This is the last Will and Testament of me Robert Cooke of the Town and Port of Sandwich in the County of Kent Marchant [Merchant] I being of sound mind memory and understanding
First I direct that my just debts and Funeral and Testamentary Expences may be duly paid and satisfied as soon as conveniently may be after my decease

Also I give and devise all and every my Messuages lands Tenements Heridts. [Hereditaments] and Real Estate whatsoever and wheresoever unto my Wife Mary Cook and her assigns for and during the term of her natural life she and they keeping the same in good and tenantable Repair and doing no waste thereunto
and from and immediately after the decease of my said Wife Mary Cooke I give and devise all and every my said Messuages lands Tenements and Real Estate whatsoever and wheresoever with their and every of their Rights members and Appurts. [Appurtenances] unto my Children Robert Cooke Augustine Forest Cooke and Susanna Cooke and my other Child or Children that I may hereafter have born alive to take as Tenants in common and not as joint Tenants and to their several and respective heirs and assigns for ever

But in case any or either of them my said Children Robert Cooke Augustine Forest Cooke and Susanna Cooke or such other Child or Children that I may hereafter have born alive shall happen to die or depart this life under the age of twenty one years and without Issue then I give and devise the part and share and parts and shares of him her or them so dying unto the Survivors or Survivor of them equally to be dived between them (if more than one) share and share alike as Tenants in common and to the heirs and assigns of such Survivors or Survivor of them forever

And it is my Will and meaning that such accruing share and shares shall in case of the of the death of any other or others of them my said Children under the age of twenty one years and without Issue be again subject to such further right claim and Condition of Survivorship to the then Survivors or Survivor of them and to his her and their Heirs as Tenants in common as is hereinbefore declared touching his her or their original share and shares of and in my said Real Estate

Also I give and bequeath unto my daughter Mary Elizabeth Cooke the sum of one thousand pounds Stock in the three pounds per Centum Consolidated Bank Annuities now standing in my Name in the Books of the Governors and Company of the Bank of England to be paid assigned and transferred to her my said daughter Mary Elizabeth Cooke when and so soon as she shall attain the age of twenty one years and in the meantime and until she shall attain that age I direct that the Dividends Interest and proceeds of the said sum of one thousand pounds Stock in the three pounds per Centum Consolidated Bank Annuities shall be paid to and received by my Executors hereinafter named and be by them applied and disposed of for and towards the support and maintenance of my said daughter Mary Elizabeth Cooke

Also I give and bequeath unto my Executors hereinafter named the Sum of One hundred pounds of lawful Money of Great Britain to be by them or the Survivors or Survivor of them paid applied and disposed of for and towards the putting or placing out my said Son Augustine Forest Cooke in any business or Situation or for his advancement or preferment in the World or otherwise for his benefit in any manner as they my said Executors or the Survivors or Survivor of them shall in their his or her discretion think fit

Also I give and bequeath all my household Furniture Implements of household plate Linen China Goods Chattels ready Monies Securities for Monies and all and singular other my personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever the same may be or consist of at the time of my decease and not hereinbefore by me otherwise disposed of (after and subject to the payment of my just debts the aforesaid sum of one hundred pounds Funeral and Testamentary Expences and all other incidental charges unto and to the use of my said Wife Mary Cooke and her assigns for and during the term of her natural life

and after her decease I give and bequeath the same unto and amongst my said Children Robert Cooke Augustine Forrest Cooke and Susanna Cooke and any other Child or Children that I may hereafter have born alive equally to be divided between them share and share alike
and in case any or either of them my said Children Robert Cooke Augustine Forrest Cooke and Susanna Cooke and any other Child or Children that I may hereafter have born alive shall happen to die in the lifetime of my said Wife or before the said personal Estate shall become distributable and shall leave issue of their respective Bodies lawfully begotten then I give and bequeath the share or shares of such of my said Children as shall so happen to die leaving issue unto their issue respectively and to be divided equally amongst such issue if more than one But so nevertheless that the Issue of any of my said Children shall be entitled only to the share or shares of his her or their Father or Fathers Mother or Mothers
But in case any or either of them my said Children shall happen to die under the age of twenty one years and unmarried then I give and bequeath the share or shares of him her or them so dying unto the Survivors of Survivor of them my said Children equally divided between or amongst them if more than one share and share alike

And I direct that such accruing share and shares shall in case of the death of any other or others of them my said Children under the said age of twenty one years and unmarried be again subject to such further right chance and condition of Survivorship to the then Survivors or Survivor of them as is hereinbefore declared touching his her or their original share and shares

And I do nominate constitute and appoint my said Wife Mary Cooke and Stephen Hooper of the Town and Port of Sandwich aforesaid Grocer and John Simmons of the same place Carpenter Executrix and Executors of this my Last Will and Testament and hereby revoke and make void all former and other Wills and Testaments by me at any time heretofore made

In Witness whereof I the said Robert Cooke the Testator have to the first two sheets of this my last Will and Testament in three sheets of paper contained set my hand and to this third and last sheet thereof my hand and Seal this twelfth day of November 1812.

Proved at London 14th October 1814 before the Judge by the oaths of Mary Cooke Widow the Relict Stephen Hooper and John Simmons the Exors. [Executors] to whom Admon. [Administration] was granted being first sworn duly to administer

Notes:
Robert Cooke was buried at St. Peter, Sandwich on 29th January 1814, aged 42. He is given as “Captain” in the register.
Robert Cooke was born 18th October 1771 and christened 17th November 1771, s. of Robert and Susanna Cooke at St. Peter, Sandwich. His only sister was Mary Cooke, who was christened there on 30th December 1768.
Parents Robert Cooke and Susanna Valder married 31st August 1767 at St. Peter, Sandwich; he was given as “Robert Cooke the Younger”. This Robert was buried 9 Mar 1801 at St. Peter’s, aged 61.

Robert Cooke of the Will married 30th December 1794 to Mary Cresy at St. Mary the Virgin, Sandwich.
Robert was of St. Peter, Sandwich; She was a minor of St. Mary’s.
