This indenture, made the first day of April, in the year of our Lord, one thousand eight hundred
and fifty three. Between John Miller, of the city of Lancaster, in the state of Pennsylvania, and
Samuel Miller of the same City, trustee of the said John Miller. Under a deed in trust, herein after
recited, of the first part: And Elijah Zittle: of Township, Lancaster County aforesaid, of the
second part: (Whereas the said John Miller, in and by deed in Trust, bearing the date of the 24th
day of June A.D. 1852, recorded in the Recorders Office, of Lancaster County; in Record Book
Y. Vol. 7 at page 231 tc. for the consideration therein mentioned, did grant, bargain, sell, release
and confirm, all his Real Estate, land, tenements, hereditaments, and appurtenances, whatsoever,
and wheresoever: including, the herby granted premises, unto the said Samuel Miller, of the first
party hereto: his heirs and assigns for ever: In trust, however, among other purposes, that he the
said Trustee, Shall at anytime - thereafter, upon the request and distractions, of the said "Cestui
quo. Trust," John Miller; sell and dispose of such part or parts of the real Estate, thereby
conveyed, at public or private sale, as he the said John Miller, Shall direct, and convey the part or
parts so sold, to the purchases, there of his or her heirs, and assigns for ever. in fee simple, clear
and free from said Trust, as in and by the said deed in trust or reference, will more at Sarge
appear. And Whereas, the said Samuel Miller Trustee aforesaid: in Execution of said recited
Trust, and upon the request and direction of the said John Miller, the "Cestui quo. Trust,"
aforesaid justified by his joining, in his Indenture of conveyance, and signing, sealing and
executing these presents: having given due timely and Legal public notice of the time and place
of sale. Did on the twenty third day of October, A.D. 1852. Expose the premises, hereinafter
described to public sale, by vendue, or out-cry, and sold the same, to Elijah Zittle, at and for the
sum of two hundred and Eighty six dollars and fifty six cents, he being the highest and best
bidder, and that, the highest and best price bidden for the same. Now This Indenture witnesseth
That the said Samuel Miller, Trustee aforesaid, for and in consideration of the sum of Two
hundred and eighty six dollars, and fifty six cents, Lawful money of the United States, to him in
hand paid by the said Elijah Zittle, at and before the the ensealing and delivery hereof the receipt
and payment whereof He does, hereby acknowledged and thereif does acquit and for ever,
discharge the said Elijah Zittle, his heirs, Executors and administrators by the presents has
granted, bargained, sold, aliened, en---ed, released and confirmed, and by these presents by the
request and directions of the said "Cestui quo. Trust," John Miller does grant, bargain, sell, alien,
enscoss, release and confirm unto the said Elijah Zittle, and to his heirs and assigns, All that
certain Lot or peice of ground, situate in the township of Martick in the county of Lancaster,
aforesaid bonded, and described as follows, to wit: Beginning at a stone or corner Land of Henry
Shenk and John Eckman thence south Eighty seven degrees west twenty nine perches, to a post;
thence by land of Daniel Eckman, North three degrees west, twenty five perches and a quarter to
a post: thence north eighty seven degrees, East, twenty nine perches, to a post; thence south three
degrees East, twenty six perches, and a quarter, to the Beginning. Containing four acres and one
hundred and twenty one perches, Strict measure, Being Part of a tract of nine acres and one
hundred and six perches of land more or less, which John Bachman and Esther his wife by deed
of Indenture dated the Eleventh day of September A.D. one thousand eight hundred and forty one
granted and conveyed unto John Miller of the party of the first part hereto his heirs and assigns
forever. Together with all and singular the houses, outhouses, edifices and buildings thereon
erected and being; and all ways, waters, watercourses, woods, trees, fences, gardens, orchards,
rights, liberties, priviliges, advantages, hereditaments and appurtenances whatsoever thereunto
belonging or in any wise appertaining: and the reversions and remainders, rents, issues and
profits thereof: And also all the estate, right, titles, interest, use, trust, property, possession, claim
and demand whatsoever of them the said Samuel Miller, and John Miller, in Law or equity, or
otherwise, howsoever, of into or out of the same. To have and to hold, the said Lot or piece of
ground above described, hereditaments and premises hereby Granted and released (or mentioned
or intended so to be) with the appurtenances unto the said Elijah Zittle, his heirs and assigns, to
and for the only proper use, benefit and behoof of the said Elijah Zittle, his heirs and assigns
forever. And the said Samuel Miller, for himself, his heirs, Executors, and administrators, does
covenant, promise, grant and agree to and with the said Elijah Zittle, his heirs and assigns, by
these presents, that He the said Samuel Miller, has not heretofore done, committed, or wittingly,
or willingly suffered to be done or committed, any act, Matter, or thing whatsoever, whereby the
premises hereby granted, or any part thereof, is, are, or shall be, or may be, impeached, charged,
or incumbered in title, charge, Estate or otherwise howsoever. In witness whereof, the said
parties to these presents have hereunto Interchangeably set their hands and seals the day and Year
