Will of Sander Haffenden

of Biddenden, Kent

I give and bequeath unto Mary Munn and Anne Munn two of the Daughters of my deceased Niece Ann late Wife of John Munn of Appledore in the said County of Kent Grazier the Sum of Twenty pounds a peice of lawful money of Great Britain to be paid them within Twelve months next after my decease by my Executor hereinafter named

also I give and bequeath unto Thomas Pilcher and William Pilcher the two Sons of Stephen Pilcher of St Marys in Romney Marsh and Elizabeth his Wife the Sum of Twenty pounds a piece of like Lawful money to be paid to them as they shall Severally Attain to the age of one and twenty years by my Executor herein after named and if either of them shall happen to dye before the said Legacy shall become payable and without leaving Issue of his Body lawfully begotten that then the Legacy of him so dying shall be paid to the Survivor

also I give and Bequeath unto my Maid Servant Catherine Chiltenden the sum of Ten pounds of like lawful money to be paid unto her within Twelve months next after my decease by my Executor hereinafter named

also I give and devise unto my Nephew George Haffenden and to his heirs and assigns forever all that my Messuage or Tenement with the Barn Stable Garden Orchard and nine Several pieces or parcels of Land Arable Meadow and pasture thereto belonging and Appertaining with their and every of their Appurtenances Containing in the whole by estimation Six and Thirty Acres more or less situate lying and being in Frittenden in the said County of Kent and now in the Tenure or Occupation of William Mallyon or his Assigns
he paying out of the same the Sum of Fourscore pounds of like lawful money unto the aforesaid Elizabeth the Wife of Stephen Pilcher within Twelve months next after my decease and my Will and meaning is that the same shall be paid unto her and for her own Separate exclusive of any power or Authority of her Husband and that her Acquittances Releases and discharges shall be good and effectual for the same notwithstanding her Coverture
and also paying out of the said Farm and Lands unto Sarah Stevenson Daughter of Samuel Stevenson of Maidstone in the said County the Sum of Thirty pounds of like Lawful money at her age of one and twenty years or Day of Marriage which shall first happen
upon default of payment of the said Legacy to the said Elizabeth Pilcher and of the said Legacy of thirty pounds to the said Sarah Stevenson when the same shall become due and payable it shall and may be lawful for the said Elizabeth Pilcher her Assignee or Assigns and also for the said Sarah Stevenson her Assignee or Assigns or either of them to enter into and upon the aforesaid Farm and Lands or any part or parcel thereof and the same to hold retain keep and enjoy until the aforesaid two Legacies which I have given out of the same shall be fully satisfied and paid and all Costs and charges thereon

also I give and devise unto my Nephew John Paine and to his heirs and Assigns forever all that my Messuages or Tenement with the Barn and other buildings Gardens Orchard and Six pieces or parcels of Land Arable Meadow and pasture Thereunto belonging with their and every of their Appurtenances Containing in the whole by estimation Thirty Acres more or les Situate lying and being in Tenterden in the said County of Kent and now in the Tenure or Occupation of Henry Morris or his Assigns and also all that part or parcel of Woodland with the Soil and Ground thereof adjoining to the last mentioned Lands containing by estimation Ten Acres more or less and being in the Several parishes of Tenterden and Biddenden aforesaid or one of them and now in my own possession

also I give and devise unto my Nephew Adrian Paine the Elder of Burwash in the County of Sussex and Grocer all that my Messuage or Tenement wherein I now dwell in the Town of Biddenden aforesaid with the Shops Tallow chandling house Stables Woodhouse Backside garden and all other the Appurtenances thereunto belonging together also with the Lane and free liberty way and passage to carry and recarry to and from the said backside with Waggons or otherwise or hath been used and also like liberty from time to time and at all times to fetch water thro all the other backsides by the way now and heretofore used To hold the said last mentioned premisses and every part and parcel thereof unto my said Nephew Adrian Paine the Elder and his Assigns for and during the Term of his natural life he keeping the same premises in good Tenantable repair
and from and immediately after the decease of my said Nephew Adrian Paine the Elder I give and devise the same premisses and every part and parcell thereof unto his Eldest Son Adrian Paine the Younger and to his heirs and Assigns absolutely and forever

also I give and devise unto my Nephew Richard Walter Burgis and to his heirs and Assigns forever all that my Messuage or Tenement together with the Buildings Garden backside and ways to the same belonging with the Appurtenances Situate lying and being also in the Town of Biddenden aforesaid and now in the Occupation of Henry Edwards or his Assigns

also I give and devise unto my Neice June Burgis and to her heirs and assigns forever all that my Messuage or Tenement together with the Buildings Garden Backside and Ways to the same belonging with the Appurtenances Situate lying and being also in the Town of Biddenden aforesaid and now in the Occupation of Thomas Gravet or his Assigns

also I give and devise unto my Neice Jane Burgis and to her heirs and Assigns forever all that my Messuage or Tenement Together with the buildings garden backside and ways to the same belonging with the Appurtenances Situate lying and being also in the Town of Biddenden aforesaid and now in the Occupation of my Sister Mary Paine or her Assigns

also I give and devise unto my aforesaid Sister Mary Paine all that my Messuage or Tenement together with the buildings gardens backside and ways to the same building with the Appurtenances Situate lying and being also in the Town of Biddenden aforesaid and now in the Occupation of John Barnham or his Assigns To hold the said last mentioned premisses unto my said Sister Mary Paine and her Assigns for and during the Term of her natural life she keeping the said premisses in good Tenantable repair
and from and immediately after the decease of my said Sister Mary Paine I give and devise the same premisses and every part and parcel thereof unto the aforesaid Adrian Paine the Younger and to his heirs and Assigns absolutely and forever

also I give and bequeath unto the said Adrian Paine the Younger my Silver Tankard marked with the Letters S H to be delivered unto him at his Age of one and Twenty years by my Executor hereinafter named

also all the rest and Residue of my Goods household Goods Stock Chattels Effects moneys Rights Creditts and personal Estate of what nature or kind soever the same be which I shall dye possessed of and not herein before before (sic) given away and dispossed of my Just debts Legacies Funeral Expenses and the probate of this my Will being first paid and discharged thereout I give and bequeath unto my said Nephew Adrian Paine the Elder
and lastly I do hereby make Nominate ordain Constitute and appoint my said Nephew Adrian Paine the Elder Sole Executor of this my last Will and Testament

In Witness whereof I have to this my last Will and Testament contained in Three Sheets of paper Set my hand and Seal To each Sheet thereof this eighth day of September in the Twentieth Year of the reign of our Sovereign Lord King George the Second over Great Britain GR and in the year of our Lord one thousand Seven hundred and forty Six

This Will was proved at London before the Right Worshipfull John Bettesworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully Constituted the Sixteenth day of January in the Year of our Lord One thousand Seven hundred and forty Six by the Oath of Adrian Paine the Sole Executor named in the said Will to whom Administration was granted of all and Singular the Goods Chattels and Creditts of the said deceased being first Sworn by Commission duly to Administer. Note:
Nephew Adrian Paine of Burwash, the executor of the will, had made his own will a day before probate was granted on this, Sander Haffenden�s, will. Adrian died a week later.
Adrian�s son and the main beneficiary of this will, Adrian Paine junior, died four months after his father.
In his will, Sander had directed his executor �to Set a fair Tombstone over me and my late deceased Sister Patience Haffenden�. The tombstone was indeed erected, with additions that Sander did not foresee:
(Altar) Top: Here lyeth the Body of Sander HAFFENDEN Gent, who died 19th September 1746 aged 63. Here lys the Body of Adrian PAINE late of B[?urwash] Nephew and Executor to the late Sander Haffenden who died 2[?8] January 174(?7) aged 55 leaving issue Mary, Adrian, Hals- ames(?) and Ann. Adrian survived his father but three months. South side; Here lyes the Body of Patience Haffenden who dyed 24th September 1733 aged 51. North side: Here lies interred Mary Paine, sister to Mr Sander Haffenden who died 19th May aged 77, 1749. East end: These stones were cleaned in 1759. West end; Arms of Haffenden: chequey on a bend three mullets. Crest three ostrich feathers.
