Indenture made this twelfth day of June in the year of Our Lord One Thousand
Eight Hundred & Thirty One between James Philpott
and Elizabeth Philpott his wife, Solomon Philpott, Robert Halliburton, Robert D. Bumpass, Nancy M.
Bumpass his wife, John Lunsford &
Sarah A. Lunsford his wife, of the county of Person and State of North
Carolina of the One part and Gabriel Davie of the County of Madison and State
of Tennessee of the Other part.
Witnesseth that the said James Philpott & Elizabeth his wife, Solomon Philpott, Robert Halliburton, Robert L. Bumpass and Nancy
his wife and John Lunsford and Sarah
his wife, they being apart of the heirs of William Davie deceased, late of the
County of Person and State of North Carolina and in consideration of the sum of
thirty dollars and ninety one cents, each of us in hand paid by John G. Gill
Agent for the said Gabriel Davie, the Receipt whereof is herby acknowledged we
hath bargained sold alieved and confirmed unto the
said Gabriel Davie his heirs and assigns a certain tract or parcel of land lot
No. 6, 340 acres to the heirs of William Davie.
We as heirs of the said William Davie claim one seventh part of the said
340 acres of land which is thirty 10/11 of acres to each one of us heirs of the
said William Davie the land lying and being in the County of Madison and State
of Tennessee.
Beginning at the South East
corner of Entry No. 211 in the name of J. Walker thence West one hundred poles
to a stake thence South 191 3/10 poles to a stake, thence East 314 6/10 to a
____ and three post oak pointers the south West corner of Lot No. 7 thence
North with the line of the same 165 poles to a stake and two hickory pointers
the South East corner of lot No. 8 thence west with the line of the same 214
6/10 poles to the North West corner of the same thence North 26 2/10 poles to the
Beginning containing three hundred forty acres which land was allotted to the heirs
of William Davie by commissioners appointed by the County Court of Madison
County.
We as a part of the heirs
of the said William Davie hath sold unto the said Gabriel Davie and each of our
parts of the said Land to have and to hold the aforesaid land with all and
singular Rights proffits ______ and appurtences and to the same belonging or in any wise
appertaining to the only proper use and ____ of him the said Gabriel Davy in
fee sim for and the said James Philpott
and Elizabeth his wife, Solomon Philpott, Robert
Halliburton, Robert D. Bumpass and Nancy his wife and John Lunsford and Sarah his wife doth covenant and agree to and
with the said Gabriel Davie his heirs and assigns they will warrant and ever
defend against all lawful claim or claims of all and every person or person
whatsoever to which we bind ourselves and heirs and assignes.
In Testimony whereof the
said James Philpott and Elizabeth his wife, Solomon Philpott, Robert Halliburton, Robert D. Bumpass and Nancy
his wife, John Lunsford and Sarah his
wife, has set their hands and affixed their seals the day and date above
written.

they are both acting Justices of the Peace for said County and duly

to an Order of Person County Court directed to Samuel Davie and William
Whitefield two of the Justices of the Peace for said County to Examine the
within named Tenn county, ____ their voluntary
consent to the Execution of the within Deed we do hereby certify that they
acknowledged that they Executed the same of their own free will and consent and
without the constraint or compulsion of their husbands. Given under our hands this 20th
day of June 1831.
