Pirtle and Jane Pirtle Decree This cause this day came on to be heard finally upon the report of the Special commissioner appointed to sell the Lands in the pleading mentioned, which report being unexcepted to, is in all things confirmed and is in the words and figures following, William Farley and Mary his wife, Jacob L. Pirtle and Elizabeth Vermillion, Elizabeth H. Pirtle, Isaac C. Pirtle, Susan Duncan, William Earles and Charity his wife, Hosea Stamps and Sarah his wife, Nancy Earles, George W. Pirtle and Susan (sic) his wife, William Pirtle, George W. Pirtle, Joseph N. Pirtle, Wm M. Pirtle, Jane Pirtle. Petition to Sell Land Exparte. Report. The undersigned having appointed by the Honorable Circuit Court of White County at the February term 1842 Special Commissioner to sell the land mentioned in the petition in this cause which the said George Pirtle died Seized and possessed of in White County. Begs leave to report that he did advertise said Land as directed in the Decretal order made in this cause in the Sparta Gazette and four public places in White County forty entire days before the day of Sale, and that he did Sell said lands upon the premisses on the 8th day of April 1842 to the following persons and in the manner following to wit: Sold all the Lands lying on the East side of the main road, Beginning at the South boundary line where said road crosses the line of said lands, thence northernly to opposite the head of the, Spring, thence making an offset such was oly to the middle of the head of the Spring leaving one half of said spring to the East parcel of Land now sold thence with the middle of the Spring branch to the mouth of the same where it empties into the creek containing 95 acres more or less to Elijah Pirtle for the sum of Two hundred and twenty six dollars he being the highest best and last bidder and took his note with Marmaduke Williamson and Robert C. Pirtle security, due duly and payable twelve months after date to William G. Sims as commissioner. I sold also the lands lying on the west side of the road, Beginning on the South boundary line where the road crosses said line, and running north with the line of the other parcel, Sold to Elijah Pirtle to the mouth of the spring branch and to include one half of the Spring supposed to contain One hundred and sixty acres more or less to Robert C. Pirtle for the sum of One hundred and fifty five dollars. Also sold the tract lying on Ceder Creek containing One hundred and ninety six acres for the sum of fifty One dollars and fifty cents to Robert C. Pirtle he being, the highest best and last bidder and took his note with Elijah Pirtle and Hosea Stamps security payable to William G. Sims as commissioner due twelve months after the date thereof of which is most respectfully submitted to the Honorable Court June 6th 1842. William G. Sims Commissioner. Whereupon the Court doth order adjudge and decree, that all the title, right and interest of the petitioners and heirs at law of said George Pirtle deceased to the lands in the foregoing Report devest and the land hereby vested in the purchasers respectively according to the boundaries set out in said Report. It is further ordered that a lein be retained upon the lands until the purchase money be paid, and that Petitioners pay the costs of the proceeding for which let execution issue as at Law. A true Copy from the Records. Given at office this 19th day of March A. D. 1844. Test. W. G.
