Item the messuage wherein I dwell with all the lands profit and commodities thereto belonging duringe for all the years that are to come in the same, I wholly give and bequeath to Ellen Dann now my wyfe she payinge fulfillinge and discharginge all as I by the lease am bound to doe In consideration shee to bringe up my children that god hath lent me.
And also all the residue of my goods and cattells I also give and bequeath to the said Ellen my wyfe in full consideration as is aforesaid.
Item I give and bequeath to Ellen now my wyfe tenements with the appurtenances called by the name of Coolanes wherein John Carter doth now inhabite and dwell in Marden aforesaid for and duringe her naturall lyfe and after her decease I will and bequeath the said tenement with all and singuler the appurtenances unto John Dann my sonne and to his heires for ever.
Item I give and bequeath to Ellen now my wyfe one other tenement with the appurtenances situate lyinge and beinge in Staplehurst wherein one William Wood doth now inhabite and dwell duringe the lyfe of the said Ellen and yf the said Ellen be now with childe with a man childe then my mynde and will is that after her decease that he shall have the said tenement in Staplehurst to him and to his heires for ever, if it be not a man childe then my mynde and will is that John Dann my sonne shall have the said tenement with the appurtenances unto him and to his heires for ever.
Item also I give and bequeath unto Ellen now my wyfe one other tenement with all and singular the appurtenances in Marden aforesaid wherein one John Conny doth now inhabite and dwell duringe such time as my sonne John Dann shall accomplishe and come to his full age of XXi tie years and then my mynde and will is that the said John Dann shall have it to him and to his heires for ever.
Item whereas one William Wenman? of Marden carpenter hath by good assurance in lawe morgaged unto me the said John Dann his tenement with the appurtenances for the summe of xv li payinge yearly therefore xxx s a year for the tyme of foure years endinge at the feast of St. Michaell th'archangell in anno 1608 I give and bequeath the said yearly rent of xxx s and the said stocke of xv li now in the hands of the said Wenma? unto the said Ellen my wyfe Provided allwaies my mynde and will is yt yf the said William Wenmam his heires nor assignes shall not paye or cause to be paid unto me the saide John Dann or to my assignes the said summe of xv li at th'end and terme of the said foure years that then my mynde and will is that the said Ellen nowe my wyfe shall take the benefitte of the lawe in the same to her and to her heires for ever.
Item I geve and bequeath unto Katheryne Dann my daughter thirtye pounds of lawfull
monie of England to be paid unto her by myne Executor at the age of xx tie years.
Item I geve and bequeath unto Tabitha Dann my daughter thirtye pounds of lawfull
monie of England to be paid unto her by my Executor at her age of xx tie years.
Item my mynde and will is that yf my wyfe Ellen be with childe with a daughter then I geve her xxx li to be paid her likewyse by myne Executor at her age of xx tie years.
The residue of all my goods unbequeathed
my debts beinge paide and my bodye beinge brought
to the ground I doe ordeyne and make Ellen Dann
now my wyfe onely Executrix of this my last
will and testament bearinge date the xxi teth daye
of Aprill and in the thirde year of the reigne of our
most dread Sovereign Lord Kinge James by the grace
of god of England Scotland France and Ireland
kinge defender of the faith etc and of Scotland the
xxxviii th anno dni 1605 John Dann Witnesses to this
will makinge we whose names are under written
