Index Vol. I, Book MM Pages 528, 529, 530 Power of Attorney Know all men by these presents, that we Jacob Jacob Thumma et al: Thumma, Peter Thumma, Henry Thumma, Joseph To Thumma, John Cosier who was intermarried with Abraham Waggoner et al: Catherine Thumma (since deceased) Jacob Shambaugh and Elizabeth his wife late Elizabeth Thumma, Jacob Carl & Anna his wife late Anna Thumma, all of Cumberland County and State of Pennsylvania, and Jacob Fertig and Fanny his wife, late Fanny Thumma, & Andrew Fertig and Barbara his wife, late Barbara Thumma, of the State of Virginia, all legal heirs and representatives of Jacob Thumma, late of Frankford township, County of Cumberland and State of Pennsylvania deceased, Have made, constituted and appointed, and by these presents do make, constitute and appoint, in our place and stead put and depute Abraham Waggoner & Christian Thumma, of the County of Cumberland and State aforesaid, our true and lawful attornies, for us and in our names, place and stead, to grant, bargain and sell, all the Four following described messuages or tracts of lands, which the said Jacob Thumma decsd., died, seized of, and which said four several tracts of land by the Laws of Pennsylvania relating to Intestate estates, to us, together with the said Abraham Waggoner & Magdalena his wife, late Magdalena Thumma, and the said, Christian Thumma, as heirs and legal representatives of the said Jacob Thumma dec'd, did descend and come - to wit,one messuage or tract of land situate in Frankford township, County and State aforesaid, adjoining lands of Abraham Hickernell, Jacob Waggoners heirs, John Thumma and Jacob Thumma Jr. Containing eleven acres and twenty perches, strict measure. Also one other tract of land situate in Morth Middleton township, County and State aforesaid, adjoining Andrew Elliott, William Douglas and others, Contain- ing one hundred and seventeen acres and one hundred and seven perches of the allowance. Also one other tract of land situate in Frankford township aforesaid, adjoining lands of Abraham Lukenbill formerly, & other lands of Jacob Thumma deceased & land of John Koser, Peter Smith and Abraham Moyer, Containing forty four acres and one hundred and fifty five perches & the allowance. - Also one other tract of land situate in said township of Frankford, adjoining lands of Christopher Snyder, George Nickey and George Kosh, Containing sixty two acres and one fourth of an acre & the allowance, with the appurtenances, and all our estate, right, title and interest in and to the same four several tracts of land, unto such person or persons, and for such price or prices, as they shall think proper, and also for us and in our names, places and stead, and as our proper act and deed, to sign, seal, deliver and acknowledge, all such Deed or Deeds of Conveyance, as shall be necessary, for the absolute granting and assuring of the premises unto the purchasor or purchasors in fee simple, giving and granting unto our said attorney, full power and ab- solute authority to do, execute and perform, any act or acts, thing or things whatsoever, that shall be needful and necessary to be done, touching or concerning in any wise the premises or the conveying or assuring thereof to any person or persons and uses aforesaid, in as full and ample manner to all intents and purposes as we ourselves might or could do if we were then and there personally present, and also ratifying and confirming all and whatsoever Acts and things our said attornies shall do, or cause to be done, by virtue and according to the true intent and meaning of these presents In Witness whereof we the said Jacob Thumma, Peter Thumma, Henry Thumma, Joseph Thumma, John Koser, Jacob Shambaugh and Elizabeth his wife, Jacob Carl and Anna his wife, Jacob Fertig and Fanny his wife, Andrew Fertig and Barbara his wife, have hereunto set our hands and seals this seventeenth day of April A.D. Before me Andrew Boden esq. One of the Justices of Peace in and forsaid County, came the within named Jacob Thumma, Peter Thumma, Henry Thumma, Joseph Thumma, John Coser, Jacob Shambaugh and Elizabeth his wife, Jacob Carl and Anna his wife and severally acknowledged the above and foregoing Letter of Attorney to be their Act and deed and desired that the same might be recorded as such according to Law. The said Elizabeth wife of the said Jacob Shambaugh, being of full age & by me duly examined separate and apart from her said husband and the contents thereof being first made known to her, declared that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the said Letter of Attorney, without any coercion or compulsion on the part of her said husband. In testimony whereof I have hereunto set my hand and seal the day and year above written. Signed, Andrew Boden Shenandoah County, V.: We George Moore and William Kerlin Justices of the Peace for said County Do hereby certify that Jacob Fartich and Andrew Fartich parties to the within power of attorney and hereto annexed, personally appeared before us in our County aforesaid and acknowledged the same to be their Act and deed and desired us to Certify the said acknowledgement to the Clerk of the said County. Given under our hands and seals this 9th day of June 1829. Signed, George Moore, William Kirlin Shenandoah County, V: We George Moore and William Kirlin Justices of the peace for said County, do hereby Certify that Fanny Fartick, the wife of Jacob Fartich, and Barbara Fartich the wife of Andrew Fartich, parties to the within Letter of Attorney and hereunto annexed, personally appeared before us in our county aforesaid and being examined by us privately and apart from their husband, and, having the within Letter of Attorney fully explained to them they the said Fanny and Barbary Fartich acknowledged to be their act and deed and declared they did willingly signed, sealed and delivered the same and that they wish not to retract it. Given under our hands this 9th June 1829. George Moore, William Kirlin Virginia, to wit: I Philip Williams Clerk of the County Court of Shenandoah in the aforesaid State do hereby certify that George Moore and William Kirlin Esquires before whom the above Letter of Attorney was acknowledged.
