I give and bequeath to my Nephew William Gillbee of the said parish of St Johns in Southwark Mariner and to my friend Mr Owen Williams of Thames Shool London wine merchant eight hundred pounds of my stock in Bank annuitys of three and a half per cent vested anno 1758 In trust that they the said William Gillbe and Owen Williams and the survivor of them and the Executors and Administators of such survivor do and shall pay the interest, dividends ? and profits of the said eight hundred pounds Bank annuities unto my son Richard Gilbe and his assignes by square half yearly payments as the same shall from time to time ? due and payable for and during the term of his natural life
and from and after the demise of my said son Richard Gillbee then upon his further ? that they the said William Gillbee and Owen Williams and the survivor of them and the Executors and Administrators of such survivor do and shall pay the Interest Dividends Income and profits of the said eight hundred pounds Bank Annuities unto my Granddaughter Mary Gillbee and her assignes for and during the term of her natural life by equal half yearly payments as the same shall / due and payable
and from and after the demise of my said Grand daughter Mary Gillbee then I give and bequeath order direct and appoint that the said eight hundred pounds Bank Annuitys together with the Interest dividends Income and profits thereof shall be unto and for all and every the child and children of my said Granddaughter Mary Gillbee lawfully to be begotten which shall be living at her death equally part and share alike if more than one and if but one then the whole to be unto and for such only child and for want of such ? and aforesaid Then I further order and appoint that the said eight hundred pounds Bank Annuitys and the Interest Dividends Income and profits thereof shall be unto and for the next of kin to my said Granddaughter Mary Gillbee by consanguity in a due cause of Administration according to the statutes of Distribution of Intestate Estates
and I give and bequeath unto my said Nephew William Gillbee and Owen Williams one thousand and six hundred pounds stock in the said Bank Annuitys of three and a half per cent ? anno 1758 In Trust they the said William Gillbee and Owen Williams and the survivor of them and the Executors and Administrators of such survivor do and shall pay the Interest Dividends Income and profits of the said on thousand and six hundred pounds Bank annuitys unto my daughter Susanna Gillbee wife of Thomas Gillbee of Dover salesman and her assignes by equal half yearly payment as the same shall from time to time ? due and payable for and during the term of her Natural Life and where with her said husband Thomas Gillbee shall not intermeddle no shall the same or any part thereof be subject or liable to the ? debts of engagements of her said husband and I order and direct that the orders receipts and acquittances of my said daughter Susanna Gillbee shall from time to time notwithstanding her cavorture? And as well cavort? As sole be good and sufficient discharges to the said Trustees for the same and from and after the decease of my said daughter Susanna Gillbee Then I give and bequeath order direct and appoint six hundred pounds Bank annuitys part of the said one thousand and six hundred pounds Bank Annuities and the Interest and dividends thereof shall be paid unto and for my Grandson Richard Gillbee eight hundred pounds Bank Annuitys other part of the said on thousand and six hundred pounds Bank Annuities and the Interest and Dividends thereof I give and bequeath order and appoint shall be unto and for my Grandson Nicholas Gillbee and I give and bequeath order, direct and appoint the remaining two hundred pounds Bank Annuitys and the Interest and dividends thereof shall from the decease of my said daughter Susanna Gillbee be unto and for my Great Grandson Humphry Gillbee and shall be paid and transferred to him by the said Trustees when and so soon as he shall attain his full age of twenty one years
and in case my said Great Grandson Humphry Gillbee shall happen before to depart his natural life in his minority and before he shall attain his said full age of twenty-one years as aforesaid then it is my Will and Mind and I further order direct and appoint that the said two hundred pounds thereof shall be unto ? for his father Richard Gillbee
and I give and bequeath my said Grandson Richard Gillbee my dwelling house wherein I now dwell with the Ground and apportion thereunto belonging situate in Gainsford Street in the said parish of St John in Southwark
and I Give and bequeath unto my two trustees the above named William Gillbee and Owen Williams ten guineas a piece? and whereas my son John Gillbee is lately deceased insame? And Intestate and to whom I am Administratix and by virtue of the Statutes of Distribution I am entitled to one third part of the clear personal estate of my said son John Gillbee deceased Now I do hereby Give and bequeath the said one third part of the clear personal estate of my said late son John Gillbee deceased to which I am entitles as aforesaid unto my said three Grandchildren Richard Gillbee, Nicholas Gillbee and May Gillbee to be divided between them part and share alike
and after my just debts are paid, funeral expenses discharged
and the legacies above given and well and ?? paid and performed I give
devise and bequeath all the rest residue and remainder of my Goods Chattels
Rights Credits Ready ? and ? for money stocks in the publick funds plate
linen household furniture and all other my effects and estate whatsoever both
Real an personal ( not herein before given devised or bequeathed) unto my
said daughter Susanna Gillbee wife of the above named Thomas Gillbee her
heirs executors administrators and assigns and I make, name, constitute and
appoint my said daughter Susanna Gillbee to be sole executrix of this my
will and do Revoke and make void all former wills and Testaments by me in
anywise heretofore made published or declared. In witness whereof I the
said Mary Gillbee the Testatrix to this my last will and Testament have set
my hand and seal the fourth day of October in the year of Our Lord one
thousand and seven hundred and sixty-eight
Mary Gillbee signed sealed published and declared by the said Mary Gillbee
the testatrix as and for her only last will and Testament in the presence of us
William Stringer Abra Harman Noty Publ.
This will was proved at London the sixth day of January in the year of Our Lord one thousand seven hundred and sixty-nine before the Worshipful George Harris Doctor of Laws and Surrogate of the Right Worshipful George Isay Doctor of Laws Quarter Keeper or commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Susannah Gillbee (wife of Thomas Gillbee) the daughter and sole executrix named in the said will to whom administration was granted of all and singular Goods, Chattels and credits of the deceased she having been first sworn duly to administer.
