This is the last Will and Testament of me Robert Tournay Bargrave late of the Parish of Eastry in the County of Kent but now of the parish of Saint George the Martyr in the City of Canterbury Esquire

First it is my particular desire to be buried where my daughters with the approbation of my Executors hereinafter named shall think proper in a plain and decent manner

And I give devise and bequeath all and every my messuages Lands Tenements and heredits. parts purparts and shares of messuages Lands Tenements and heredits. and all other my real estate and all my leasehold messuages Lands Tenements and premises whatsoever and wheresoever and all my furniture, Plate, linen, China, pictures, books, money, securities for money, Goods, Chattels, rights, Credits and personal estate whatsoever and wheresoever and of what nature kind or quality soever the same may consist and be at the time of my decease not hereinafter by me specifically given, devised or disposed of after and subject to the payment of my just debts, funeral expences, the several legacies and bequests hereinafter also mentioned, the charges of proving this my Will and all other incidental charges
Unto my Son in Law Sir Thomas Staines Knight, Commander of the Bath, my Son in Law William Bridger Esquire and my friend Sir Stephen Tucker the younger of Welling in the said County of Kent Esquire, their heirs, Executors, Admors. and assigns for ever according to the different natures and qualities thereof respectively upon this special trust and confidence nevertheless

That they the said Sir Thomas Staines, William Bridger and Stephen Tucker the Younger or the survivor of them or the heirs executors admors. or assigns of such survivor do and shall within twelve calendar months next after my decease sell and dispose of and convey the said several messuages or Tenements, lands and heredits. parts, purparts and shares of messuages, Tenements, Lands, heredits. and Leasehold premises hereby devised and bequeathed and the inheritance thereof in fee simple and all my term and terms estate and interest therein either entirely or together in one Lot or in parcels or in several lots and other by public auction or private contract as they or he shall think best for the most money that can be reasonably had or gotten for the same

And do and shall make execute and perfect all necessary and proper deeds writings conveyances assignments and assurances in the law for the purpose of vesting the same in any purchaser or purchasers thereof or in such person and persons and for such uses intents and purposes as he or they shall direct or appoint
And do and shall in like manner within twelve calendar months next after my decease sell and convert into ready money all such part and parts of my personal estate and effects as shall not consist of monies or of writing for money and do and shall collect, receave and get in all such part and parts thereof as shall consist of monies or securities for money

And I hereby declare and direct that the receipt or receipts of the said Trustees or Trustee or the acting or only Trustees or Trustee of this my Will for the time being shall be a good and sufficient acquittance or discharge or good valid and sufficient acquittances and discharges to the purchaser or purchasers of the said several messuages or Tenements lands and heredits. parts purparts and shares of messuages, Tenements, Lands and heredits. or of any part thereof for all or any part of the money which shall be by them or him paid for the same or so much thereof as in such receipt or receipts shall be acknowledged to be received
And that no such purchaser or purchasers after paying his her or their said purchase monies to the said Trustees or Trustee or to his or their order shall be answerable for the application or in any respect accountable for or by reason of the misapplication or nonapplication of any part thereof

And I do hereby further will and direct that the said Sir Thomas Staines, William Bridger and Stephen Tucker the Younger or the survivor of them or the heirs executors admors. or assigns of such survivor do and shall at all times and from time to time stand possessed and interested in the monies to arise by every or any such sale or sales of and to be collected, got in and received from my said real and personal estate as aforesaid after payment of debts, the several legacies and bequests and the charges of executing the trusts of this my Will

Upon trust to pay and apply, transfer and assign one full moiety or equal half part thereof the whole into two equal parts to be divided, unto and for the sole use and benefit of my daughter Christian Tourney the Wife of the said William Bridger her executors admors. and assigns to and for her and their own use and benefit absolutely
and upon this further trust to pay, apply, transfer and assign the other moiety or equal half part thereof the whole into two equal half parts to be divided unto and for the sole use and benefit of my daughter Sarah Tournay the Wife of the said Sir Thomas Staines her executors admors. and assigns to and for her and their own use and benefit absolutely

And I give and bequeath unto my said daughter Christian Tournay Bridger all and singular my household furniture, fixtures, books and China which shall be and remain in upon and about my at dwelling house at Eastry Court in the parish of Eastry aforesaid at the time of my decease

And I give and bequeath unto my said daughter Sarah Tournay Staines the Sum of fifty Guineas of lawful money of Great Britain to be paid to her within six calendar months next after my decease

Also I give forgive and release unto the said William Bridger all such sum and sums of money which shall and may be due and owning from him to me at the time of my decease for rent of the eleventh day of October instant

and I give leave and bequeath unto my esteemed friend Ann Buckley the whole of my household furniture together with all my wearing apparel, china, Glass, pictures, books, wine, spirits and Coals and every other article of what nature, quality, extent or description soever which shall be in about or belonging to my said dwelling in the parish of Saint George the Martyr aforesaid to her sole uncontrouled possession and disposal as her property in any manner which may seem proper to her to possess and dispose of the same not hereinbefore or hereafter by me otherwise specifically bequeathed
I also give and bequeath unto the said Ann Buckley two birds the parrot and the cockatoo together with their cages and I also hereby desire that the said Ann Buckley may be permitted to remain and reside in my said dwelling houses for the space of six calendar months next after my decease my Executors herein mentioned undertaking to pay the rent to become due for the same to the persons entitled thereto out of my personal estate

Also I give and bequeath all and singular my plate and linen which shall be in and about my said dwelling house at the time of my decease unto my two said daughters Christian Tournay Bridger and Sarah Tournay Staines equally to be divided between them share and share alike and to their several executors admors. and assigns

Also I give and bequeath unto my [the following in ( ) is crossed through] (said two daughters Christian Tournay Bridger and Sarah Tournay Staines equally to be divided between them share and share alike) brother William Tournay and my Sister Martha Tournay the Sum of ten Guineas a piece of lawful money of Great Britain

And I give and bequeath unto the said Sir Thomas Staines the sum of fifty Guineas and unto the said William Bridger the sum of thirty Guineas of like lawful money as in remembrance of me
Also I give and bequeath unto the said Stephen Tucker the younger the sum of twenty five pounds and unto my friend Richard Mount the sum of five pounds for rings in remembrance of me

I also give and bequeath unto Elizabeth Collinson of the Parish of Saint Margaret at Cliffe in the said County of Kent, Spinster, the sum of ten Guineas I also recommend her after my decease to the care and protection of my two daughters

And I give and bequeath unto my old Servant William Gumer the sum of five pounds
and unto my Servant Edward Hills if he shall be living with me at the time of my decease the like sum of five pounds
of lawful money of Great Britain to be paid to them respectively within six calendar months next after my decease

And Lastly I make ordain constitute and appoint my said Sons in Law Sir Thomas Staines and William Bridger and the said Stephen Tucker the younger Executors of this my last Will and Testament
and I do hereby revoke and make void all former and other Will and Wills and Testamentary dispositions by me at any time heretofore made or published and I do publish and declare this and this only to be my last Will and Testament

Provided always and it is my Will and meaning that the said Sir Thomas Staines, William Bridger and Stephen Tucker the Younger or either or any of them their or either or any of their heirs Executors or Administrators shall not be charged or chargeable with or answerable or accountable for any more of the said trust monies and effects than they respectively shall actually receive or shall come to their hands or respective hands by virtue of this my Will nor with or for any loss which shall happen of the said trust monies and premises or any part thereof so as such loss happen without their or either or any of their wilful neglect or default nor either or any of them for the acts deeds receipts or disbursements of the other or others of them but such and every of them for his own acts deeds receipts and disbursements

And further my Will and mind is and I do hereby direct that it shall and may be lawful to and for my said Trustees and Executors and each and every of them their and each and every of their heirs executors and admors. in the first place by and out of the before said trust monies and premises to deduct and retain to and reimburse themselves respectively all such costs damages and expences whatsoever as they or either or any of them shall actually sustain and be put unto for or by reason of the trusts hereby in them reposed in relation to the said trust monies and premises or the management or execution thereof or of any part thereof or any other matter in any wise relating thereto

In Witness whereof I have at the bottom of the three first sheets of this my last Will and Testament in four sheets of paper contained set my hand and to this fourth and last sheet thereof my hand and seal the twenty eighth day of October One thousand eight hundred and twenty three

Proved at London 10th November 1825 before the Worshipful John Danbery, Doctor of Laws and Surrogate by the Oaths of William Bridger Esquire and Stephen Tucker the younger Esquire two of the Exors. to whom Admon. was granted having been first sworn duly to Admr.
Power reserved to Sir Thomas Staines, Knight, Commander of the Bath, the other Executor [when he shall apply for the same]

Proved again at London the 16th March 1826 before the Worshipful John Danbery, Doctor of Laws and Surrogate by the Oath of Sir Thomas Staines, Knight, Commander of the Bath, the other Executor to whom Admn. was granted having been first sworn duly to Admr.
