I Robert Baker of Barham in the County of Kent Yeoman being weak in body but of Sound and p�fect [perfect] mind & memory (God be praised) do make and ordain this my last Will and Testament in manner and Form following
Imprimis I resign my soul into the hands of Almighty God my mercifull Creator hoping for salvation only by the merits of my Lord and Saviour Jesus Christ and my body I comit to the Earth to be decently buried at the discretion of my Executors hereinafter named

Item I do nominate and appoint my two Nephews Thomas Baker and Henry Baker Executors of this my last Will and Testament

Item I give and bequeath unto my dear and loving wife Mary Baker all such goods and household stuff as were hers at the time of our Intermarriage to be taken and delivered unto her by my said Executors soon after my decease Also I give and bequeath unto my said Wife Mary the sum of ten pounds of lawfull money of Great Britain to be paid unto her my said wife by my said Executors in manner following (that is to say) Five pounds thereof at the end of one month next after my decease and the other five pounds at the end of twelve months next after my decease

And also I further give and bequeath unto my said Wife Mary for and toward her more better livelihood after my decease the sum of Foarty shillings a year of lawfull money of Great Britain for and during the terme of her natural life to be paid unto her by my said Executors at two of the most usuall Feasts or days of payment in the year (that is to say) at the Feast day of the annunciation of the blessed Virgin Mary and St. Michael the Archangell by even and equal portions half yearly to be paid the first payment out there of to begin and to be made at the First of the said Feasts that shall next happen after my decease

Item I give and bequeath unto my Niece Anne Baker whom I have bred up and who lives with me the sum of one hundred pounds of lawfull money of Great Britain to be paid unto her my said Niece by my said Executors at the end of Twelve Months next after my decease
Also I give unto her my said Niece all the furniture of the room where she usually lies together with the chests of linnen and what else is usually standing there to be delivered unto her by my said Executors soon after my decease

Item as touching all that my Messuages or Tenement and about three acres of land with the appurtencs [appurtenances] situate lying and being in Barham foresaid and which I have purchased of Sr Basil Dixwell Baronet I give and bequeath the same and every part thereof unto my two Executors Thomas Baker and Henry Baker their Heirs and Assigns for ever they paying out of the same unto my aforesaid Niece Anne Baker the abovesaid Sum of One hundred pounds before bequeathed unto her at the end of Twelve Months next after my decease

And in default thereof I do I do hereby Will and order that my said Executors their Heirs and Assignes do convey the Inheritance and fee simple of my aforesaid reall Estate unto my said Niece Anne Baker her Heirs and Assignes for ever in lieu of her aforesaid Legacy of one hundred pounds and which shall be in full Satisfaction to her for the same

Item all the rest of my goods Chattells and personall Estate my Debts Legacies and Funerall Expences being first paid and discharged I give and devise between my aforesaid Two Executors and their Brother John Baker and their Sister Mary the wife of Anthony Gilpin, Sarah Baker and Elizabeth Baker equally to be divided between them share and share alike

And I do hereby revoke disannull and make void all and every other former will and wills by me heretofore made, declaring this and no other to be my last Will and now my mind is at quiet waiting with patience untill it shall please Almighty God to call me out of this transitory Life

In Witness whereof to this my last Will and Testament contained in one sheet of paper and this part of a sheet to the first sheet whereof I have only set my hand and to the last sheet my Hand and Seal the Eight and Twentieth day of December in the Eighth Year of the Reign of our Sovereigne Lady Queen Anne of Great Britain, etc. Anno dini 1709

Probatum fuit: Decimo octavo [18th] die February Anno dini 1709(10)

Notes:
Robert Baker was buried at St. John the Baptist, Barham on 31st January 1710.
His wife Mary, Widow, was also buried there 9th September 1718.
Robert Baker, Husbandman, married Mary Beane, Widow, at St. Alphage, Canterbury on 4th November 1706.
There are no known children of this marriage.
Robert Baker was the son of Thomas and Sarah Baker � he was christened 12 Feb 1643 and Brother John on 6th December 1640 � both at Barham.
Brother John Baker and his wife Mary had children (all christened Barham) as mentioned in the above Will:
3 Aug 1679 Thomas; 9 Jan 1681 Henry; 4 Nov1683 Mary; 25 Apr 1685 Robert (Bu: 30 Apr 1685); 9 Jan 1687 Sarah; 13 Sep 1689 Ann; 13 Sep 1682 John; 24 May 1695 Robert (Bu: 2 Dec 1695) and 1 Mar 1701/2 Elizabeth .
