Will of Narborough Filmer Baker

of Middlesex, Ex Kent

This is the last Will and Testament of me Narborough Filmer Baker late of Walmer in the County of Kent now residing at No. 9 St Alban’s Place, St. James in the County of Middlesex, late Lieutenant Colonel of the 80th Regiment Foot
First I direct that all my just debts funeral and testamentary expences be paid with all convenient speed after my decease

I give all my plate, jewellery, trinkets and other valuables of a like nature to my sister Elizabeth Honora Lady Lee, Widow of the late Admiral Sir Richard Lee
I also give to my said sister Lady Lee a legacy of two thousand five hundred pounds which I wish to be paid to her with all convenient speed after my decease

I give to my sister in law the Countess Augusta Baker widow of my brother Sir Thomas Baker a legacy of Three hundred and fifty pounds
and to her two sons Eric and Oscar Baker and her daughter Elizabeth Countess Piper I give a like legacy of Three hundred and fifty pounds each
And I direct that the legacy to my said niece Elizabeth shall be paid into her own hands

To Mrs. Ann Baker widow of my late brother William Baker I give the sum of Three hundred and fifty pounds
and to her four daughters Elizabeth, Harriet, Mary and Matilda and her son Hercules a legacy of Three hundred and fifty pounds each

To my Nephew and Niece Charles Hougham Baker and Harriet Dick wife of Commander Dick of the Royal Navy the son and daughter of my late brother Charles, I give a legacy of Three hundred and fifty pounds each
To Charles Tysden Esquire of Narborough Hall, Nofolk; John Tysden Commander of the Royal Navy; Mrs. Sophia Holroyd wife of The Reverend James Holroyd and Mrs. Elizabeth Smith, the sons and daughters of my late sister Sophia I give a legacy of Three hundred and fifty pounds each
and to The Reverend Thomas Tysden Bazeley son of my late sister Harriet Bazeley a like legacy of Three hundred and fifty pounds

And Whereas I am entitled to the moiety of the proceeds of some Sheep in Australia which sheep are the joint property of John West Esquire of Eversley in Hertford Bridge and myself Now I direct that if the entire proceeds of such sheep shall be received by my Executors that they do forthwith pay over to the said John West Esquire his moiety of such proceeds And I direct that my own moiety shall fall into the residue of my estate

And as to all the Rest Residue and Remainder of my Estate of what kind soever and wheresoever situate I give devise and bequeath the same to my said sister Elizabeth Honora Lady Lee for her own absolute use benefit and disposition

And I appoint my nephews Charles Tysden of Narborough Hall in the County of Norfolk Esquire; The Reverend Thomas Tysden Bazely, Rector of Poplar and James Powell Esquire of Hamilton Terrace, St. John’s Wood in the County of Middlesex Gentleman, Executors of this my will and do give to the said James Powell a legacy of one hundred pounds as some compensation for the trouble he has already taken in my affairs and for the trouble that he will have hereafter in the character of Executor of this my will

And I do declare that they may at all times after the first monies that come to their hands reimburse themselves respectively all costs damages and expences they may be put to in and about the execution of all matters relating to this my will and that neither of them shall be answerable for the other nor for any loss unless the same shall happen by or through their wilful neglect and default respectively nor shall either of them be answerable for more monies than shall actually come to their hands respectively

and hereby revoking all former wills by me at any time heretofore made I do declare this to me my last will and testament
In Witness whereof I the said Narborough Filmer Baker the Testator have hereunto set my hand this first day of April one thousand and fifty two

Signed by the said Narborough Filmer Baker the Testator in the presence of us present at the same time who have signed our names as witnesses thereto in his presence and in the presence of each other this first day of April one thousand eight hundred and fifty two

Proved at London 23rd April 1852 before the Worshipful Frederic Thomas Pratt Doctor of Laws and Surrogate by the oaths of Charles Tysden Esquire and The Reverend Thomas Tysden Bazely, Clerk, the nephews and James Powell Esquire the Executors to whom Admon. was granted, having been first sworn duly to administer.
