William Duncan the Elder of Brumfield Parish, Culpeper County, to my son Rice Duncan of county aforesaid. For love, good will and effection and for his further and better support and maintenance hereafter in this world. 200 acres in Brumfield in the Gourdvine fork of Rapahannock River and lying on Mill Run . . . on the side of a branch a corner made for David Kinkaid . . . corner to John Duncan . . . in the head of a bottom another corner to John Duncan . . . corner to Joseph Duncan . . . on a ridge . . . houses, orchards, fences, inclosure . . . Culpeper County Virginia Deed Abstracts, 1789-1790, Vol.11, p.103, FHL #975.5392 R2s. Articles of Agreement made & concluded this 21st day of May 1790 Between Joseph Duncan of County of Culpeper of one part and John Duncan, Son & heir at Law to Rawley Duncan dec'd of the County of Russell of other part; Whereas Rice Duncan Dec'd., late of County of Russell, having property in County of Culpeper made his last Will & Testament proved in the County Court of Culpeper (but not recorded by means of its being mislaid) wherein he devised to Joseph Duncan his Brother all his Estate both real & personal, several years after, the said Rice Duncan removes to the Settlement of Clinch in aforesaid County of Russell where he acquired property also & soon after departed this life. Now a dispute has arisen between Joseph Duncan & John Duncan concerning the legal as well as an equitable title to the said Estate and wishing to settle the matter without litigation, have come to the following compromise; The said Joseph Duncan for him self & his heirs doth forever quit claim release & make over unto John Duncan his heirs all his right and title (under the Will aforesaid) to all the Estate both real & personal which Rice Duncan died seized & possessed of in County of Russell, and John Duncan for himself & his heirs forever quit claim release & make over unto Joseph Duncan his heirs all his right & title (as heir at Law to his Father, Rawley Duncan, who was Eldest Brother of said Rice Duncan dec'd). to all the Estate both real & persaonal which Rice Duncan was seized & possessed of in County of Culpeper. For the performance of the above covenant the parties for themselves their heirs do bind thenmselves each to the other in the penalty of Five hundred pounds current money of Virginia. Pendleton 21 Jun 1790 and by Isaac Browning 20 Sep 1790.

     Deed Abstracts of Culpeper County, Virginia, Vol.7: (1783-1785), p.21, FHL 975.5392 R2s, This indenture made this 17th day of November in year of our Lord One thousnad seven hundred & Eighty three between James Duncan and Seine his Wife of County of Culpeper & State of Virginia of one part and William Roberts of same . . . for sum of Three hundred & five pound current money of Virginia . . . paid James Duncan & Seine his wife . . . bargain and sell unto William Roberts his heirs all that tract of land lying in County aforesaid . . . North side of the River and corner to the land late the Property of Capt. John Strother deceased formerly Rawley Duncans, . . . containing Fifty one acres . . . together with all houses gardens orchards etc. . . . Signed: James Duncan, proved in Court 17 Nov 1783.

Deed of gift - I James Duncan of Bromfield Parish and County of Culpeper in the Province of Virginia for divers good causes and consideration me hereunto moving by these presents do freely give and deliver unto my son Reuben Duncan, one Negro named Poll, to my son William Duncan, one negro woman named Vilet, to my son James Duncan one Negro named Janett, to my son Willis Duncan, one negro named Morton, to my Daughter Frances Duncan, one negro named Selah, to my daughter Mary Duncan, one negro name S---, to my daughter Ann Duncan, one negro named Cate, to my daughter Sarah Duncan, one negro named Nelly. The above mentioned Negroes to be retained in my possession until my sons arive at the age of Twenty one years and my Daughters to the age of eighteen years or marry. Signed 10 Sep 1794, James Duncan in the presence of William Menefee, Samuel McQueen, Frederick Duncan.

     PROBATE: Albermarle County, Virginia will Bk 1 p.20; 1751; FHL #975.5482R2sa: In the name of God, Amen, I Thomas Phelps of Albemarle County, being weak in Body but in sound & perfect memory do make this my last will and Testament in manner & form as followeth: Item: I give my soul to God as gave it . . . . . . Item: I lend unto my loving wife, Elizabeth Phelps, during her widowhood, all my whole Estate Real and Personal. Item: I give and Bequeath unto my loving son, Thomas Phelps, Three Hundred acres of land lying on both sides of Bridle Creek joining his own lines to him & his heirs forever. Item: I give and Bequeath unto my loving son, John Phelps, the Plantation whereon I now Dwell & the Island I now tend in and three hundred acres of Land on both sides of Hunt's Creek joining Nicholas line to him and his heirs forever. Item: I give & Bequeath to my Loving Daughter, Mary Patterson one shilling sterling. Item: I give & Bequeath unto my Grand Daughter, Joyce Patterson & my Grandson, Peter Patterson - - Betwixt them both one child's part. It is my Will and Desire that all my Personal Estate shall be Equally Divided among all my children Except my Daugther, Mary Patterson, & my will and Desire is that my Estate shall not be appraised enduring my wife's time & I do appoint & ordain my son, Thomas Phelps & son-in-law, Richard Given to be Executors of this my last Will & I do by these presents revoke . . . . . .
