THIS INDENTURE MADE this 2nd
day of October in the year of our Lord 1809, Between John Jennings Esquire
Sheriff of the County of Anson and State of North Carolina on the one part and
Richard Russell of the County of Anson & State aforesaid on the other part
WHEREAS by virtue of and Execution Issuing from the County Court of Anson
against Paton Lundsford
for the sum of Eighteen pounds which said sum was Recovered by Richard Russell
against Paton Lundsford as
on Record may appear and whereas the said Execution was directed and Delivered
to the said John Jennings Esqr. sheriff as aforesaid
Commanding him that of the Goods and chattels Lands and Tenements of the said Paton Lundsford he
should cause to be made the aforesaid sum of Eighteen pounds to satisfy the
said Execution with the costs thereon and the said John Jennings sheriff as
aforesaid in pursuance and by virtue of his office and the aforesaid Execution did sieze
and take into his hands and custody (no Goods or chattels to be found) a
certain piece or parcel of Land situate Lying and being in the County of Anson
Bounded as followed Beginning at a stake in William Threadgills
line and Runs with said line No. 66 wt. 39 chains to his and Thomas Threadgills corner pine then with Thomas Threadgills line No. 45 Wt. 28 chains to Henbys corner post oak then with his line so. 70 wt. 18
chains crossing the Road to a stake then So. 15 Et. 38 chains and 80 links to a stake by
five black oaks and pine then No. 81 Et. 62 chains & 50 links to the
Beginning Containing in the whole one hundred and Fifty acres more or less and
the said John Jennings sheriff as aforesaid after due advertisement according
to Law did cause the said piece or parcel of Land with all the appurtenances
thereunto Belonging to be put up at public sale to the highest bidder on the 8th
day of April in the year of our Lord 1809, at which time and place the
aforesaid Richard Russell became the last and highest bidder at the sum of
sixteen pounds Ten shillings for the said Land with the appurtenances thereunto
belonging.
THIS INDENTURE WITNESSETH
that the said John Jennings sheriff of Anson County as aforesaid for and in
consideration of the sum of sixteen pounds ten shillings to him in hand paid by
the said Richard Russell at and before sealing and signing of these presents
the Rec’t whereof is hereby acknowledged, he the said
John Jennings Sheriff doth hereby bargain sell alien Enfeoff
(?) convey and confirm unto the said Richard Russell his heirs Exrs. Admrs. or assigns forever all the aforesaid Lands Tenents and appurtenances with all Right title claim or
Demand of or unto the aforesaid piece or parcel of Land with all the hereditaments (?) and Emoluments (?) to the same belonging
or in anywise appertaining.
TO HAVE AND TO HOLD to the
said Richard Russell his heirs Exrs. Admrs. or
assigns who shall may from time to time and at all times hereafter have hold
occupy possess and enjoy the said premises with the appurtenances free and
clear of and from all Incumbrances had made done or
committed by him the said Sheriff or by his order means or procurement and the
said John Jennings Sheriff will warrant & Defend the same to the said Richard
Russell his heirs Exrs. Admrs. or
assigns so far as his office of Sheriff will admit and no farther.
