In the name of God Amen the first day of July in the first yeare of the Raigne of our most gratious Soveraigne Lord King James the second of England &c. Anno Dm 1685
I Thomas Barton of Milton als Middleton next Sittingborne in the County of Kent Gent do for the quieting of my minde & preventing of difference about my estate after my death & for the settling of the same according to my minde & will make & declare my last will & Testament in these words following

Imprimis I do make & ordaine my deerely beloved wife Elizabeth Sole Executrix of this my will to whom & to whose heires & assignes for ever I do give bequeath and devise all and every my goods chattells Lands and Tenements whatsoever and wheresoever (except that Estate both Freehold & coppyhold w`ch lyeth att or neere Stowmarkett in the County of Suffolke)
She paying out of the same all my ... debts and all the Legacies in & by this my will given & bequeathed att such tyme and in such manner as hereinafter expressed & all my funerall Charges

Item I do give & devise to my kinsman Thomas Dilke the sume of one hundred (& fifty � erased) pounds att his age of one & Twenty yeares and in the mean tyme I give unto him the sume of (nyne � erased) six pounds per ann towards his mainetenance

But in case my said wife and Executrix shall happen to be with childe by me att the tyme of my death than I do give to my said kinsman Thomas Dilke the sume of Fifty pounds onely to be paid unto him at his age aforesaid

Item I do give and devise to my said kinsman all my Coppyhold land & Tenem`ts w`ch I hold of the severall mannors of Columbyne hall als Thorney Columbers and Abbotts hall scituate & being in or neere Stowmarkett aforesaid or either of them w`ch Coppyhold Land & Tenements in or about the moneth of September last past I surrendred into the severall hands of the sev`all Lords of the said severall mannors to such use & uses as I at any tyme or tymes afterwards by any will in writing or other writing shaould direct lymitt or appoint the same) To have and to hold the said Coppyhold land to the said Thomas Dilke his heires & assignes for ever according to the Customes of the said sev`all mannors or either of them

Item I do give and devise to him the said Thomas Dilke & his heires & assignes for ever all and every of my Freehold lands & Tenem`ts scituate in Stowmarkett aforesaid
But in case my said wife shalbe w`th childe as aforesaid then my will is that the bequests & devises before to my said kinsman Thomas Dilke as concerning my Freehold & coppyhold land att Stowmarkett aforesaid shalbe utterly void

Item I do give & bequeath to my two sisters Elizabeth Dilke and Frances Bishopp & their respective daughters my neeces the sume of Ten pounds a peice of lawfull money of England to be paid unto them w`thin two yeares after my death they & every of them dischargeing my said wife & Executrix of all & every their or any of their demands or clayme for or in respect of any duty legacy or bequest by me payable or belonging to them or any of them.

Item I do give & bequeath to the poore people of the parish of Milton aforesaid w`ch do not receive Almes as poore of the parish the sume of Ten pounds to be equally distributed amongst them upon the St Thomas his day Twelve moneth after my decease

Lastly I do hereby revoke make null & void all wills & Testaments ... formerly made & do declare this to my last will & Testament
In witnes whereof I the said Thomas Barton have to this my last will & Testament sett my hand & seale the day & yeare first above written

I the said Thomas Barton have my on this sixth day of July Ano Dm 1689 haveing struck out of this my last will & Testam`t the sume of Fifty pounds of the legacy above given to my kinsman Thomas Dilke & the legacy given to William Back
Do publish & declare the above contents w`th those obliteracons as above & do the same day & yeare publish this my last will & Testam`t in the p`sence of theise p`sons who att my req`t & in my p`sence do sett their hands as witnesses hereunto
