In the name of God Amen The xxth day of Auguste in the seconde and thirde yeares of the reigne of or sovereigne lorde and layde Phillip and Marye by the grace of God Kinge and Quene of yngland, Fraunnce, Naples, Jeruzalem and Irelande, defendors of the faithe princes of Spayne and Civill, Archdules of Austria, dukes of Myllen, Burgundy and Branat, Counties of Habspurge, Flannders and Tiroll
I Robert Burges of Leneham in the countie of Kent Yeoman beinge sicke in bodye but of parfect remembrannce (thanckes be to God) do make and ordeigne this my testament and last Will in manner and forme followinge
Firste I comyt my sowle into the handes and tuicion of allmightie God trustinge assuredlye by his marcye and by the passhion of ouer saviour Jesus Christe to attayne remissyon of my synnes
Item I will my bodye (my sowle departed) to be buried wher(e) it shall seame good to myn executors

Item I will that ther(e) be distributed to the poor people at my funerall or shortlye after by the discretion of my executors xls [40s]

Item I will to Bennet my Wif one hundred marks of lawfull money of ynglande and all her apparrell wtsomoche [with so much] Corne Cattall and howshold stuffe as shalbe worthe xli [£10] or els xli all whiche money stuff corne and Cattall to be delivered to hir by my executors wtin iv monthes next after my decease
Uppon this condicion that she holde her self content wt the said porcion And that she nor no other for her or in her name do aney act or actes wher by this my Will maye be brokyn or hindered but if she doo aney act or actes eherby my Will maye be brokyn or hindrered Then my Will is that she have no more of my goodes and cattalls but xls and no more owt of my landes but xls by the yeare accordinge to her Joynter [Jointure]

And I will to Peter Elsden towarde the reparacion of his howses xs

and to J George Balden, Robert Elson and John Balden to every of them a iijs iiijd
Item I Will to Robert Perye my daughters son lxli [£40] of lawfull money of ynglande to be paid to him or his assignes by my executors wtin fower yeares next after my decease

Item I Will to John Coliar and Mary Coliar and to ether or them vj sylver spones whereof viij be knapped and one gilt and iiij be unknapped and ungilte
Item I Will that my gre[a]t cupborde in my hall my furnes my bords tables and formes remayne still in my Principall messuage to the Use of John Coliar or Maryye Coliar whether shalbe owner thereof
And I Will unto John Gardenar fyve marks
Item to Rycharde Elveston other fyve marks of lawfull money

The Residue of all my goodes and cattalls my debtes and legacies paide over and besides suche as I have allredye delivered wt my owne hande to certen uses I will give and bequethe to John Coliar and Marye Coliar my daughters children betwene them to be divided by my Executors
Provided alwayes and my Will is that if either of the saide John or Marye Coliar fortune to departe this naturall lif before the age of xviij yeares from the[ir] birthe That then the overliver of them shalhave all suche portion of my goods as is before willed to him or her as shall so fortune to departe

And I make and ordeigne to be the executors of this my testament and last will John Gardnar and Richarde Elveston
And James Perye? to be the sup[er]visor of the same

This ys the laste Will of me the said Robert Burges made and declared the daye and yeare first above written For the better orderinge and disposinge of all my landes ten[emen]tes rentes and hereditamentes wtthapptennces [with the appurtenances] scituat lyeng and beinge in Leneham Goodherste [Goudhurst] Ledes Byddenden or ells wher(e) wtin the shere of Kent

First I will to Alice Amys my sister one litle howse and one garden scituat lyenge and beinge in Ledes [Leeds] in the said countie to be had to her duringe her naterall lif she payenge the lordes rentes and kepinge the reparacions And after her decease to remayne to Marye Coliar my daughters childe To be had to her and her heyres forever

Item I will that Bennyt my wif shall have receave and take yearlye to her use duringe her naterall lif aswell all that her Joynter the whiche I made her in consyderacion of mariage as als all that my one annuytie of iiijli by the yeare the whiche I have yearlye owt of the landes of Gregorye Taylor at Byddenden in the said countie of Kent And that it shalbe lefull [lawful] for her to destreyne for none payment of the same in like manner and forme as I nowe maye To be had to her duringe her naterall lif

And after her decease I will the said annuytie of iiijli by the yeare remayne to the said John Coliar To be had to him and to the heyres of the bodye of the same John
uppon condicion that the same John nor aney other for him or in his name doo not demaunde aney accompte of me the said Robert Burges or my executors for suche somes of money as I have rceaved to his use of the prefectes of his landes in Byddenden Leneham and Smarden in the said countie of Kent
And for lack of suche heyres of the bodye of the same John Coliar to remayne to Mary Coliar To be had to her and theyres [the heirs] of her bodye lawfullye begotten And for lacke of suche heyres to remayne to Robert Pery my daughters son To be had to him and his heyres for ever

And also my Will ys if my Wif be wt childe whether it be a man or woman that the same childe have all that my principall mesuage in the whiche I nowe inhabite and my landes called Sympkyns and ham landes and all that my howse and landes in Goodheurst in the said countie of Kent To be had to the same Childe and to theheyrs of the bodye of the same childe
And for lacke of suche heires to remaine to John Coliar To be had to him and to the heires of his bodye And for lacke of suche heires to remaine to Marye Coliar To be had to her and to the heires of her bodye And for lacke of suche heyres to remayne to Robte Perye and to his heyres for ever

And also I will give and bequethe to John Coliar aswell all thos(e) my ij messuages and landes in Liffyngton beinge in Leneham aforesaide And one litle howse and landes called Fullers lyenge and beinge in Leneham aforesaid now in thoccupeing of John Gardynar, Richard Harper? and Guye Holt as also all thos(e) my ij fi[e]ldes called Haffers and Hokes in the wood of the same withe thapprtenncs lyenge and beinge in Leneham aforesaid in the said countie of Kente To be had to the same John Coliar and to the heyres of his bodye And for lacke of suche heyres to remayne to Marye Coliar To be had to her and to the heires of her bodye lawfullye begotten And for lacke of suche heieres to remayne to Roberte Perye To be had to him and to his heyres for ever

Item I will to James Perye and Roberte Pery all that my messuage and landes wt thapprtenncs the whiche I late bought of Robert Barnes and Robert Bourne scituate lyenge and beinge in Leneham aforesaid in the said countie of Kent To be had to the same James and Roberte Perye and their heyres for ever

Item I will to Mary Coliar all that my one little howse and garden scituat lienge and beinge in Leneham aforesaid the whiche late were John Lyores? to be had to her and to the heires of her bodye And for lacke of suche heires to remayne to Roberte Perye To be had to him and to his heyres for ever
And moreover I will give and bequethe to the said Mary Coliar all those my one mesuage and landes in brake and iij peces of land wt thapprtenncs lyenge and beinge at Royton in Leneham aforesaid in the said countie of Kent the whiche iij peces of land now ar(e) demysed to ferme [farm] to Richard Balden To be had to the same Marye and to the heires of her bodye lawfullye begotten And for lacke of suche heires to remayne to To be had to the same John Coliar and to the heyres of his bodye And for lacke of suche heyres to remayne to Roberte Perye my daughters son To be had to him and to his heyres for ever

And my will ys that if Thomas Henman of Mylsted [Milstead] paie or cause to be paid unto my executors xlto of lawfull money of ynglande wtin half one yeare next after my decease That then my executors shall deliver unto the same Thomas Henman one dede of annuytie of fyve marks by the yeare the whiche I have owte of his landes

Item my will is that if Robert Stones of Charinge Paye to my executors xli [£10] accordinge to one dede Indented made betwene him and me That then he the same Robert Stones shall have agayne to him and his heires all suche landes as I late purchased of him lyenge in Charinge in the said countie

And furthermore my will is that my said executors shalhave the order and bringe upp of the said Marye Colyar and John Coliar untill suche tyme that they and eyther of them shall severallye accomplisshe the age of xxti yeares or els untill suche tyme as they or either of them shall severallye be maried whither shall first fortune And then I will that my executors shall make to either of the same John Coliar and Marye Coliar a severall accompte and payment of all ther recepts alowinge them selves the neccessarye chardges And yearlye to eyther of them duringe their receyte as is aforesaid xxs out of the landes afore willed to the said John Coliar

Intestimonye of all whiche promisses I the said Robert Burges caused this to be writt and subscribed it wt my owne hande in the presens of
