In the name of God Amen the xxth day of Aprill in the yeare of our Lord God 1608
I William Baylie of the parishe of Hernehill in the Countie of Kent, yeoman beeing verie sicke in bodie, but perfect in remembrance (I thanke God for it) doe make and ordaine this my Last Will and Testament in manner and forme following, videlict
I bequeath my soule to almightie God my maker and Redeemr by whose merits onely I hope to bee saved and my bodie to be buried in the church yarde of the parish abovesaid as nere my wives and children as may bee

Item I doe give unto my sonne Willm Bailie my house and Tenem[en]t wh-all [withal?] any houses buildings and edifices hereto belonging And also all my lands with all the apperten[a]nc[e]s thereto belonging whatsoever during his naturall lief
And after the death of the said Wm. my sonne then I will that Joseph sonne of my said sonne William shall have my foresaid house and tenemt with all the apprtencs thereto belonging whatsoever, To him and to the heires male of his bodie lawfullie begotten for ever
And if it shall happen the said Joseph to die and depart this his n[atu]rall lief without heires male of his bodie Lawfullie begotten, Then my will is that the next sonne of my sonne William shall have the said tenemt & Landes to him and to his heires male of his body Lawfullie begotten forever; soe the heires male of my sonne William to have yt; and soe from heire to heire male of my sonne Willm. his sonnes sonnes for ever, if they have any

But and if my said sonne Willm Bailie do die and depart this his n’rall lyef and leave noe sonne nor sonnes sonnes to enjoy the said house and Lands, Then I doe give yt to my sonne Henrie Baylie and to his heires male of his bodie lawfullie begotten for ever

Item I doe give unto my said sonne Henrie Baylie to begin Three yeares next after my decease xls everie yeare during his n’rall lief to bee paid out of my lands and ten[emen]ts beforesaid and to bee paid unto my said sonne Henrie att the last [feast?] of St. Michaell tharchangell by my executor, his heires exec[uto]rs administrators or assignes

But if it happen that the said some of fourtie shillings of lawfull money of England bee not paid to my sonne Henery at the time aforesaid by my executor or his assignes; Then yt shalbee lawfull for my said sonne Henrie to enter unto anie part of the foresaid premises yearely, and ther(e) to stresse and straine, and the stresse or stresses soe Taken to leade, drive and Carrie away and then to houlde and impound untill the said Fourtie shillings bee paid as aforesaid

Item I also give unto my sonne Abraham Bailie foure pounds of Lawfull mony of England to bee paid unto him by my executor or his assignes att the feast of St. Michaell tharchangell, beeing full foure years ended next after my dece[a]se, but if it bee not paid att the time aforesaid according to this my will, Then my will is that Abraham my sonne shall have the full and whole authoritie in everie point to stresse and straine as aforesaid my sonne Henrie hath, untill he bee paid the said iiij li(bra)

Item I doe give unto my sonne Thomas Bailie my best cloke presentlie after my decease
Item I doe bequeath and give unto the three sonnes of my sonne Thomas Baily, each of them xls apeece to bee paid unto them by my executor or his assignees when they Come to the full age of one and twenty yeares, Vizt. Thomas, Henrie and William
And if it happen that anie of the said three boies doe depart this lief before they Come to the age of one and twentie yeares, then my will is, that eich of them to bee (the) others heire of their said legacies And my will is as the eldest when hee Comes to one and twentie yeares, and the other Twoe as they growe to that age to be paid

Item I doe give unto Martha Daughter of my sonne Willim Baily my bed and bedstead furnished as yt is and the presse, and the joyned table and four joyned stooles, and a great joyned Chest all standing in my parlour, to bee paid unto her att the age of one and twentie yeares

All the residue of my goods whatsoever, my funerall ended, my debts and legacies paid, I doe give whollie unto my sonne Willm Baily, whom I doe make my onely and sole executor of this my present testam[en]t and Last Will
And I doe make and ordaine Leonard Harris my overseer of this my will to see it performed, and for paines I doe give him xs to bee paid by my executor

And soe I praie unto God Almightie of his infinite great mercie and goodnes to receave my soule into his blessed Kingdome and place it among his elect children for ever
And soe I the said Willm. Bailie doe set my hand the daie and yeare first above written in the presence of:
Willm. Eviton, Writer hereof and George Rainold;
By me Willm. Bailye, my marke
Witnesses to his present will: Willm. Eviton, Clearke and George Rainold’s marke

Probatum fuit: 21st December 1608

Note: Willm Balie was buried at St. Michael, Hernhill, Kent on 27th November 1608.
