I Lydia George of Maidstone in the County of Kent Spinster hereby revoking all former testamentary dispositions declare this to be my last Will and Testament

I give all my wearing apparel and linen of whatsoever description which I shall die possessed of unto all or such of my Nieces
Sarah Pankhurst the daughter of my Brother Richard George and wife of (blank – actually Isaac) Pankhurst of Cranbrook or near thereunto in the County of Kent aforesaid
Mary Wicke of London Widow,
Mary Waters Wife of Samuel Waters of London aforesaid,
and Elizabeth Farmer of Cranbrook aforesaid Spinster the three daughters of my Sister Eleanor Farmer
Jane Elizabeth Hook of Sevenoaks in the County of Kent aforesaid Spinster,
Susanna Watson wife of Daniel Watson of Ticehurst in the County of Sussex,
Hannah Raynolds Wife of (blank) Raynolds of Tenterden in the County of Kent aforesaid
and Mary whom resides in or near London but the name of whose husband has (gone from) my recollection,
the four daughters of deceased Sister Elizabeth Hook)

as shall be living at my decease equally to be divided between my said Nieces by my Executors hereinafter named

And I give to my said Niece Elizabeth Hook my chest of drawers and one of my Silver table Spoons
And I give to my said Niece Elizabeth Farmer one other of my Silver table Spoons
And I give to my said Niece Susanna Watson my half dozen of Silver tea Spoons

And I give and dispose of my four Bed Quilts as follows One to my said Niece Mary Waters another to my said Niece Elizabeth Farmer another to Mrs. Eleanor Marshall of Tenterden in the County of Kent and the fourth or remaining one to my said Niece Hannah Reynolds

And I give the Sum of twenty pounds sterling unto all the Children of the late Mr. John Pyne [Pine] of Tovill near Maidstone aforesaid who shall be living at my decease to be equally divided among them and the shares of such as may be underage to be paid to their Mother Rebecca Pyne (whose receipt shall be a sufficient discharge) to be by her applied for their benefit in such was as she shall think best

And I give the Sum of five pounds sterling unto my Great Nephew Mr. John Wicke of Stepney near London

And as to all the residue of my Personal Estate not hereby otherwise disposed of I bequeath the same unto my Friend Mr. John Evans of No. 4 Grays Inn Square, London and the said John Wicke their Executors Admors. [Administrators] and Assigns Upon Trust that they the said John Evans and John Wicke and the Survivor of them and the Executors Admors. or Assigns of such Survivor or such of them as may be the Trustees or Trustee for the time being acting in the execution of the trusts of this my will do and shall with all convenient speed after my decease collect call in and convert into money my said Personal Estate and do and shall by and out of the same and the monies to arise from such collection calling in and conversation [conversion!] thereof in first place pay satisfy and discharge all my just debts and funeral and testamentary expences and the several legacies given by this my Will

And do and shall in the next place pay out and invest the surplus of the said monies in their or his names or name in the purchase of a competent share or competent shares of the Parliamentary Stocks or Public Funds of Great Britain or at interest upon Government or real Securities in England or Wales to be from time to time altered and varied at their or his discretion and do & shall stand possessed of and interested in all the said trust monies and the Stocks Funds and Securities in or upon which the same shall be laid out and invested And of and in the interest dividends and annual produce thereof

Upon the Trusts following namely Upon Trust during the joint lives of my said Brother and Sister Richard George and Eleanor Farmer to pay the interest dividends and annual produce of the said trust monies Stocks Funds and Securities unto or permit the same to be received by my said Brother and Sister respectively and their respective Assigns in equal moieties

And from and after the decease of whichever of them my said Brother and Sister shall die then Upon Trust to pay the whole of the said interest dividends and annual produce unto or permit the same to be received by the Survivor of them my said Brother and Sister and his or her Assigns during his or her life

And from and after the death of the Survivor of my said Brother and Sister then the whole of the said Trust Monies Stocks Funds and Securities to be in trust for all or such of my Nephews and Nieces
Richard George of Whittersham near unto Tenterden aforesaid Jonah George of Chatham in the County of Kent aforesaid William George and George George both of Tenterden aforesaid and the said Sarah Pankhurst (the said five Children of my said Brother Richard George)
the said Eleanor Wicke Mary Waters and Elizabeth Farmer (the three Children of my said Sister Eleanor Farmer)
George Hook of Tenterden aforesaid and the said Elizabeth Hook Susanna Watson Hannah Raynolds and Mary (blank) (the five Children of my said deceased Sister Elizabeth Hook)
Jonah George of Brabourne near Ashford in the County of Kent aforesaid (the Son of my deceased Brother Jonah George)
and also the Children of my deceased Niece Lydia Linbridge late the Wife of Jeremiah Linbridge and who was another daughter of my said Sister Elizabeth Hook)

as shall be living at my decease in equal shares as tenants in common
save and except only that the Children of my said Niece Lydia Linbridge although taking as amongst themselves in equal shares shall together take only such part or share as their said deceased mother would have taken or been entitled to if in the trust lastly hereinbefore declared or contained she had been named among my said other Nephews and Nieces now living and enumerated as aforesaid and she were living at my decease, my intent being only to put her said Children in her place in the division of the said trust monies and premises

Provided always that if any one or more of the said Children of my said Niece Lydia Linbridge who shall be living at my decease shall being a Son or Sons die under the age of twenty one years of being a daughter or daughters die under the age or twenty one years and without having been married then and in each such case as well the original share of the Child so dying of and in the trust monies Stocks Funds and Securities as likewise any share or shares thereof that may survive or accrue to him or her by virtue of this present clause shall survive and accrue to and do in trust for the survivors or survivor others and other of such Children in equal shares as tenants in common

And in case there shall be no Child of my said Niece Lydia Linbridge living at my decease who being a Son shall attain the age of twenty one years or being a daughter shall attain the age or marry then and in such case the entire share hereinbefore given to or declared to be in trust for the said Children of and in the same trust monies and premises shall go to and be in trust for all or such of my said several nephews and Nieces hereinbefore named as shall be living at my decease in equal shares as tenants in common

Provided always and I hereby declare that the receipts in writing of the acting trustees or trustee for the time being of this my Will for any monies payable to them or him under this my Will or the trusts thereof shall be a sufficient discharge for the same and the person or persons to whom the same shall be given his her or their heirs exors. admors. [executors administrators] or assigns shall not afterwards be liable for any misapplication or nonapplication or be in any wise concerned to see to the application of the money thereby acknowledged to be received

And I hereby appoint the said John Evans and John Wicke Executors of this my Will
Provided always and I hereby declare that if the trustees appointed by this my Will or to be appointed as hereinafter mentioned or any or either of them shall die or desire to be discharged from or refuse or decline or become incapable to act in the trusts thereof before the said trusts shall be fully performed or discharged then and in every such case it shall be lawful for the then surviving or continuing trustee or the Executors Admors. of the last surviving or continuing trustee by any deed or writing to be sealed and delivered by him or them in the Presence of and attested by or two or more Credible Witnesses from time to time to appoint any person or persons to be a trustee or trustees in the place of the trustee or trustees so dying or desiring to be discharged or refusing declining or becoming incapable to act as aforesaid

And upon every such appointment of any new trustee or trustees all the trust monies Stocks Funds and securities then subject to the trusts of this my Will shall with all convenient speed be assigned to and vested in such new Trustees or Trustee either or solely or jointly with any surviving or continuing trustee as the case may require upon the trusts hereinbefore declared thereof and then subsisting or capable of taking effect
And all and every such new trustees or trustee shall and may in all things act and assign in the management and execution of the said trusts in conjunction with the other then surviving or continuing trustee (if any) but if none then by themselves as fully and effectually and with all the same powers whatsoever as if they or he had been originally by this my Will nominated Trustees or trustee thereof

And the said several Trustees hereby appointed or hereafter to be appointed as aforesaid and every of them their and every of their heirs executors administrators and assigns shall be chargeable respectively only for such monies as they shall respectively actually receive by virtue of this my Will or of the trusts thereof notwithstanding their or any of them giving or signing or joining in giving or signing any receipt or receipts for the sake of conformity And none of them shall be answerable for the other or others of them or for the acts receipts neglects or defaults of the other or others of them but only for his own acts or receipts neglects or defaults and none of them shall be answerable for any Banker Broker or other person with whom or in whose hands any part of the said trusts monies shall or may be deposited in the execution of the said trusts nor for the insufficiency or deficiency of any Security or Securities Stocks or Funds in or upon which the same trust monies or part thereof shall be laid out and invested nor for any other loss or damage which or may happen in the execution of the aforesaid Trusts or in relation thereto except the same shall happen by or through their or his own wilful default

And it shall be lawful for such present and future trustees and every of them their and every of their heirs executors administrators and assigns by and out of the monies which shall come to their respective hands by virtue of this my Will or the trusts thereof to retain and reimburse himself and themselves respectively and also to allow his and their CoTrustee and CoTrustees all costs Expences which they or any may sustain or expend in or about the execution of the aforesaid Trusts or in relation thereto

In Witness whereof I have to this my last Will and Testament set my hand and seal this twenty seventh day of October one thousand eight hundred and twenty eight

Proved at London the 30th November 1835 before the Worshipful John Danbran? Doctor of Laws and Surrogate by the Oaths of John Evans Esquire and John Wicke the Executors to whom Admon. [Administration] was granted having been first sworn duly to administer

Notes:
Niece Sarah Pankhurst’s (d. of Richard George) marriage is thus: 18 May 1817; Sarah George, Spinster, married Isaac Pankhurst, Bachelor, at St. John the Baptist, Wittersham.
Sarah George was christened 3 Sep 1797, d. of Richard and Elizabeth George at Wittersham.

Sister Eleanor (nee George) married William Farmer on 20th March 1768 at St. Dunstan, Cranbrook, Witnessed by Joseph George.
Sister Elizabeth (nee George) married John Hook on 10th April 1766 at St. Mildred, Tenterden.
Both were given as otp. Witness was Thomas Hook.
