To Marie, my welbeloved wife, the one half of all my household stuffe nowe beinge in the
house wherein I dwell, she shall take and chose
And the other halfe thereof shalbe equallie divided amongst Elizabeth, Marie, Agnes and Joane, my fower daughters
I will and give to Marie my wife, in consideration of such dower or title of dower as she hereafter maie pretend to have right unto of such lands & tenements whereof I am nowe seised, the some of �100
Residue of goods, cattell, Chatells, debts & specialties (my debts and legacies paid and one obligacon of the penall some of �400 or thereabouts entred into by my selfe as surtie with Thomas Friend my sonne unto one John Hickes for the leavinge of Marie the nowe wife of the said Thomas my sonne & daughter of the said John Hickes, worth �200 of the fortune to survive my said sonne discharged and my funeral expences defalked) I whole will and give unto the said Thomas Friend my sone whom I hereby ordeyne & make the sole Executor of this my last will and testament
I give & bequeath unto Thomas Freinde my sonne, my messuage with the Copper and all other utensells to the same apperteyninge & belonging to the trade of a Clothier with the buildings, gardens, orchards and lands to the same messuage apperteyninge & used which I purchased of Edward Hudson, Michaell Hudson & Robert Hudson, scituate, lyinge & beinge in East Sutton
Wife Marie to have for the terme of her life my two Croftes of land called Pet garden & East garden and that parte of my other crofte of land called kitchine Crofte, all in East Sutton aforesaid which I purchased amongst other lands of Robert Clarke
And after her decease I will the said tenement and lands shall come and remaine unto Thomas Marshe my grandchild and sonne of Thomas Marshe and Elizabeth his wife, my daughter
Provided allwaies that if the said Marie my wife fortune to die before the said Thomas Marshe my grandchild shall attain to this age of 16 yeres, then Joane Marshe, sister of my said grandchild and Marie Marshe, her sister, shall have & receive the next fower yeares profit & issues of the same tenement & lands purchased of the said Robert Clarke
Item I will and give unto Thomas Marshe my sonne in lawe, my messuage with the buildings, yards, Closes, garden, orchards & lands thereunto belonginge called Bingarden, Dennisfeild, Neither field, Owen Crofte & Birchetfeild & the other part of Kitchinefeild as it is nowe devided & not formerlie bequeathed, to be had & holden by him the said Thomas Marshe, his heires & assignes for ever,
upon condicion that he the said Thomas Marshe shall well and trulie paie or cause to be paid unto Belknapp Coveney my son in lawe, or unto Marie his nowe wife, he beinge dead, or unto the issue of them both is the said Belknapp & Marie shall be dead, the some of �50 on the feast of St Michaell tharchangell full three yeares next after my decease
And upon condicion that he the said Thomas Marshe, his heires or assignes shall well and trulie paie or cause to be paid unto Christopher Barlinge my sonne in lawe or unto Agnes his wife, he being dead, or unto the issue of them both the said Christopher & the said Agnes shalbe dead, the some of �40 on the feast of St Michaell tharchangell full five yeares next after my decease
Lastlie, my will and minde is that Mary my Wife, upon the receipte of her forsaid legacies of �100 or her acceptance of furniture for the same, shall make a Release sufficient in the lawe unto such person and persons as I have hereby devised my lands unto of all such dower or title of dower as she maie claime out of the same lands & tenements soe to them devised
