Will of Thomas Day

of Cranbrook, Kent

Inprimis I give and bequeath unto my loveing wife Lydia Day five pounds, to be paid unto her by my Executor within six months after my decease.
Item I give and bequeath unto my Cozen Elizabeth, now wife of Richard Knowles of Towne Malling in the County of Kent, Carpenter, tenn pounds, to be paid unto her within one yeare after my decease.
Item I give and bequeath unto my Cozen Alice Bishopp, the now wife of Thankfull Bishopp of Rye in the County of Sussex, grocer, the su[m]me of tenn pounds, to be paid unto her within one year next after my decease.

Item I give and bequeath unto my three Neeces, Mary Day, Martha Day and Hannah Day, three others of the daughters of my loveing Brother Jacob Day deceased, twenty pounds a peice, to be paid to each of them respectively by my Executor within one yeare after my decease.
Item I give and bequeath unto my loveing Cozen Anne Day, daughter of my Cozen Isaac Day dec[ease]d, twenty shillings.
Item I give and bequeath unto my loveing Friend Peter Usborne, sonne of Stephen Usborne dec[ease]d, twenty shillings, to be paid him within one yeare after my decease.

Item I give and bequeath unto my loveing friend Thomas Breecher al[ia]s Briches twenty shillings and one sute and Coate, two shirts, one pair of good shoes and one Hatt, to be paid and delivered to him within six month after my decease.
Item I give and bequeath unto my loveing Cozen Margaret Faulkner of Hunton, widdow, two pounds and tenn shillings, to be paid unto her within one yeare after my decease.
Item I give and bequeath unto my loveing Cozen William West of Maidstone, Threadman, two pounds and tenn shillings, to be paid unto him within one yeare after my decease.

Item I give and bequeath unto my loveing Cozen Luce Luxford, wife of George Luxford, of East Malling in the County of Kent, Gent, five pounds, to be paid unto her within one yeare after my decease, if she shall be then liveing,
And if she shall happen to dye before that time, then I give and bequeath unto Thomas Luxford, Sonne of the said Luce Luxford, the su[m]me of five pounds, to be paid to him within one yeare next after my decease.
Item I give and bequeath unto Alice Johnson my Cozen twenty shillings, to be paid unto her within one yeare next after my decease.

Item I give and bequeath unto Matthew Wells of Brenchly ten shillings, to be paid him within six month next after my decease.
Item I give unto William Morris of Cranbrooke tenn shillings, to be paid unto him within six months after my decease.
Item I will and bequeath unto my loveing Cozen John Hinds twenty shillings, to be paid to him within one yeare after my decease.
Item I give and bequeath unto Thomas Dawne, sonn of Godfrey Dawne, twenty shillings, to be paid unto him within one yeare after my decease.

Item I give and bequeath unto Anne Carter, daughter of John Carter, late of Brenchly decea[se]d, twenty shillings, to be paid unto her within one yeare next after my decease.
Item I give and bequeath unto the poor of the parish of Brenchly fourty shillings, to be distributed by the Minister and Churchwardens of the same parish in manner following (Vizt), Twelve pence a peice to such of the poor people of the said parish as shall be then sixty years of Age or upwards, and the remainder of the fourty shillings as the said Minister and Churchwardens shall think fitt.

Item I give and bequeath unto my Cozen Elizabeth Hurt of Maidstone, widow, two pounds and ten shillings, to be paid unto her within one yeare after my decease.
Item I give and bequeath unto William, John and Elizabeth Austen, the three children of John Austen of Brenchley aforesaid, yeoman, by Elizabeth West his former wife, two pounds and tenn shillings, equally to be divided between them, to be paid to each of them within one yeare after my decease.
Item I give and bequeath unto my Cozen John Turner of Penhurst one pound, to be paid unto him within one yeare next after my decease.

Item I give and bequeath unto my Brother Isaac Day of Sevenak one pound, to be paid him within one yeare next after my decease.
Item I give and bequeath all my Linnen whatsoever unto the Six Children of my Brother Jacob Day (vizt) unto James Day, Elizabeth Knowles, Mary Day, Alice Bishopp, Martha Day and Martha Hannah Day, equally to be divided betweene them, share and share alike.

Item I give and bequeath unto my Cozen Thankfull Bishopp, and unto my loveing Friend Nicholas Amhurst of Cranbrook afores[ai]d, Gent, to each of them one pound, to be paid unto them within one yeare next after my decease,
And I doe make the said Thankfull Bishopp and Nicholas Amhurst Overseers of this my Will, and doe desire them to be aiding and assisting to my Executor in the Execuc[i]on of this my will.

Item whereas I have settled parte of my messuage, Farme and Lands in Cranbrooke, in the Occupac[i]on of Henry Harman, upon Lydia my wife as a joynture, I doe hereby in the first place ratify and confirme the joynture I have soe made, and doe, as an addition to the said Joyntur of my said wife, give and bequeath unto my said wife the su[m]me of five pounds p[er] Annu[m], to be issueing and goeing out of the rents and proffitts of my said Farme and Lands in the Occupac[i]on of the said Henry Harman, for and dureing the terme of her naturall Life,
To be paid to her by halfe yearly payments (Vizt) on every twenty ninth day of September and twenty fifth day of March, by equall porc[i]ons, with Liberty to distreyne for the same if unpaid twenty one days after either of the said days of payment, she paying and allowing of a proporc[i]onable parte of the Kings Taxes for the said five pounds per Annu[m].

Item I give and bequeath unto my loveing Brother James Day of Elmenden in the County of Essex, and unto my Cozen James Day, son of my said Brother Jacob day, all that my said messuage or tenement, Farme and Lands, with their and every of their Appurt[enance]s, scituate, lyeing and being in Cranbrooke aforesaid, in the Occupac[i]on of the said Henry Harman, to hold to them, their heirs and Assigns, for and dureing the Life of my said Brother James Day, equally to be divided betweene them, share and share alike, charged and chargeable with the said Joynture and payment of the said five pounds p[er] Annu[m] to my said wife for Life as aforesaid.

Item I give and bequeath my said messuage or Tenement, Farme and Lands in Cranbrooke aforesaid, in the Occupac[i]on of the said Henry Harman, And alsoe all other my Messuages and Lands whatsoever and wheresoever, i[m]mediatly after the decease of my Brother James Day, unto my said Cozen James Day, sonne of my said Brother Jacob Day, to hold to my said Cozen James Day, his heirs and Assigns forever, charged and chargeable with the said Joynture and five pounds per Annu[m] as aforesaid.

Item I give and bequeath unto my loveing Friend Ralph Double of Cranbrooke aforesaid, Cordwainer, the su[m]me of tenn shillinges, to be paid unto him within one yeare next after my decease.

Item all the rest and residue of my ready money, goods, Chattells, householdstuffe and personall estate whatsoever and wheresoever, my debts, Legacies and funerall expences being first paid and satisfied, I give and bequeath unto my said Cozen James Day, whom I make sole Executor of this my last will and Testament. ,p> In Witness whereof I, the said Thomas Day, the Testator, have to this my last Will and Testament, contained in four sheets of paper, to the three first sheets thereof set my hand, and to the last sheet thereof my hand and Seale, this seventeenth Day of Aprill in the twelfth yeare of the Reigne of his Majestie King William the Third, Anno D[omi]ni 1700. Signed, sealed, published and declared by the said Thomas Day, the Testator, as and for his last will and Testament, in the p[re]sence of us who have alsoe subscribed our names as Witnesses in the p[re]sence of the said Testator.

[This above-written will, of Thomas Day, late of Cranbrook in the diocese of Canterbury, deceased, who died having etc goods etc in various dioceses or peculiar jurisdictions in the province of Canterbury, Of whom etc, On the eighth day of the month of March in the one thousand seven hundred and third year of our Lord (in the style of England), Before Master John Stockar, Clerk, surrogate etc, By the oath of James Day, the nephew by the brother of the said deceased, and the executor named in the said will, To whom was committed administration of all and singular the goods, rights and credits of the said deceased, and of all things whatsoever concerning this his will, He having been first sworn on the holy etc.]
