I give and bequeath all my wearing apparel unto and equally between my three sons GEORGE, JOHN and THOMAS
Also I give and bequeath unto my youngest son the said THOMAS BRENCHLEY to be paid within six months after my decease the sum of one hundred pounds together with my silver watch and thrashing machine
And as to all the rest residue and remainder of my stock, crops, goods, chattels, monies, rights, credits and all other my personal estate and effects whatsoever not hereinbefore specifically given and bequeathed I give and bequeath in the same manner following (that is to say)
One full equal fifth part or share thereof unto my eldest son the said GEORGE BRENCHLEY
One other fifth part thereof I give and bequeath unto my second son the said JOHN BRENCHLEY
One other fifth part thereof I give and bequeath unto my youngest daughter MARIA TAYLOR
One other fifth part thereof I give and bequeath unto my youngest son the said THOMAS BRENCHLEY
And the remaining fifth part thereof I give and bequeath unto my said executors upon trust
for the children of my late daughter CATHERINE the wife of JOHN HIGGINS equally to be divided
between them and to be paid and advanced and applied at such times and in such manner as my
said executor shall in his discretion think proper
And I appoint my sons the said GEORGE BRENCHLEY and THOMAS BRENCHLEY executors of this my will
and I give unto them all the estate vested in me as trustee or mortgagee according to the
equities affecting the same respectively
In witness whereof I the said JAMES BRENCHLEY the testator have to this my last will and
testament set my hand and seal this nineteenth day of March in the year of our Lord one
thousand eight hundred and forty one

at his request and in the presence of each other have hereunto subscribed our names as witnesses

The before registered will of James Brenchley deceased was proved the sixth day of May 1848 before the Reverend John Metcalfe clerk, surrogate to the Worshipful Sherrard Beaumont Barnaby Doctor of Laws Official General to the Reverend the Archdeacon of Canterbury lawfully constituted by the oaths of George Brenchley and Thomas Brenchley sons of the deceased the executors named in the said will they being first sworn to perform the same
