As concerning my worldly goods of what kind or nature whatsoever I do give and bequeath them unto my most dearly beloved wife Luce whom I make sole Executrix of this my last Will and Testament and I do hereby earnestly and instantly require and charge her as she tendeth my reputation with the world and the salvation of my soul to pay truly all my debts.
This is the last will of me the said John Denne concerning my messuages lands and tenements which I
have either of an estate of inheritance or by lease either in the County of Kent or City of Canterbury.
First whereas I paid my brother in law William Denne of Bishopsbourne stand(?) bond unto Joane
Denne widow my mother and to Anne Denne my youngest sister in a bond of five hundred pounds for
the payment of twenty and five pounds yearly to my said mother during her life quarterly and for the
payment of one hundred pounds unto the said Anne Denne my sister at a date now past and also for the
payment of thirty three pounds six shillings and eight pence unto the said Anne with the said sums of
25 one hundred pounds and �33 6s and 8d next appointed and limited by my fathers will to be to them
by me paid and which said sums to be paid to my sister Anne as already paid and discharged.
Item I will that the said Joane Denne my mother and Mr Walter Aylesworth my father in law and the survivor of them or upon refusal of either of them the other shall in as convenient time as may be after my decease bargain and sell for the utmost value they can get all that my dwelling house with the appertuances there together with my lease estate and term of years of a corner house in the same parish together with all my deeds evidences and writings concerning the same and the money thereof coming I will shall be employed and ordered in manner following that is to say that the said money be put out and disposed of by the discretion of my said mother and father in law and the survivor of them and out of the yearly profits thereof.
I will that my said mother shall have during her life twenty and five
pounds yearly to her paid quarterly by equal portions for and in lieu recompense and satisfaction of the
said �25 which I stand bound to pay her by the said bond and by my fathers said will and the yearly
surplus of the profit of the said money so arising of this said sale.
I will and bequeath the same to all
my children born and to be born for and towards their education.
And after the death of my said mother
I will and bequeath that Joane Denne my daughter shall have one half of the said money arising of the
said sale of my said messuage and tenements for and towards her advancement in marriage to be to her
paid at her age of twenty and one years or day of marriage which shall first happen and the other half of
the said money I will and bequeath unto Luce Denne my daughter to be to her paid at her age of twenty
and one years or day of marriage which shall first happen.
And my will is that the said Joane and Luce
my daughters shall have the yearly profit and interest of their said portions in full the said several times
of payment thereof.
Item my will is that if the said Joane and Luce my daughters either of them shall
die before such times as they are to have their said portions paid them that then the survivor of them
shall the others portions to be paid at such times as aforesaid
and if both my said daughters shall die
before they shall receive their said portions then my will is that my youngest son Walter Denne shall
have both their said portions to be paid to him at his age of 21 years and in the meantime he to have the
yearly profit and interest thereof.
And if my said children Joane Luce and Walter do all die before such
times as their portions are to be paid them then I will all the same portions to my eldest son Vincent
Denne to be paid to him at his age of 21 years and in the meantime he to have the yearly profits thereof.
And if he the said Vincent Denne shall die before the said age of 21 years unmarried and is to have the
said portions then my will is that my well beloved wife Luce shall have the same.
And my will is that after the decease of my said mother or after her marriage my said father in law Mr Aylesworth my uncles Mr Edward Aylesworth John Stocket(?) or any of them together with my brothers William Thomas Henry and Vincent Denne or with any one of them shall have the ordering disposing and letting out of the said money so to be levied and raised of the sale of the said house and premises to the uses and purposes before appointed.
Item my will and mind is that upon the sale aforesaid that my said mother shall deliver up to my said Executrix the said bond of �500 to be cancelled before the same be due put(?) in suit or otherwise my said mother shall have no benefit by this my will but all gifts and devices to her to be utterly paid.
Item I do will and devise that the said Luce my wife shall have and
enjoy during her natural life all those messuages lands tenements and hereditaments which are or were
intended to be assured unto her for her jointure and after her decease I will and devise the same except
all such as are hereafter willed and devised immediately to my son Walter Denne.
Item the said
Vincent Denne my son and heir and to the heirs males of his body lawfully begotten and for default of
his heirs I will and devise the same to my son Walter Denne and to the heirs males of his body lawfully
begotten.
Item I will and devise to my said son Walter Denne and to the heirs males of his body
lawfully begotten all that messuage or tenement with the appertuances which was Richard Nethersoles�
and which he leased to my brother in law William Denne and two acres of arable land lying in
Bromfield in Kingston near the field gate and orchard of the same house and all my lands lying
between the highway leading from Kingston Street towards Kingston and between Silverdown Hill and
Great Sale Woods(?) as well those which be leased lands ? others and also all that close of land called
Crouches and all that close of land called ? in Kingston aforesaid and all that close called Mengates(?)
in Kingston aforesaid that is to say so much thereof as is not exchanged with John Lawrence and all my
closes and lands in Upfield in the several occupations of Edmund Kingsmill and Gregory Smithson.
And my will is that after my wife�s decease my said father in law and uncle Edward Aylesworth and
their heirs shall convey and ? the best lands which were Richard Nethersoles according to my will
above said.
Item I will and devise to Luce my wife and to her heirs for and towards the payment of my debts one rent charge of �10 by year going out of certain lands and tenements in Kingston aforesaid of Robert ? and all my rents charges in Kingston aforesaid with all the deeds and evidences concerning the same. In witness whereof I have to each of the three sheets of this my will subscribed my name. John Denne.
