Be it remembered that on
this the 6th day of January 1870, this cause came on to be heard and
was ____ heard upon the report of E. D. Harris the Clerk and commission which
is as follows;

In this cause the
undersigned begs leave to report that pursuant to the interlocutory of Sale
made at the November Term 1869 of the County Court he exposed to public sale at
he Court house in Troy on the third day of January 1870 the Tract of Land of
one hundred and fifty one ¼ acres mentioned in said order, after having
advertised the sale thirty days as directed in the interlocutory order of sale
and J. H. Pierce being the highest and best bidder became the purchaser at the
sum of Twenty Three hundred and ninety five $2395.00 Dollars, he paid last the
sum of Seven hundred and ninety eight 33/100, $798.33, dollars and he executed
his two notes each for $798.33 payable to the Clerk and Commissioner in one and
two years after date with A. S. Finck and W. C.
Robinson his Securities. All of which is
respectfully submitted.

Which report being unexcepted to is in all things
confirmed by the Court. It is therefore
ordered and adjudged and decreed by the Court that the title to said tract of
land be and the same is hereby divested out of the petitioners and the
defendants and vested in the said J. H. Pierce the purchaser at the sale of the
Clerk subject however to a special lien for the unpaid purchase money which
lien is hereby expressly retained.
The said tract of land is
situated in Obion County on the South Side of Obion River in Civil District No
11 in Range 6 and Section 6 granted by the State of Tennessee to Michael Hackly
by No. 3970 and bounded as follows, viz, Beginning at a Maple with black gum and ash
pointers the N. W. Corner of said Grant, thence South with the West boundary of
the same 328 poles to a stake with Elm & Sweet gum pointers the South West
corner of the same, Thence East 65 poles to an Elm with Elm pointers, Thence
North 85 poles to a Stake with Poplar pointers, thence North 239 poles to a
Maple in the north boundary of said Grant.
Thence West 77 poles to the beginning containing one hundred and fifty
one and one fourth acres, more or less.
And it is further ordered
and decreed by the Court that the Clerk retain the casts and his commission, on
the first payment paid in and pay to J. J. Smith seventy five dollars for his
services as the attorney in this cause out of the purchase money on hand and
pay the remainder to the parties according to their rights on their complying
with the law, and it is further ordered that the Clerk retain his commission on
the balance of the purchase money as it shall be paid in and pay the note
balance of the same to the payment in interest according to their rights their
complying with the Law and when all the purchase money shall have been paid in
let the Clerk report his action in the premises.
State of
J. E. D. Harris Clerk of the County Court of said County
and State aforesaid do hereby certify that the above and foregoing transcript
is a full and perfect, and complete copy of said Decree as full and complete as
the same which appears upon Record and on filing in my office, and that all of
the purchase money has been paid in by the said J. H. Pierce purchaser and the
money paid to the distributors respectively.
