In the name of God Amen I John Caseby of the Towne and Porte of Sandwich in the County of Kent Cooper being Sicke & weake in body but of good remembrance & understanding considering the uncertainty of continuance of this Life doe make & declare this my prsent last will and Testam[en]t in writeing in manner following
First I comitt my soule into the hands of Almighty God my Creat[o]r trusting for the Salvation thereof upon the alone account of his free mercy & grace in Jesus Christ my redeemer And my body I yeald to the earth whence it came to bee decently buried att the discretion of my Executrix hereafter named

Item I will bequeath and give to Susan Irons of Sandwich afores[ai]d wid[ow] one of the daughters of my First wife Thirty shillings of lawfull money of England to be p[ai]d to her by my Executrix wthin one month after my decease
Item I will & give to the poore of the p[ar]ish of St. Peter the App[ost]le in Sandwich aforesd. the Sume of tenne shillings to be pd. by my Executrix into the hands of the Churchwardens & by them to be distributed
Item I will & give to the poore of the Du[t]ch Congregacon in Sandwich aforesd the like Sume of tenne shillings to be pd. by my Executrix for their use into the hands of the Deacons of the sd Congregacon

Item I will & give to Thomas Caseby of Dover my brother all my weareing apparell both linen & wollen
Item I will & give to the sd. Thomas Caseby my brother for (the) terme of his natur[a]ll Life one Annuity of five pounds & four shillings p[er]anum to be yearely issueing & goeing out of all my Messuages or Tenem[en]ts & buildings wth th'appurten[an]ces Scituate & being in the p'ish of St. Peter the App'le in Sandwich aforesd. to be pd. him by quarterly paym[en]ts, to witt att the four usuall Feasts, that is to say, the Birth of or Lord Crist, the annunciacion of the Virgin Mary, the Nativity of John the Baptist & St. Michaell the Archangell, the first paym[en]t thereof to begin & be made on the First of the sd. Feasts that shall next happen aft[er] my death with power for him my sd. Brother Thomas Caseby & his assignes to distreyne on the pr[e]mises for the same from time to time if neede be as often as the same shall be in arreare or unp'd

Item I will bequeath & give to Mary my Loveing wife for (the) terme of her naturll Life All my sd Messuages or Tenemts & buildings wth their Appurtences Scituate & being in the sd. pish of St. Peter the Apple in Sandwich aforesd, she keepeing the sd Messuages & prmises from time to time well repaired & well & truely paying the sd Annuiety to my Brother from time to time which my will is shee shall carefully doe

And aft(er) the decease of Mary my wife I will bequeath & give All my sd Messuages or Tenemts & buildings wth thappurtences before menconed to be Scituate & being in the sd pish of St. Peter the App'le in Sandwich aforesd to my foure cozens John Lambert; Ann the wife of James Adkins of Dover; Jane Lambert & Sarah Lambert the foure children of John Lambert late of Dover aforesd Mariner my late Kinsman deceased & to their heires & assignes for ever, equally to be devided between them, they paying the sd Annuety to my Brother aft(er) the death of my sd wife if he happen to over live her according to the true intent & meaning of this my will

And in case it shall happen the sd Thomas Caseby my Brother doe die & depart this Life before my sd wife Then my will is that my sd wife shall dureing her life pay out of the sd Messuages & prmises wth thappurtences unto the sd John Lambert sonne of my sd late Kinsman John Lambert decea[se]d the like yearly Sume of five pounds & foure shillings by quarterly paymt. on the severll Feast days before menconed, the first paymt thereof to be hadd on the First of the sd Feasts that shall next happen after my brothers death

Item I will bequeath & give to Jane the Wife of Tobias Dommer of Sandwich aforesd, Dyer & to her heires for ever All that Messuage or Tenemt. (now empty) Sometime in two Dwellings being & late in the occupacon of John Bowsax, Mary Suise, Spinster, scituate & being in the pish of St. Mary the Virgin in Sandwich aforesd neere the Beagrums there wth the gardens & Appurtences to the same adjoyning or belonging & all my right & interest to the lane or passage way there lately being & belonging to the Mayor, Juratts & Cominalty of Sandwich aforesd & by them lately letten & demised to me & since by me layed into my garden; she or they paying the Townes rent for the same to growe due aft(er) my decease

Item I doe nominate constitute & appoint Mary my sd wife to be sole Executrix of this my last will & Testamt to whome for the paymt of my debts, Legacies herein given, funerall charges & probate of this will I will bequeath & give all my p[er]sonall estate whatsoever & wheresoever & of what nature soever not hereinbefore given

This is the last will & Testam[en]t of me the sd John Caseby and I doe hereby revooke all former wills by me made
In Witness whereof I the sd John Caseby have to this my prsent last will & Testamt conteyned in two sheetes of paper to the last sheet thereof my hand & seale have sett, & putt dated the Ninth day of October In the Nine & twentieth yeare of the raigne of or Soveraigne Lord Charles the Second now King of England &c. Annoq Dini 1677.

Mrs. Cahsbye was buried 20 Oct 1615 at St. James, Dover, Kent.
John Caseby married Mary Partridge, Widow, on 14 Jan 1630 at St. Peter, Sandwich.
