An Act to Direct Descents - 20 Jan 1786
for Persons who died without a will

from Acts of Assembly Chapter XLV - Vol 204, page 184


If any person owning real estate dies intestate, real estate shall descend 


1st to the children or their descendants equally

  • If estate was purchased by the decedent (and not descended from parents) 2nd - if no children, then to the brothers and sisters of decedent or their descendants 3rd - if none, then to the father 4th - if none, then to the mother 5th - if none, then to the paternal grandfather; then his descendants 6th - if none, then to the maternal grandfather; then his descendants 7th - if none, then to the spouse; if none, then to the spouse's kindred (if multiple spouses and all died before the descedent, then divided equally amongst all kindred of all spouses)
  • If estate descended to the decedent thru the father - 2nd - if no children, then to the father 3rd - if no father, then to brothers and sisters of the blood of the father and their descendants equally 4th - if no brothers or sisters, then to paternal grandfather 5th - if no paternal grandfather living, then to descendants of paternal grandfather 6th - if none, then to paternal great grandfather, then his descendants 7th - if none, then to the mother; her descendants; then maternal ancestors as with the paternal ones above.
  • If estate descended to the decedant thru the mother - 2nd - if no children, then to the mother 3rd - if no mother, then to brothers and sisters of the blood of the mother and their descendants equally 4th - if no brothers or sisters, then to maternal grandfather 5th - if no maternal grandfather living, then to descendants of maternal grandfather 6th - if none, then to maternal great grandfather, then his descendants
