of High Halden, Kent

This is the last Will and Testament of me Edward Barton the Elder of Halden otherwise High Halden in the County of Kent, Yeoman made in Writing in manner following (that is to say)

I Give and bequeath unto my loving Wife Mary Barten the Sum of Five Pounds to be paid to her by my Executor hereinafter named within one Calendar Month next after my decease out of my Personal Estate
I Give and bequeath unto my said Wife One Annuity or Clear Yearly Sum of Eighteen Pounds of lawful Money of Great Britain free from all Deductions whatsoever to be paid to her during the Term of her Natural Life by four even and equal quarterly Payments in each year The first quarterly Payment to Commence and be made at the End of Three Calendar Months next after my death
And I hereby Charge my Personal Estate with the Payment thereof and of all such Costs and Charges as she shall or may be just unto in or about recovering and receiving the same or by reason of the same not being paid at the times and in the manner aforesaid
And I direct that the Legacy and Annuity by me given to my said Wife shall be in Lieu and full Satisfaction of her Dower or Customarily Share which she can or may Claim as my Widow out of all or any part of my Real Estate

I Give and Devise All that my Undivided Moiety or Half Part, the whole in two Equal Parts or Shares to be divided And all other my Parts, Purparts and Shares of and in All that Messuage or Tenement with the Barns, Stables, Gardeners Lodge, Close, Yards, Backsides, Gardens, Orchards thereto belonging And also all those several Pieces or Parcels of Arable Meadow and Pasture Land thereto also belonging containing in the whole by Estimation One Hundred and ten Acres, be the same more or less, Situate, lying and being in the several Parishes of Halden otherwise High Halden aforesaid, and Bethersden in the said County of Kent as the same are now in the Tenure or Occupation of me the said Edward Barton or my Assigns And all other my Real Estate of what Nature or Kind soever in manner following (that is to say)

I Give and Devise One full and equal undivided third part thereof (the whole in three equal parts or shares to be Divided) unto and to the Use of my Son Edwin Barton of Smarden in the said County of Kent, Surgeon, his Heirs and Assigns for ever
I Give and Devise one other full and equal third Part thereof unto my Son in Law Stephen Southerden of Halden aforesaid Tilemaker and my Daughter Caroline his Wife their Heirs and Assigns for ever
And I Give and Devise the other full and equal third Part hereof unto my Son Bolden Barton his Heirs and Assigns for ever

I Give and bequeath all my Ready Moneys and Securitys for Money, Household Goods, Stock, Cattle, Goods, Chattels and Personal Estate and Effects whatsoever which I shall dye Possessed of, Interested in or Intitled unto (Subject and after Payment thereout of all my Just Debts, Funeral Expences, the Charges of Proving this my Will, the said Legacy of Five Pounds by me given to my said Wife, And also the Annuity of Eighteen Pounds by me given to my said Wife, and all such Costs, Charges and Expences as she shall or may be put to in or about the recovering the same or of the same not being paid quarterly as by me directed) unto my said Sons Edwin Barton and Balden Barton and the said Stephen Southerden and Caroline his Wife in the manner and proportions following (that is to say)
One third Part or Share thereof unto my said Son Edwin Barton his Executors, Administrators and Assigns;
One third Part thereof unto my said Son Balden Barton his Executors, Administrators and Assigns;
And the other or remaining third Part thereof unto the said Stephen Southerden and Caroline his Wife, their Executors, Administrators and Assigns

And I Appoint my said Sons Edwin Barton and Balden Barton and my said Son in Law Stephen Southerden joint Executors of this my last Will and Testament And I hereby revoke and make void all former and other Wills by me at any time heretofore made And declare this only to be my last Will and Testament

In Witness whereof I have to this my last Will and Testament Contained in two Sheets of Paper to the first Sheet thereof Set my Hand and to this Second and last Sheet thereof Set my Hand and Seal the Twenty third Day of May in the year of our Lord One thousand Seven hundred and Eighty seven

Signed, Sealed, Published and Declared by the said Testator Edward Barton as and for his last Will and Testament in the Presence of us who in his Presence and at his request and in the Presence of each other have hereunto Subscribed our Names as Witnesses (the Interlineation respecting the Legacy and Annuity given to my Wife being in full of her Dower being first wrote between the Twelfth and Thirteenth Lines of the first Sheet)

The before Registered Will of Edward Barton deceased was roved the Seventeenth Day of June 1788 before the Reverend John Gostling Ash, Surrogate to the Worshipful William Scott, Doctor of Laws, Official General to the Reverend the Archdeacon of Canterbury, lawfully constituted by the Oaths of Edwin Barton, Bolden Barton and Stephen Southerden, the Executors named in the said Will, They being first Sworn duly to perform the same
