Petition to sell land for to pay debts
Be it remembered that on this the 6th day
of March 1865 this came on for further hearing on the petition exhibits and
proof. When it appearing to the
satisfaction of the court that the personal assets of the estate of James Sanders, deceased, are all
exhausted and that there are debts remaining unpaid and that B. F. Norris, Jane Norris, Lucinda Acuff, wife of F. R. Acuff, and Amanda
Sanders are the only heirs at law, and that J. D. Hubbard, guardian ad litem,
answered before the court for the minor Amanda
Sanders.
Said parties have had five days notice of this
application and that the said James
Sanders died seized and possessed of the following described parcel of
land, Lauderdale County, State of Tennessee, Civil District No. 6, and bounded to wit;
Beginning at a dead hickory and dogwood pointers, the
original NW corner of a grant of 120 acres by the State of Tennessee to Obediah Baker, thence south 160 poles to a sweet gum marked
O. B., mulberry, hickory pointer, the SW corner of said grant thence east 57
poles to a stake in the west boundary line of Adam Boyd’s 5000 acre tract
thence with said tract north 160 poles to a stake where the northern boundary
line of said Baker tract crosses the Boyd line thence west 76 poles and 9 links
to the beginning containing 67 6/10 acres.
It is therefore ordered adjudged and decreed that
George Johnston is hereby appointed commissioner to sell said land that he
advertise according to law and sell said land to the highest bidder, that he
sell said land at the court house door in the town of Ripley, Lauderdale
County, State of Tennessee on the first day of April 1865 for one half cash in
currency the balance on a credit until the 25 December 1865 in currency at that
time and that said commissioner _______ retaining a lien on above until all the
______ is paid.

Be it remembered that on this the 3rd
day of April 1865, this cause came on for further hearing before the worshipful
Samuel A. Thompson, Chairman and presiding Justice for said county and Daniel
McLeod and Robertson Meadows, Esqrs, Justice of the
Peace for said county upon the report of clerk and commissioner which said
report is received approved and in all things confirmed which report is in the
words and figures as follows, to wit;
The undersigned would respectfully
report he sold the land mentioned in the pleading at the court house door in
the town of

Johnston, Commissioner
And
it appearing to the satisfaction of the court that the cost in this cause is $35 which deducted from the
cash payment of $202.50 leaves in this court the sum of one hundred and sixty
seven 50/100 dollars ($167.50). It is
therefore ordered adjudged and decreed by the court that that the clerk and
commissioner of the court pay over to William
Lunsford, administrator of James
Sanders, deceased, the above amount of $167.50 to be applied to the payment
of the debts of the said James Sanders,
deceased, and that all further proceedings in this cause be reserved until the
balance of the money is paid in this cause.

FINAL DECREE
Be it remembered that this cause
coming on for final hearing on this the 4th day of December 1865
before the worshipful S. A. Thompson, Roberson Meadows and James Gillespie,
Esquires, Justices of the Peace of said County of Lauderdale on Petition answer
and reports and orders heretofore made on proof when it appeared to the
satisfaction of the court that sometime in the year 1862 James Sanders died intestate in said county and that letters of
administration upon his estate was granted to William Lunsford the petitioner and that the said James Sanders left him surviving Jane Norris, wife of B. F. Norris, Lucinda Acuff, wife of Robertson Acuff,
Amanda Sanders, Harriett Sanders and Julia
Sanders, his children, and only heirs at law, that at the time of his death
the said James Sanders was the owner
in the following described tract of land situate in the county of Lauderdale,
State of Tennessee, and thus bounded and described (to wit);
Beginning at a dead Hickory and Dogwood

further appearing to the satisfaction of the court that a sale of said was
necessary for the payment of the debts of said intestate, the personal estate
being insufficient for the payment of the same and it further appearing to the
court that this court at its March Term 1865 ordered and directed George
Johnston Clerk of the court to sell said land which was done by him in strict
accordance with said decree and that he sold the same to James A. Lackey and
Benjamin A. Sinclair at and for the sum of $405, and that they have paid all of
the purchase money for said land as appears from the report of said George
Johnston Clerk and Commissioner which is in the words and figures following (to
wit);

The undersigned would respectfully report that he has
collected of James A. Lackey and B. A. Sinclair two hundred and two 50/100
dollars the amount of the last payment for the land mentioned in the pleading
and that the cost of entering final decree is two dollars, which deducted
leaves the sum of $200.50. Subject to
the order of this court this the 4th day of December 1865

Which is unexcepted
to and in all things confirmed and approved, and the said James A. Lackey and
Benjamin A. Sinclair having sold and assigned this purchase of said land to Benjamin S. Lunsford and coming him
into open court and requesting that the title of said land be vested in said Benjamin S. Lunsford in their …… and
stead.
It is therefore ordered adjudged and
decreed that the right title and interest of the said Benjamin
F. Norris and wife Jane Norris, Robert Acuff and wife Lucinda Acuff,
Amanda Sanders, Harriett Sanders and Julia Sanders be divested out of them and
vested in the said Benjamin S. Lunsford,
his heirs and assigns forever, and it is ordered that said George Johnston,
Clerk and Commissioner, pay said sum of $200.50 to William Lunsford,
administrator of said James Sanders, deceased, to be by him administered.
