Hales' notes 1980 Genealogical History of the Hale Family in
Virginia. The first emigrants of the Hale family came to America
in 1632 bearing the Coat of Arms of the Kent-Hales. The family
was numerous in Massachusetts and Connecticut and records
indicate that seven brothers joined the American Army in the
Revolution. Most of them served under General Washington in New
Jersey and Pennsylvania, with several of the survivors later
moving southward and located in Franklin County, Virginia.
Lewis Hale was from the branch of the family that moved to
Franklin County, Va. and in 1758 he married Mary Burwell a
descendant of the Burwells of Jamestown, Va. He and his wife
moved westward and settled on Elk Creek in Grayson Co., Va, then
known as Hale Settlement. They reared a family of six sons
and two daughters, all of them settled nearby. When Grayson
County was formed in 1792, Lewis Hale was the first Magistrate
appointed by Henry Lee. Lewis Hale who was born in Franklin
County Va. in 1737 was a soldier and Patriot and actually
served under Colonel Campbell and Crockett(?), including the
Battles of Kings Mountain in 1780 and Gulfordin 1802. The six
sons of Lewis Hale and Mary Burwell all served in the War of
1812; they were Richard, William, Dudley, Francis, Lewis Jr.
and Stephen Hale. The two daughters were named Elizabeth and
Mary. William the second son was born in 1771 and married Lucy
Stone. From this union Col. Stephen Hale (second son of Wm.
Hale) was born and later married Frances Bourne. To this union
was born Rev. Wiley Dickenson Hale.......... From the Hale and
Burwell Genealogy by Mrs. Anna G. RichLewis Hale - Soldier and
Patriot who fought for the American Revolution, Served under
Col. Crockett and Col. Wm. Campbell the battle of
King's Mountain and Guilford Courthouse among others. He was
born in Franklin Co. Va. in 1737 and Died August 2, 1802 in
Grayson Co. Va. He resided in what is now known as Elk Creek,
but during the revolution was known as Hale Settlement as there
were numerous families of Hales there at that time. Lewis Hale
- Married Mary Burwell of Glouchester County, Va. in 1758 and
to this union was born eight children six sons and

Would appreciate any help you can render to me in fleshing out genealogical information on some great greats on my grandmother's side: Lewis HALE, of Franklin Court [County?], VA, Stephen HAIL/HALE of Grayson County VA, Mary BURWELL, of Grayson County VA, William BOURNE Sr., reportedly a Private in the Revolutionary War, who may have supplied munitions to the Continental Army; Minitree JONES, Major Abner JONES.
Lewis Hale married Mary Burwell, who was a descendant of the Burwells of Jamestown, VA. Soon after his marriage, he moved from what is now Franklin Co, VA, to the upper part of the New River Valley, and settled on Elk Creek, VA. He had a brother-in-law named John Walden. When Grayson Co was formed in 1792, Lewis Hale was one of the first Magistrates of the court. Lewis Hale is said to have been a Revolutionary War soldier. Lewis Hale's 6th son, Stephen, married Frances Bourne, daughter of William (b Aug 23, 1743) and Rosamond Jones (b Feb 14, 1750) Bourne. Ref: Nuckolls book. And here's more -------------------------------------The will of Francis Haile, written 1775 Bedford Co, VA, recorded 1780, names wife Adara; sons Richard, Stephen, Lewis; daughters Elizabeth, Mary, Ruth, Ushley, Mourning; witnesses were Jonathan Pratt, George Bowles, Barnabas Arthur. Lewis Haile of Bedford Co, VA, in 1773, bought 130 acres of land in Pittsylvania Co from Nathaniel Christain and Jean, his wife. In 1778, Lewis Hale and wife Mary sold Pittsylvania Co land.
In 1779, Lewis and Mary Haill of Patrick County, VA, sold 200 acres in Patrick and Henry Counties to Robert Cowan of Bedford County, VA. Ref: Patrick County Deed Book 1 page 293.

Will: [Authors comments: This article was originally posted on this site in early 2000. Since then, many favorable comments and support for the conclusions reached have been received. This Nov. 2000 update is a result of the authors receipt of a new, more complete, set of photographs of the Hale Cemetery which revealed features not seen in the previous set].

Will: Introduction: Two different dates are widely published for Lewis Hale's death, March 12, 1802 and July 2, 1802. The purpose of this document is to furnish conclusive evidence in support of the March date.

Will: Source No. 1 - Inventory and Appraisal of Lewis Hale's Estate: Apparently, Lewis Hale (Sr.) did not leave a formal will. However, an inventory and appraisal of his estate was made after his death and recorded in Grayson County, Virginia Will Book No. 1, 1796 -1839, Reel 9, pages 14 -16. Below is a summary of the inventory and the full text of the closing statement.

Will: Inventory and appraisal summary: Livestock, household items, horses, saddles and harnesses, farm implements, carpentry tools, plus many additional items, together with their value, are recorded in an extensive list. The grand total of all goods was $996.32. A sampling of the inventory, exactly as worded, appears below.

Will: In Pursuance of an Order of Court, We have appraised the personal Estate of Lewis Hail Dec'd shown to us and Inventory of which is hereto annexed amounting in the whole to nine hundred nintey six dollars thirty two cents. Given under our hands this 3rd day of April 1802.

Will: Source No. 2 - Hale Cemetery Photographs The Hale Family Cemetery is located in Elk Creek, Virginia on a hill above where the old Hale mansion was once built. At the front of the cemetery are two decorative iron gates which swing open at the center. Incorporated within the iron scroll work at the upper portion of the gates is the inscription, "HALE 1802."

Will: In 1972, the Rev. Vickrey Dougherty and his wife, Anna, visited Elk Creek to do research for the book Anna published in 1985, "Sharing the Hidden Secrets of the Past in Dougherty History." As part of their research, they took several photographs at the Hale Cemetery. The Rev. Dougherty, a Methodist Minister, is a descendant of Rosamond J. Dougherty, nee Hale, a daughter of Lewis Hale Jr. and Elizabeth Bourne.

Will: In 1991, sisters Geraldine Moreton and Ruby Yeakley also took a series of photographs at the Hale Cemetery which supplement the 1972 Dougherty set. Mrs. Moreton and Mrs. Yeakley are descendants of Rufus M. Hale, a brother of the Rosamond J. Dougherty mentioned above.

Will: One photo shows a view through the iron gates at the front of the cemetery. Lewis Hales grave monument can easily be identified in the background by its distinctive shape as it is the same monument described and depicted in the book published in 1914 by B. F. Nuckolls, Pioneer Settlers of Grayson County, Virginia, pages 108 to 113.

Will: The monument is estimated to be about nine feet tall. Located between the white granite base and the top cap is a four sided white granite obelisk.

Will: Views of the four faces of the obelisk reveals that an inscription is carved into each face. Close-up photos of the two inscriptions which establish the death dates of Lewis Hale and his wife Mary [Burwell] are shown below.

Will: The filing date of Lewis Hail's estate inventory and appraisal, with the words, "Lewis Hail, Dec'd", firmly establishes that Lewis Hail died prior to 3 April 1802.
The listing of the names of Richard Hail and William Hail, the two eldest sons of Lewis Hail, as administrators of the inventory and appraisal, gives us reasonable assurance that the document was for their father, the particular Lewis Hail (Hale) who married Mary Burwell.
The monument definitively states that Lewis Hale died on March 12, 1802. This March date obviously conflicts with the statement on page 108 of the Nuckolls book stating that Lewis Hale died on July 2, 1802.
