Will of Thomas Morgan 1676

In the Name of God Amen
The Sixth day of October 1676 And in the Eight and Twentieth yeare of the Reign of our Soveraigne Lord Charles the Second by the grace of God King of England Scotland France and Ireland defender of the Faith etc I S[i]r Thomas Morgan of Chanston in the County of Hereford Knight and Baronet being of sound and perfect memory (Praise be given to God for the same) And knowing the uncertainty of this life on Earth And being desirous to sett things in order Doe make and ordaine this my last Will and Testament in amnner and forme following (that is to say) First and principally I com[m]end my soule to Almighty God my Creator assuredly beleiving That I shall receive full pardon and free remis-sion of all my sins and be saved by the pretious death and merets of my blessed Saviour and Redeemer Jesus Christ And my body to the Earth whence it was taken To be buried in such decent and Christian manner as my Execu-trix hereafter named shall thinke meete and Convenient And as touching such wordly Estate as the Lord in mercy hath lent me my will and mind is That the same shall be disposed bestowed and enjoyed as hereafter by this my will is expressed and directed hereby revoking and making void all wills and bequests by me formerly made First I give and devise to my dearly beloved wife Dame Delariver Morgan All that my mannor or mannors and Lordship or Lordshipps of Chanston and Waterston and Prossers Farms And all those Lands and Tenements which I bought of Mr. James Penoyr And the Two messuages and Farms now or late in the Tenures or occupa-tions of Howell Nicholls and William James And the Lands which I bought of John Reece and Francis Reece or either of them And the lands and Tenem[en]ts which I bought of David Smith and John Smith or either of them And those singell messuages which I lately bought of James Cooxye (all which said premisses are situate lying and being in the parishes of Vowchurch Turniston Peterchurch St Margarett and Burton or in some or one of them in the County of Hereford) And all other the lands Tenements and hereditaments of me the said S[i]r Thomas Morgan whereof I am now seised in Fee simple situate lying and being in the said Parishes of Vowchurch Turniston Peterchurch St Margaretts and Burton or in any or either of them Together with all Houses outhouses lands woods woodlands waters watercourses Co[m]ons proffitts and Com[m]odities to the same or to any part thereof belonging or appertayning To have and to hold the said Mannor Lordship ffarmes messuages lands tenements hereditaments and premisses unto my said wife for the Terme of her naturall life And after her death I doe give and devise the same unto my eldest sonne John Morgan and the the heires Male of his body lawfully begotten And for want of such issue Then to my Second sonne Cholmley Morgan and to the heires Male of his body lawfully begotten And for want of such issue Then to my Third sonne Charles Morgan and to the heires Male of his body lawfully begotten And for want of such issue Then to my Fourth sonne James Morgan and to the heires Male of his body lawfully begotten And for want of such issue Then to my daughter Delariver Morgan and to the heires Male of her body lawfully begotten Item I doe give and devise unto my said wife All those houses and lands with th[e] appurtenances which I lately bought of my Brother Richard Cholmley Com[m]only called by the name of Bramhall in the parish of Spawford in the County of York And all my lands Tenements and hereditaments whereof I am now seised in Fee simple lyeing and being in the said parish of Spawford To have and to hold the said houses lands Tenements and hereditaments unto my said wife for the Terme of her naturall life And after her decease I doe give and devise the same unto my said sonne Cholmley Morgan and to his heires and Assignes for ever And my will and meaning is That my said wife shall dureing her naturall life give and allow unto my said sonne Cholmley Morgan out of the Rents and proffitts of the premisses in Spawford aforesaid such main=tenance as she in her discretion shall think fitt Item I give and devise unto my said sonne Charles Morgan and to his heires for ever All those Two Tenements called the Blanyes and the Tenement called Blackhill with th[e] appur=ten[anc]es lying and being in the said County of Hereford Item I give and devise unto my said sonne James Morgan and to his heires for ever All my houses lands Tenements and hereditaments Lying and being in the parishes of Langattock Llingott and Langhihangell Killcorney in the County of Monmouth And all that Tenement called the Hollingwood with th[e] appurtenances lying and being in the parish of [blank] in the said County of Hereford lately bought by me of my Cousin Richard Parry Item I give and bequeath unto my said deare and loving wife The one Third parte (The whole three parts to be devided) of all my goods and Chattels Reall and personall debts ready money Morgages Jewells Plate and Household goods and of all other my personall Estate whatsoever Item I give and bequeath unto my said Daughter Delariver Morgan The sume of Three Thousand pounds to be paid at her day of Marriage or age of One and Twenty years which shall First happen if my said daughter shall marry with the Consent of my wife But if she marry without the Consent of my wife during the life time of my said wife Then I give and bequeath unto my said Daughter the sume of Fifteene hundred pounds and noe more Item I give and bequeath unto my said sonne Cholmley Morgan the sum[m]e of Five hundred pounds And to my sonne Charles Morgan the sum[m]e of One Thousand pounds And to my sonne James Morgan the sum[m]e of One Thousand pounds And my mind and will is That the severall sum[m]es of money bequeathed to my said Three youngest sonns shall be paid to them Respectively at such time as they shall respectively attain the age of Four and Twenty yeares and not before my Executrix herein after named shall think fitt in her discretion to pay the same or any parte thereof sooner And alsoe my mind and will is That if any or either of my said Three youngest sons or my said daughter shall happen to dye without issue before the sum[me]s of money bequeathed to them as aforesaid shall be respectively paid That then the said sum[m]es of money bequeathed as aforesaid To him her or them soe dying or such thereof as shall be unpaid att the time of his her or their death shall be equally devided and paid To and amongst the survivors and survivor of them my said Three youngest sonns and my said daughter share and share alike And further my mind and will is That if by any accident or default of payment The personall Estate which I shall leave at the Time of my death shall happen to be lessened That then and in such case the loss thereof shall be borne by my said wife And my said Three youngest sonns and daughter proportionally according to the parts and sum[m]es of money given and bequesthed to them as aforesaid Item I give and bequeath unto my sister Lingen the sum[m]e of Fifty pounds which I doe desire shall be paid into the hands of her sonn John Lingen in Trust for her And that her husband shall not receive the same nor any part thereof And likewise That an acquittance and receipt in writing under the hand of the said John Lingen Testifying the receipt thereof shall be a good discharge to my said Executrix against my said sister and her husband And further That if my said sister shall happen to dye before me Then I doe give and devise the said Fifty pounds To the said John Lingen her sonne Item I give and Bequeath unto Mr. James Hore the sum[m]e of Fifty pounds Item I give and bequeath unto my Coser Lewis Morgan of Langattock Kingott in the County of Monmouth Tenn pounds To Mr. Peter Griffith Tenn pounds And to my Cousin Griffith Gwillham Ten pounds Item I give and bequeath to the poor of the parish of Langattock Kingott Five pounds To the poor of the parish of Dowchurch five pounds And to the poor of the parish of Turniston Twenty shillings which said Three last ment[i]oned sum[m]es of money shall be paid to such poor people of the said parishes as my said Executrix shall think fitt Item I give and bequeath to each of my domestick servants that shal be in my service att the time of my death Twenty shillings apeice And I doe Constitute and appoint my said deare and loving wife Delariver Morgan to be the sole Executrix of this my last will and Testament And I doe nominate my Brother Richard Cholmley Esquire and my Cousin John Parry of Aulston in the County of Hereford Gent John Baynes of Westminster Esquire and my Cousin James Morgan of Lantilo in the County of Monmouth overseers of this my last will And I doe give to every one of them the said Richard Cholmley John Parry John Baynes and James Morgan the sume of Ten pounds a peice And this I doe declare to be my last will and Testament written in Two sheets of Paper Unto oath of which I have sett my hand and seale the day and yeare First above written .
