To the sheriff of
Whereas
heretofore to wit at the June Term 1850 of the Circuit Court of Lauderdale
County in said State, Raleigh Smith recovered a Judgment against John C.
Claiborne for Sixty Two Dollars 90 cents on which said Judgment and Execution
was issued to Ivey Chandler Sheriff of said County on the 9th day of
July 1850 which Execution was returned Nulla Bona,
and afterwards to wit on the 4th day of Sept 1850 a Garnishment was
served upon one Patrick H. Pugh summoning him to appear at the Oct Term 1850 of
said Court, and answer what he was indebted to the said John C. Claiborne, and
being solemnly called to come into Court and answer said garnishment came not
but made default.
Whereupon
it was considered by the Court that the said Raleigh Smith recover of the said
P. H. Pugh the sum of Forty two 76 dollars the balance of his debt against the
said Jno. C. Claiborne unless the said Pugh show good
and sufficient cause to the contrary, thereof, at the next term of this Court.
We
therefore command you that you make known to the said P. H. Pugh the tenor and
effect of this writ, and summon him personally to appear before the Judge of
our 10th Judicial Circuit at a Circuit Court to be holden at Ripley in said County on the third Monday in June
next, then and there to show cause why the said Smith shall not have his
execution against him for the said sum of Forty two 76 dollars. Herein fail not
and have you then and there this writ.

Answering
says that at the time of serving said summons he was indebted to said John C.
Claiborne in the sum of $19 – that he did not then have any other property or effects
of the said John C. Claiborne in his hands and knows of no other person who has
