Whereas Thomas BOYD of Loudon C o., VA, hath lately departed this life intestate, leaving real property in the said county o f Loudon containing 131 acres, 2 roods, 24 1/2 poles, and James BOYD his brother, John KEMP w ho intermarried with Nancy BOYD, a sister of the said Thomas BOYD deceased, John BOYD, Willia m BOYD and BOYD, which John, William and Elizabeth are children of William BOYD deceased, ano ther brother of the said Thomas BOYD deceased, William WATSON who intermarried with Polly BOY D a daughter of Elizabeth BOYD another sister of the said Thomas BOYD deceased, George ROSE w ho intermarried with Jane BOYD a daughter of John BOYD deceased another brother of the said T homas BOYD deceased, and William BELL alias BOYD a son of Jane BOYD deceased another of the s isters of the said Thomas BOYD deceased, his legal representatives and heirs at law, and wher eas the said John BOYD, John KEMP and Nancy his wife, John BOYD, William BOYD, William WATSO N and Polly his wife, George ROSE and Jane his wife have made a sale and executed a deed of c onveyance for the said real property to the above bound Presley CORDELL which said deed bear s date in this 10 Apr in the present year and whereas one of the said representatives to wi t Elizabeth BOYD was at the time of executing the conveyance aforesaid and still is an infan t under the age of 21 years, therefore incapable in law of joining in that conveyance of th e said land and William BELL the son of Jane BOYD another of the representatives of the sai d Thomas BOYD deceased is now absent and has not been heard of by any of the other representa tives for 7 years last past. Now the condition of the above obligation is such that if the sa id Elizabeth BOYD do and shall after attaining the age of 21 years or whenever thereafter req uired by the above named Presley CORDELL his heirs or assigns by a good and sufficient deed o f conveyance convey to the said Presley CORDELL his heirs or assigns all her right title an d interest in the land mentioned and described in the deed above mentioned and further shoul d the said William BELL be in existance and the said William BELL being thereunto afterward s required by the above named Presley CORDELL his heirs or assigns by a good and sufficient d eed of conveyance convey to the said Presley CORDELL his heirs or assigns all his right titl e and interest in the land mentioned and described in the deed above mentioned, then the abov e obligation to be void, otherwise to remain in full force, power & virtue.
