To     }        Deed of Gift

James J. Osteen

 

Reg. 24th Jany 1843

 

State of Tennessee

Madison County. 

January the fifth day of Eighteen hundred & forty three –

 

For the love and affection, I Jessee Ledbetter and Elizabeth Ledbetter entertain for James J. Osteen, we do hereby give transfer and convey to him our tract of Land in Madison County Tennessee and in the 10th Surveyors District, Range 3 and Section 7 Containing forty acres it being a part of 455 acre tract of Land granted to Zinds Alexander and Robert Irvin situation on Cypress Creek in Madison County and bounded as follows; 

Beginning at the South east corner of the said 455 acre tract and running North with the East boundary of said tract eighty poles to a stake, thence South eighty poles to a stake, thence along the South boundary of said 455 acres to the beginning. 

To have and to hold the same to the said James J. Osteen and his heirs and assigns forever, we covenant and agree for ourselves and heirs to warrant and defend the title to said tract of Land to the said James J. Osteen his heirs and assigns against the lawful claims of all person whatever. 

In Witness whereof we have hereunto set our hands and seals this the day and date above mentioned.

Lauderdale County

 

            Personally appeared before me Isaac M. Steele Clerk of the County Court of said County of Lauderdale the within named Jesse Ledbetter with whom I am personally acquainted and who acknowledged that he executed the within deed for the purposes therein contained. 

 

Witness my hand at office this 18th day of January 1843.

And Elizabeth Ledbetter having also appeared before me privately and apart from her husband, the said Jesse Ledbetter, acknowledged the execution of said deed to have been done by her freely voluntarily and understandingly without compulsion coercion or restraint from her said husband, for the purposes therein expressed.

            I, James D. McClellan, Clerk of the county Court of said county do certify that I rec’d the State Tax on this deed .. Jany 24th 1843
