Circuit Court, June
Term, in the year of our Lord one thousand eight hundred and fifty three.
The grand jurors of
the State of Tennessee, elected, impannelled, sworn
and charged, to inquire of the county aforesaid, upon their oath present; That Arery D. Lunsford late of said county on the first day of
April in the year of our Lord one thousand eight hundred and fifty three with
force and arms in the county aforesaid, in and upon one Elsey
Taylor in the peace of God and the said State, then and there being, did make
an assault, and him the said Elsey Taylor [should
state Aris Lunsford] did then and there beat, wound
and ill-treat, and other wrongs to the said Elsey
Taylor then and here did, to the great damage of the said Elsey
Taylor and against the peace and dignity of the State.

You are hereby commanded to summon H. R.
Osteen and Rezen S. Byrne and Elsey
Taylor if to be found in your county, personally to be and appear before the
Judge of the next Circuit Court to be held for the county of Lauderdale, at the
Court House in the town of Ripley on the 3rd Monday in October next,
on the first Wednesday of said term then and there to testify and the truth to
speak in behalf of State in a certain
matter of controversy, wherein the State of Tennessee is plaintiff, and Aries
D. Lunsford is defendant; this they shall in no wise omit under the penalty
prescribed by law.

Lauderdale, at the Courthouse, in the town of Ripley, then and there to answer
THE STATE OF TENNESSEE ON A BILL OF PRESENTMENT FOR ASSAULT AND BATTERY.
Herein fail not, and have you then and there

Osteen, Rizen S. Byrn and Elsey Taylor personally to be and appear before the Judge
of Lauderdale Circuit Court, at a term of said Court to be held for the county
of Lauderdale, at the Court House in Ripley, on the third Monday in February on
the 1st Wednesday of said term next, then and there to testify and
the truth to say, in behalf of the State
in a certain matter of controversy in our said court depending, wherein
the State of Tennessee is plaintiff, and Aries D. Lunsford is defendant, this
they shall in no wise omit, under the penalty prescribed law. Herein fail not,
and have you then and there this writ.
