Will of Thomas Chaplin

of Bermondsey, Surrey (Ex Maidstone)

This is the last Will and Testament of me Thomas Chaplin of Webb Street Bermondsey in the County of Surrey Stationer and Printer.
I give and bequeath unto my son Henry the sum of six hundred pounds sterling

I give and bequeath unto Robert Chaplin of Maidstone in the County of Kent grocer and Benjamin Williams of Red Cross Street Southwark in the said County of Surrey iron plate worker their executors administrators and assigns the like sum of six hundred pounds sterling Upon Trust
as soon as conveniently may be after my decease to invest the same in their names or in the name of the survivor of them or of the executors or administrators of such survivor in the purchase of parliamentary stocks or public Funds in Great Britain or at interest upon Government or real securities in England or Wales
and from time to time as they or he shall think fit to enter vary and transpose the said stocks funds and securities for others of the same or a like nature but with the previous consent in writing of my daughter Lucy during her life and to pay the interest dividends and annual proceeds thereof unto my said daughter Lucy during her life for her sole and separate use independent of any husband with whom she may intermarry but without power of anticipation by my said daughter and the receipts of my said daughter Lucy whether covert or sole shall alone be good and effectual discharges for the same provided such receipts be given for money then actually accrued due and not otherwise

And from and after the death of my said daughter or in case of her anticipating her interest under this my will whichever shall first happen to stand and be possessed of and interested in all and singular the said stocks funds and securities and the dividends interest and annual produce thereof in trust for all and every the children and child of my said daughter who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry to be divided among such children if more than one in equal shares and if but one the whole to be in trust for such one child.

And in case there shall be no child of my said daughter who shall live to attain a vested interest as aforesaid then in trust for such person or persons and in such proportions manner and form as my said daughter shall by deed or writing revocable or irrevocable under her hand and seal or by her last Will and Testament direct and appoint.

And in default of such direction or appointment and so far as the same shall not extend In Trust for the next of kin of my said daughter according to the Statutes for the distribution Intestates Effects

And I do hereby declare my Will to be that it shall be lawful for my said Trustees or the survivor of them or the executors or administrators of such survivor after the decease of my said daughter or in case of her anticipating her interest as aforesaid or previously thereto in case my said daughter shall so direct by any writing or writings under her hand to pay and apply the whole or any part of the interest dividends and annual produce of the expectant portion of any of my said daughters child or children in and towards the maintenance education of such child or children and to pay and apply any part not exceeding one half of the expectant share or shares of such child or children for his her or their preferment advancement or benefit as to my said trustees shall seem fit.

I give and bequeath all my share of and in the stock and utensils of trade employed and carried on by me and my said son Henry in our business of Stationers and Printers and all the Residue of my personal Estate whatsoever unto and equally between my said children Henry and Lucy as tenants in common

And I appoint Robert Chaplin and Benjamin Williams Executors of this my Will

Provided always and my will is that in case either of my said Trustees or any future trustee or trustees to be appointed under this provision shall depart this life or be desirous of being discharged from the aforesaid trusts or shall go to reside beyond seas or shall neglect or decline or refuse or become incapable of acting in the said trusts it shall be lawful for my said daughter during her life and after her decease for the surviving or continuing trustees or trustee or the executors or administrators of the last surviving or continuing trustee to appoint any fit person or persons to supply the place of the trustees or trustee so dying desiring to be discharged or going to reside beyond seas or neglecting declining refusing or becoming incapable of acting as aforesaid

And that immediately after such appointment the said trust estates monies and premises shall be conveyed assigned and transferred so and in such manner that the same may vest in such new trustees or trustee jointly with the surviving or continuing trustee or solely as the case may require upon the trusts hereinbefore declared concerning the same

Provided also and my will is that my trustees or any or either of them their or any or either of their heirs executors or administrators shall not be chargeable with or accountable for any more of the trust monies and premises than they respectively shall actually receive or shall come to their respective hands by virtue of this my will nor with or for any loss whatsoever which may happen to the same without their respective wilful default nor either of them for the other of them nor for the acts deeds receipts or disbursements of the other or others of them but each of them only for his own acts deeds receipts and disbursements

And also that it shall or may be lawful for my said trustees respectively by and out of the monies which shall come to their hands to deduct and reimburse themselves all such loss costs charges and expenses as they respectively shall sustain expend or be put unto for and by reason of the trusts hereby reposed in them.

In witness whereof I have to this my last Will and Testament contained in three sheets of paper set my hand this twenty fourth day of June one thousand eight hundred and forty four � Thos Chaplin � Signed and executed by the said Thomas Chaplin as and for his will in the presence of us present at the same time who at his request in his presence and in the presence of each other subscribe our names as witnesses the words �of my said daughter� between the first and second lines from the top of the second sheet hereof having been first interlined

Proved at London 21st Nov�r 1846 before the Worshipful Jesse Addams Doctor of Laws and Surrogate by the oaths of Robert Chaplin and Benjamin Williams the Executors to whom Admon was granted having been first sworn duly to administer.
