Will of William Day

of Eastchurch, Kent

Item I give and bequeath unto my two daughters Martha and Anne forty shillings apeece, to bee paid att their sev[er]all ages of One and Twenty yeares or dayes of their marryage, w[hi]ch shall first happen.
It[e]m I give unto my said two daughters all my late Wyves weareing apparrell, both lynnen and wollen, to bee equally devided betweene them.

Item I give and bequeath unto my two sonne John and Andrew Twenty pounds apeece, to bee paid att their sev[er]all ages of one and Twenty yeares.

All the rest and residue of my goods, Cattell and Chattles, if any shall remayne after my debts, legacies herein bequeathed, and funerall expences bee satisfied and paid, I give and bequeath unto my four children before named, to bee equally devided amongst them.

And I make and ordaine my loveing friend John Bollingham Executor of this my last Will and Testam[en]t.

Item it is my Will that my two daughters before named shall have all their sheepe w[hi]ch are now going and feedeing in my grounds.
Item I give and devise unto my two sonnes before named my house and Lands lyeing in the Citty of Colchester, or neere the same, to them and their heires for ever.

And this is my last Will and Testament. In witnesse whereof I have hereunto putt my hand and seale the day and yeare first above written.
Further it is my Will that if either of my said sonnes happen to dye before hee accomplish his age of one and twenty yeares then the Survivor shall enioy the Legacie of the decea[se]d.

[This before-written will, of William Day deceased, Was proved on the 7th day of the month of May in the 1677th year of our Lord, Before Master John Hunt, clerk, lawfully authorised commissary of the worshipful William Stede, Doctor of Laws, lawfully deputed Official of the Reverend Lord Archdeacon of Canterbury, By the oath of John Ruffin, the principal creditor of this deceased, and indeed the tutor etc of Martha Day and Anne Day, the daughters of this deceased and legatees named in this will, And approved in respect thereof etc.
And because the Executor named in this will renounced the burden of execution of the same, Therefore the Lord committed administration of the goods of this deceased, with this will annexed, to the aforenamed John Ruffin, the creditor and tutor etc aforesaid, during the minor age of the aforenamed Martha and Anne Day, the minors aforesaid, and not otherwise or longer, he having been first sworn touching God�s holy gospels. Saving the right of any person whomsoever having an interest.]
