made his last Will and Testament in Writing and thereof Appointed the said Bridget Hanbury sole Executor who hath proved the same in the Perogative Court of Canterbury and is thereby become Intitled to the said principal Sume of One Thousand pounds which remaineth due and owing and Secured upon the Premisses before mentioned and Discribed All Interest for the same being paid to the day of the Date hereof And Whereas the said Bridget Hanbury hath Agreed to Advance and Lend unto the said James Tuder Morgan the further sume of One thousand Pounds to be Secured with Interest for the same in such manner as is here in after mentioned Now this Indenture Witnesseth that for and in Consideration of the sume of One Thousand Pounds now due and owing from the said James Tuder Morgan and Secured to the said Bridget Hanbury as afore mentioned and in Consideration of the further sume of One Thousand pounds of Lawfull Money of Great Britaine to them the said James Tuder Morgan and Martha his Wife in hand at or before the Sealing and Delivery of these Presents by the said Bridget Hanbury well and truly paid the receipt of which said sume of One Thousand pounds they the said James Tuder Morgan and Martha his Wife do hereby Acknowledge And thereof and therefrom do respectively Acquitt Exonerate and Discharge the said Bridget Hanbury her Executors Administrators and Assignes and every of them by these Presents which being added to the said Principall sume of One Thousand Pounds owing and Secured In manner as is before mentioned maketh together in the whole the sume of Two Thousand Pounds They the said James Tuder Morgan and Martha his Wife Have and each of them hath granted Bargained Sold Aliened Released and Confirmed And by these Presents Do and each of them doth grant Bargain Sell Alien Release and Confirm unto the said Bridget Hanbury in her Actual Possession now being of the Capitall Messuage Closes peices or Parcells of Land Messuages or Tenements Hereditaments and Premisses with the Appurtenances hereinafter mentioned by force and Virtue of One Indenture of Bargain and Sale for the Consideration of Five Shillings of like lawfull money bearing date the day next before the day of the date hereof for one whole Year Comencing from the day next before the day of the Date thereof and made or mentioned to be made between the said Partyes hereunto and by force of the Statute for the Transferring of Uses into Possession and to the Heirs and Assignes of the said Bridget Hanbury All that Capital Messuage or Mansion House and all and every the Messuages or Tenements Farms Closes Grounds Mills Lands Tenements Hereditaments and Premisses herein before mentioned and described and which in and by the said recited Indentures of Lease and Release were Granted Release and Conveyed by the said James Tuder Morgan and Martha his Wife unto the said John Hanbury and his Heirs with
