Next I give to my oldest son THOMAS GOWAR, also by my said late wife[LOUISA], my silver
watch to be delivered to him immediately after my decease for his absolute use.
I also give to my said son THOMAS and to JOHN DISNEY of Blackheath Hill in the County of
Kent, aforesaid - Builder - my executors hereinafter appointed - �5 each of Legal British
Money for the trouble they respectively will be at in the execution of this my will.
Also I give to my said wife during her life all these my several leasehold messuages or
tenements and premises, with their respective appurtenances, situate in Gorwell Street, Gorwell
Street in the County of Middlesex, which I hold under lease, subject nevertheless to her paying
the rent and performing the Covenants therein contained
and upon the decease of my said wife I give the said leasehold premises before described for
all such term,state and interest as shall be there to count therein unto my said son and
daughter[the said THOMAS and MARY ANN] equally, share and share alike, as tenants in common and
not as joint tenants, their several respective executors, administrators and assignees, subject
nevertheless to their paying the rent and performing the Covenant in the lease under which I
hold the said premises.
Also I give to my said daughter, all that my leasehold messuages and premises with the
appurtenances thereto belonging, situate in Bridge Place Lewisham aforesaid, wherin I now
reside, and which I hold under a lease from Thos.. Penny, to hold the same with the appurtenances,
to my said daughter, her executors, administrators and assignees, for all such term, state and
interest as shall be contained therein, at my death subject nevertheless to the rent and
Covenants contained in the lease under which I hold the said premises.
I also give to my said daughter all those my three leasehold messuages or tenements and
premises, with all their respective appurtenances, situate in Mordon Street Greenwich,
aforesaid and now or late in the occupation of Messrs Bayley, Carman and Cooper, and
numbered 24, 25 and 26, and which I hold under lease with the other premises in Mordon Street
aforesaid, to hold the said three leasehold, messuages, tenements and premises last described
with their appurtenances, unto my daughter, her executors, adminstrators and assignees for all
such term state and interest as I shall have to raise therein at my death, but subject to her
paying a fair and equal proportion of the original groundrent received by their lease, such
which I hold with such premises with others as aforesaid and performing the Covenants and
agreements therein contained so far as affects the last three mentioned houses but not further
or otherwise.
And I give to my said wife SARAH GOWAR, for her life, the residue and remainder of the messuages
or tenenents and premises, situate in Morden Street aforesaid with their appurtenances which I
hold under the said lease with the said three last mentioned houses as aforesaid, she my said
wife paying the residue and remainder of the said rent payable in respect thereof and
performing the Covenants and agreements therein contained, so far as affects the same, but not
further or otherwise.
And upon the decease of my said wife, then I give one equal moiety or half part of the said
leasehold premises in Morden Street aforesaid, with their appurtenances, of which she is to
have the --- for her life as shall be be there to raise therein, unto my son RICHARD
GOWAR, also by my said late wife, his executors administrators and assignees, subject to
his paying an equal half part of the said remaining groundrent payable in respect thereof, and
performing the Covenants and agreements to which the same are subject and liable by the said
lease under which I hold the said premises with terms as aforesaid.
And also after the decease of my said wife, then I give that other moiety or half part of the
leasehold premises in Morden Street[which my wife is to have for her life] to my son HENRY
GOWAR, his executors administrators and assignees, subject to his paying the same yearly
groundrent for the same as my son RICHARD will have to pay for the leasehold premises given by
me to him as aforesaid. And also my said son HENRY performing the Covenants and agreements to
which I hold the same, with other premises as aforesaid.
But my will and meaning is ---- that the bequest to my said son HENRY of the said moiety or half
part of the aforesaid leasehold premises is on this condition and not otherwise, that he my
said son HENRY shall -------- serve out the whole term of his present apprenticeship and
for the performance whereof I have given and executed my Bond. But in case he my said son HENRY
shall neglect or fail to do so, then I revoke and make void the said bequest to my said son
HENRY of the said moiety or half part of the aforesaid leasehold premises, and in that case I
give the same with the appurtenances to my son the aforementioned THOMAS, his executors
adminstrators and assignees for all such term state and interest as shall be there to count
therein subject to the rent and Covenant which I have directed the same to be subject and
liable to as last aforesaid, and also subject to my said son THOMAS having ------ and keeping
my Estate from all ----, costs charges damages and ---- to which it may be subject or liable
by reason or on account of my having given and committed my Bond for the due service of
appurtenances of my said son HENRY as aforesaid and whereas there is a considerable debt now
due --- and serviced by a mortgage on these my leasehold houses and premises at Tanners Hall,
Deptford in the County of Kent aforesaid.
---- after all the said debts and charges and testamentary expenses are paid as aforesaid I
give the then future interest of the said mortgage debt to my said wife SARAH GOWAR for her
life, and upon her decease I give the said mortgage debt itself and all interest thereafter to
become due thereon unto and equally between my said son THOMAS and my said daughter MARY ANN
and their several and respective executives adminstrators and assignees for their several and
respective absolute use.
I also give to my said son THOMAS GOWAR all that my leasehold messuages or tenements and premises with the appurtenances thereto belonging, situate at the----- in the parish of Greenwich aforesaid and called or known by the name or sign of The Coach and Horses Public House, and all other premises comprised in the said lease under which I hold the said Public House to hold the same to him my said son THOMAS GOWAR his executors administrators and assignees for all such time state and interest as I shall have due in the leasehold premises at my death subject to the Covenants prevised and contained in the ---- under which I hold the same.
I also give to my said wife SARAH for her life all that my leasehold messuages or tenements and
premises with the appurtenances thereto belonging situate in Cold Bath Row Greenwich aforesaid,
now in the possession of Mrs. ----- and which I hold free of groundrent, she performing the
Covenants in the lease under which I hold the same.
Then I give the said leasehold premises last described for all such time etc., as shall be
there to count therein unto my said son THOMAS and my said daughter Mary ANN equally share and
share alike as tenants in common and not joint tenants, their and respective executors
administrators and assignees subject to their performing the Covenants in the lease under which
I hold the same.
And as to the rest and residue and remainder of my goods chattells and debts whatsoever and wheresoever which I shall die possessed of and not herewith disposed of before, I give ----- and -- part thereof and all my true estate and interest therein with the appurtenances unto and equally between my said son THOMAS and my said daughter MARY ANN their several executors administrators and assignees for their absolute use and benefit provided nevertheless and notwithstanding what is herein before contained and it is my wish and intent and I do declare that in case it shall happen that my said daughter the said MARY ANN GOWAR shall depart this life before my said wife the said SARAH GOWAR, then, and in that case from the decease of my said daughter the yearly interest of all the leasehold etc., to which she my said daughter would become entitled in case she had survived my said wife as aforesaid, I give the said three leasehold houses in Morden Street Greenwich aforesaid unto her my wife for her life, and in the event last aforesaid I give the said leasehold houses in Morden Street Greenwich aforesaid and also after the decease of my said wife I give all the said leasehold properties to which my daughter would have become entitled in case she had survived my said wife as aforesaid unto and between my said three sons, the said THOMAS, RICHARD and HENRY equally, share and share alike as tenants in common and not as joint tenants, their several and respective executors administrators and assignees for their several and respective absolute use and benefit
and I do hereby nominate constitute and appoint my said son THOMAS GOWAR and the said before named John Disney to be executors of this my will and I do declare that they respectively, and their respective executors and administrators shall be answerable only each of them for so much money, property estate , effects as they respectively shall --- or shall count to their respective hands by virtue hereof and that one of them shall not be answerable for the other of them, nor for the acts, deeds receipts or defaults of the other of them, the joining in receipts or doing any other act merely for conformity notwithstanding and that they respectively shall and may out of the remains coming into their hands by virtue herof reimburse theirselves respectively all loss costs charges damages and expenses which they respectively may bear pay or sustain or be put to in and about the execution of this my will or relating thereto
and lastly I do hereby revoke and make void all former wills codicils and cofirmatory
depositions by me made, and to publish and declare this only to be my last will and testament
in witness whereof I the said THOMAS GOWAR the testator have to this my last will contained in
five sheets of paper, affixed together with my seal to wit my hand at the bottom of each sheet
and my hand and seal to this the 5th and last sheet therof this 10th day of August in the year
of our Lord 1827 Thomas Gowar published and declared by the said Thomas Gowar, the Testator
as and for his last will and Testament in the presence of us:
