I give and
devise one annuity or yearly rent charge or sum of fifty pounds of lawful money of Great Britain free
and clear of and from all eases(?) charges and deductions whatsoever unto my beloved wife Ann
Denne and her assigns for and during the term of her natural life to be issuing and going out of all that
my messuage or farm called Santon Farm and all and singular the lands hereditaments and
appurtenances to the said messuage or farm belonging or therewith used occupied or enjoyed situate
lying and being in the several parishes of Preston next Wingham, Ash next Sandwich and Elstone or
some or one of them in the said County of Kent and now or late in the tenure or occupation of
And my will and mind is and I do
hereby will devise order and direct that if it shall happen that the said annuity or yearly rent charge or
sum of fifty pounds or any part thereof shall at any time or times be behind or unpaid by the ? of
twenty one days next after either of the said feast days or times of payment on which as aforesaid the
same ought to be paid then and so often it shall and may be lawful to and for my said wife Anne Denne
and her assigns into and upon all and singular the aforesaid messuage or farm lands hereditaments and
premises with the appertuances or into and upon any part thereof to enter and there to distain for the
said annuity or yearly rent charge or sum of fifty pounds or for any part thereof so being behind and
unpaid as aforesaid and the distress and distresses then and there found from thence to take ? ? amost
carry away impound or otherwise detain and keep and also to sell and dispose of the same for and
towards satisfaction of all arrears of the said annuity or yearly rent charge or sum of fifty pounds and
also of all the costs and charges of taking such distress or distresses returning the overplus(?) if any
shall happen to be to the owner or owners of the goods and chattels so distained.
I give and devise all
that my said messuage or farm and all and singular the said lands hereditaments and appertuances to
the said messuage or farm belonging or therewith used occupied or enjoyed called Santon Farm situate
lying and being in the said several parishes of Preston next Wingham, Ash next Sandwich and Elnstone
or some or one of them in the said County of Kent and ? or late in the tenure or occupation of the said
Richard Laslett his assigns or undertenants subject nevertheless to and charged and chargeable with the
said annuity or yearly rent charge or sum of fifty pounds free and clear of and from all eases(?) charges
and deductions as aforesaid unto my sons Thomas Denne and John Denne equally to be divided
between them share and share alike as tenants in common and not as joint tenants and unto their several
and respective heirs and assigns for ever.
I give and devise all those my three messuages or tenements
and the outhouses edifices buildings yards gardens lands hereditaments and appertuances thereunto
belonging or therewith used occupied or enjoyed situate lying and being in the Parish of Adisham in
the said County of Kent unto my said son Thomas Denne his heirs and assigns for ever.
I give and
devise all that my farm called Hatch(?) Farm and all and singular the lands woodlands hop oasts
hereditaments and appertuances to the said farm called Hatch Farm belonging or therewith used
occupied or enjoyed situate lying and being in the Borough of Hoath in the Parish of Reculver and in
the Parish of Chislet aforesaid or one of them in the said County of Kent and now or late in the several
tenures or occupations of Valentine Cork(?) and me the said David Denne or one of us our or one of
our assigns and also all those my three messuages or tenements with the outhouses edifices buildings
yards gardens lands hereditaments and appertuances thereunto belonging or therewith used occupied or
enjoyed situate lying and being in the Parish of Chislet aforesaid in the said County of Kent and now or
late in the several tenures or occupations of Thomas Holloway Boston and Edward Hadrock(?) or some
or one of them their or some or one of their assigns and also all that my one full equal undivided ? or
half part of and in all those ten acres of marshland more or less with the appertuances lying and being
in the Parish of Chislet aforesaid in the said County of Kent now or late in the tenure or occupation of
my son in law Thomas Vandepeer and by me purchased of John Saunders unto my son William Denne
his heirs and assigns for ever.
I give and devise all those my five messuages or tenements with the
outhouses edifices buildings yards gardens land hereditaments and appertuances thereunto belonging or
therewith used occupied or enjoyed situate lying and being in the Parish of Chislet aforesaid in the said
County of Kent and now or late in the several tenures or occupations of Edward ?, Henry Denne, Peter
Goldfinch, William ?, John Gardiner, John Culling and me the said David Denne or one of us our or
one of our assigns and which I purchased of Mrs Tomlin and also all those my three messuages or
tenements with the garden land hereditaments and appertuances thereunto belonging or therewith used
occupied or enjoyed situate lying and being in the parish of Chislet aforesaid in the said County of
Kent in or near a ? street there called Upstreet and now or late in the several tenures or occupations of
Thomas Smith, Peter Saunders and James Johncock or some or one of them their or some or one of
their assigns and which I purchased of Henry Cork unto my son David Denne his heirs and assigns for
ever.
I give and devise all that my messuage or tenement and the outhouses edifices building yard
garden land hereditaments and appertuances thereunto belonging situate lying and being in the
Borough of Hoath in the Parish of Reculver aforesaid in the said County of Kent and now or late in the
tenure or occupation of ? Edwards or his assigns and which I purchased of John Kingford unto my
daughter Mary Vandepeer her heirs and assigns for ever.
I give and bequeath unto my said wife Ann
Denne the sum of one hundred and fifty pounds of lawful money of Great Britain to be paid unto her
out of my personal estate by my Executor hereinafter named within six calendar months next after my
decease.
I give and bequeath all the rest and residue of my goods chattels ready money
securities for money, money in the public stocks or funds of this Kingdom and personal estate
whatsoever and wheresoever after all my just debts funeral expenses charges of proving this my last
Will and Testament and all other ? charges shall be fully paid and satisfied unto my said son David
Denne his Executors administrators and assigns for ever to and for his and their own proper use and
benefit. And I do hereby make nominate constitute and appoint my said son David Denne sole
Executor of this my last Will and Testament and I do hereby publish and declare this and no other to be
my last Will and Testament hereby revoking all former wills and testaments by me made. In witness
whereof I the said David Denne the Testator have to every sheet of this my last Will and Testament in
three sheets of paper contained set my hand and seal the ninth day of September in the twelfth year of
the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain, France and
Ireland, King Defender of the Faith and so forth and in the year of our Lord one thousand seven
hundred and seventy two. David Denne, signed sealed published and declared by the said David
Denne Testator as and for his last Will and Testament in the presence of us who subscribed our names
as witnesses thereunto at the request and in the presence of the said David Denne the Testator.
This will was proved at London the first day of December in the year of our Lord one thousand seven
hundred and seventy two before the Worshipful George Harris Doctor of Laws Surrogate of the Right
Worshipful George Hay(?) Doctor of Laws Master Keeper or Commissary of the Prerogative Court of
Canterbury lawfully constituted by the oath of David Denne the son of the deceased and sole Executor
named in the said will to whom administration was granted of all and singular the goods chattels and
credits of the said deceased having been first sworn only to administer.
I give and bequeath unto my said daughter Mary Vandepeer the sum of four hundred and fifty
pounds of like lawful money to be paid unto her out of my said personal estate by my said Executor
within six calendar months next after my decease.
I give and bequeath unto my daughter Ann Collard
the wife of Thomas White Collard the sum of five hundred and fifty pounds of like lawful money to be
paid unto her by my said Executor out of my said personal estate within six calendar months next after
my decease.
I give and bequeath unto my daughter Sarah Denne the sum of one thousand and fifty
pounds of like lawful money to be paid unto her by my said Executor out of my said personal estate
within six calendar months next after my decease.
I give and bequeath unto the four children of my said
daughter Ann Collard unto the child of which she is now big if born alive unto the two children of my
said son Thomas Denne unto the two children of my said son William Denne and to the child of my
said son John Denne the sum of one hundred pounds apiece of like lawful money to be paid unto them
severally and respectively by my said Executor out of my said personal estate within six calendar next
after my decease.
