In the name of God Amen The last day of November in the Eleaventh yeare of the raigne of our Sovereigne Lord Charles by the grace of God of England Scotland France and Ireland King Defender of the faith etc. Anno dini 1635
I John Baker of Fevesham [Faversham] being Sick of Body but of good & perfect minde and memory, thankes bee given to God therefore, I doe make & ordeine this my p�sent [present] testament and last will in manner and forme following
First I bequeath my Soule into the hands of my Lord and Saviour Jesus Christ by whose death and passion onely I trust to be saved and my Bodye to bee buried in Christian buriall

Item I give and forgive unto Ralph Baker my eldest sonne one Bond or obligacon of Three score pounds wch [which] the said Ralph Baker my eldest sonne doth owe & is indebted unto mee I give more to the said Ralph Baker twenty pounds of lawfull English money to bee paid to the said Ralph by mine Executor heereafter named at the feast of St. Michaell tharchangel [the archangel] next ensuing the date hereof

Item I give and bequeath unto Nicholas Baker my sonne the Sume of tenn poundes of good and lawfull money of England to be paid to the said Nicholas Baker at the feast of St. Michaell tharchangell wch shall bee in the yere of our Lord God one thousand six hundred thirtie and eighte

Item I give and bequeath unto James Baker my sonne my Lease of two houses (wch I have in lease in the parish of Wapping in the County of Middlesex) on this Condicon that the said James shall pay into Michaell Baker my youngest sonne thirty shillings and every yeare untill such time as the said Michaell hath served out the time of his apprenticeshipe and likewise to pay Martha Baker my daughter out of the said Lease forth shillings yearely and in every yeare during the tearme of nyne yeares next after my decease the first payment thereof to begin at St. Michaell tharchangell next ensuing the date hereof

Item I will to the said James Baker my sonne shall pay unto Elizabeth Baker my Daughter forty shillings yearly and in every yeare during the tearme of fower yeares next and ymediately [immediately] after my decease the first payment thereof to begin at the feast of thannunciacon [the annunciation] of the Blessed Lady St. Mary the Virgin next ensuing as aforesaid

Item I will that mine Executor heereafter named shall pay unto Elizabeth my daughter the summe of fifty poundes of lawfull English money wch I give & bequeath unto the said Elizabeth at (the feast of) St. Michaell the Archangel wch shalbe in the yeare of our Lord God one thousand six hundred thirty and Nine

Item I give more to the said Elizabeth my daughter fifty pounds of Lawfull English money wch I give and bequeath unto the said Elizabeth at the feast of St. Michaell tharchangel wch shalbe in the yeare of our Lord God one thousand six hundred and forty

Item I give and bequeath unto John Baker my sonne fifty pounds of lawfull English money to bee paid unto the said John at (the feast of) St. Michaell the Archangel wch shalbe in the yeare of our Lord God one thousand six hundred forty and one

Item I give and bequeath unto Michaell Baker my sonne fifty pounds of lawfull English money to bee paid unto the said Michaell at (the feast of) St. Michaell the Archangel wch shalbe in the yeare of our Lord God one thousand six hundred forty and two

Provided allwayes and it is my will That if Elizabeth my daughter happen to decease this life before the time that her porcon [portion] shalbe due to bee paid That then her porcon shall be equally devided betwixt my two sonnes, that is to say, Nicholas and John Baker

And if it happen that any of my childrens porcons bee not paid according as I have bequeathed it unto them Then I will that they and either of them for want of paymt [payment] thereof may lawfully enter uppon my Messuage and Lands lying and being in the pish [parish] of Edgerton [Egerton] and to distreyne and the distresse or distresses there so taken and fownd [found] from thence to Lead drive Beare and Carry away and the same to detaine impound wthhould [withhold] and keepe untill suche time as they and every of them shalbe fully satisfied contended and paid wth all cost and damage in that case had and sustinede [sustained]

Item It is my will and monde that if Mary my wife happen to decease this life before the end & tearme of nine yeares bee expired wch have yet to come next after the date hereof Then I will that my sonne Ralph Baker shall have tenn poundes yearly out of my Landes until such time as the said nyne yeares bee fully expired from the date hereof and for want of the paymt thereof it shalbe lawfull to & for the said Ralph or his assignes to enter upon my landes and therein to distreine and the distresse or distresses thereof so taken and found from thence to lead drive Beare and carry away and the same to detaine impound wthhoulde & keep untill such time as hee shalbe fully satisfied contented and paid wth all cost and damages in that case had & susteined during the residue of the nyne yeares as aforesaid

Item If the said Mary my wife happen to decease this life wthin [within] the tearme aforesaid [Then] I give and bequeath unto John Baker my sonne fifty pounds of lawfull English money to bee paid to the said John at the feast of St. Michaell tharchangell wch shalbe in the yeare of our Lord God one thousand six hundred and forty three

Item I give and bequeath unto Michaell Baker my younger sonne fifty pounds of lawfull English money to bee paid to the said Michaell at the feast of St. Michaell tharchangell wch shalbe in the yeare of our Lord God one thousand six hundred and forty and fower

Item I give and bequeath unto Elizabeth my daughter all my houshold stuffe whatsoever

Item I give and bequeath unto James Baker my sonne my Landes called and knowne by the name of Runnersonne (?) Land lying & being in the pishes of Smarden and Hedcorne [Headcorn] in the County of Kent aforesaid to bee holden to the said James Baker and to the heires of his body lawfully begotten forever And for want of such heires of his body lawfully begotten I give and bequeath all the said Lands unto John Baker my sonne and to his heires for ever from and after the decease of the said James Baker my sonne

Item I give unto the said James Baker my sonne the Messuage and all the Landes thereunto belonging lying & being in the pish of Edgerton aforesaid wch messuage and Lands I purchased of George Renevaest (?) upon this condicon that the said James shall within the space of fower yeares next after my decease sell away the said Messuages and all the lands there and p�ntley [presently] after the sale thereof pay & discharge all my debts and legacies before given & bequeathed

Item I give and bequeath unto the said James Baker my lease of the messuage and land wch I hadd in Lease of the Right Honorable the Lord Wootton Provided allwaies & it is my will that if the said James my sonne happen to decease this life without heires of his body lawfully begotten then I will and bequeath the said Lease unto Ralfe Baker my sonne wthall [with all] profitts thereunto belonging

The Residue of all my goodes and Chattells whatsoever unbequeathed my debts Legacies and funeral paid and discharged I give and bequeath unto James Baker my sonne

Item I make & ordaine James Baker my sonne my full & whole Executor of this myne testament and last Will

In Witness whereof to every one of these sheetes of paper being five in Number I have subscribed my name and to the last of them my Seale have sett and published the same to bee my last will & testament in the p�sence [presence] of those whose names are hereunder written the day and yeare first above written

Notes:
John Baker was buried at St. Mary, Little Chart, thus:
�John Baker whose dyed at Fevesham was buryed at Little Chart Churchyarde December 19th 1635.�

It appears John Baker moved around a lot, so tracking him and his family has proved very difficult and ambiguous.
John Baker married Mary Gigoe were married at Boughton Aluph on 7th July 1595. No children have been found christened in this parish; nor at Headcorn.
Some were christened at St. James, Egerton: Martha 1 Jan 1611; Ralph 23 Oct 1603; John 1 May 1614;
Then at St. Michael, Smarden: Michaell 25th Mar 1620; Elizabeth: 24 Aug 1617; Edward 18 Jul 1619.
Wife Mary Baker was buried at Faversham on 10th August 1647, Widow.
