Now I the said John Hare do hereby give and bequeath unto Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor all that my Leasehold Estate where the said Trade and Business of a Brewer is carried on and all my third part and parts aforesaid and all my Right Title Share interest and advantage of in and to the said Joint Stock and Trade and all the Gains Profits and Produce thereof to arise or be had or made during the continuance of the said Copartnership together with full power for them the said Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor from the time of my death. In my place and stead to follow and carry on the said Joint Trade during the then residue and remainder of the said Term of Seven Years in such manner as in and by the said Indenture of Copartnership is mentioned and expressed concerning the same and all other my Monies Goods Chattels and Estate whatsoever. To have hold receive take and enjoy the same and every part thereof unto and to the use of them the said Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor.
In trust that from time to time during the said Copartnership they the said Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor do and shall out of the Gains Profits and Produce of the said Trade and of my Estate and Effects pay to or to the use of my Wife during the said Copartnership the weekly sum of Twenty Five Shillings and my will and mind is that my said Wife shall have the use of and hold and enjoy the house wherein I now dwell for and during the remainder of the said Copartnership and from and after the Expiration of the said Copartnership I hereby declare my said Leasehold Estate and Premises and all benefit and advantage in the said Trade of Brewer to be vested in them the said Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor. In Trust for my Brother Richard Hare his Executors Administrators and assigns upon condition that he the said Richard Hare his Executors or Administrators shall and do (before he or they take or be entitled to the same or anything under this my Will) Enter into one Bond or Obligation for the due payment of the said weekly sum of Twenty Five Shillings to or to the use of my said Wife and the yearly sum of Eighteen Pounds for and during the term of her natural life to commence and take place and be accounted from the End or Expiration of the said Copartnership.
And also enter into one other Bond or Obligation for the two payments of the yearly sum or sums of money to my daughter Mary Fletcher and her Son Richard Fletcher (that is to say) to my said daughter Mary Fletcher for and during the term of her natural life the yearly sum of sixty pounds by four quarterly payments and to begin and be made from the Day of the Death of my said Wife and the Expiration of the said Copartnership the same being intended by me for her sole and peculiar use and benefit and to be at her own disposal therefore I order and direct the same to be paid into her own proper hands or to such person or persons in such parts and shares and to and for such uses and purposes as she by any writing or writings under her hand notwithstanding her coverture shall direct or appoint. And to my Grandson the said Richard Fletcher the yearly sum of forty pounds payable as aforesaid for and towards his Maintenance and Education until he shall arrive at the age of twenty four years. In case his father shall happen to die before he my said Grandson shall attain his said age of twenty four years.
And also enter into one other Bond or Obligation to them the said Simon Hill Richard Rogers and William Hussey or the Survivors or Survivor of them or the Executors Administrators of such Survivor for the free payment for all such sum and sums of money as shall appear due to my Estate for my part or share of the said Joint Stock and Trade in manner following (that is to say) One third part thereof within our year next after the Expiration of the said Copartnership the other third part thereof within two years next after and the remaining third part thereof at the end of three years next after the Expiration of the said Copartnership with Interest for the same at and after the rate of five pounds by the hundred by the year. Provided always and my will and mind is that in case the said Richard Hare shall decline or refuse to accept and take the said Leasehold Estate and the Benefit and Advantage thereof or shall not enter into such Bond and Bonds as aforesaid within three months next before the End and Expiration of the said Copartnership then and in such case I do give and bequeath my said Estate to my said Trustees and the Survivors and Survivor of them and the Executors and Administrators of such Survivor and I do order and direct that they do and shall with all convenient speed sell and dispose of the same and out of the produce thereof pay or cause to be paid to or to the use of my said Wife the said weekly sum of Twenty Five Shillings and the yearly sum of Eighteen Pounds for and during the term of her natural life and from and after her decease pay or cause to be paid to my said Daughter the yearly sum of Sixty Pounds as aforesaid and to my Grandson Richard Fletcher in case his said father shall happen to dye before he attains the age of twenty four years the yearly sum of forty pounds for and during and until he shall attain his said age. Provided also and my will and mind is that in case my said wife shall happen to dye during the continuance of the said Copartnership that then the said weekly sum of twenty five shillings shall be paid to my said Daughter during the remainder of the said Term of Seven Years. And my will and mind further is and I do hereby declare my said Estate and Effects and every part thereof from and after such refusal for the said Richard Hare�s Executing such Bond and Bonds as aforesaid to be so vested in them the said Simon Hill Richard Rogers and William Hussey and the Survivors and Survivor of them and the Executors and Administrators of such Survivor from and after the Expiration of the said Copartnership and that they stand and be possessed of the same upon the Trusts and to and for the uses interests and purposes hereinafter mentioned (that is to say)
In trust in the first plan to lay out and vest the same from time to time as the same shall come to their hands or be by them received either entire or in parcels in some Government or other Good Security�s in their names and from time to time pay Imploy and Dispose of all the yearly Interest Dividends and Produce to arise and be made of and from the same in manner following (that is to say) after paying the yearly Annuitys or Annuity aforesaid one molety or half part of my said Estate and Effects to or to the use of my Grand- Daughter Mary Fletcher her Executors Administors and assigns to be paid to her when she shall attain the said age of twenty one years but in the meantime the Dividends Interest and Produce thereof to be paid and applied towards her Maintenance and Education and the Dividends Interest and Produce of the other molety during the life of my said Daughter Mary Fletcher into the proper hands of her the said Mary Fletcher or to such person or persons and to such uses and purposes as she shall by any writing or writings under he hand notwithstanding her Coverture � direct and appoint in such manner as I have before ordered and directed the payment of the aforesaid sum of sixty pounds or as the said Dividend Interest and Produce shall become due and payable in every year. And from and after the decease of my said Daughter Mary Fletcher to pay assign and transfer the moiety or half part of my Estate and Effects and the Dividend Interest and Produce then due (if any) to or to the use of my said Grand Daughter Mary Fletcher and such other child or children of my said Daughter Mary Fletcher as shall hereafter be born equally to be divided between them share and share alike when they shall respectively attain the age of twenty one year. But if my said Grand Daughter Mary Fletcher shall happen to dye before she attains her age of twenty one years then upon trust to pay assign and transfer my said Estate and Effects so as aforesaid given to her and the Dividends Interest and Produce then due upon the same (if any) to or to the use of such other child or children of my said Daughter Mary Fletcher hereafter to be given and if more than one equally to be divided between them share and share alike when they shall respectively attain the age of twenty one years.
And if there should be no such child or children hereafter born then upon the death of my said Grand Daughter I give and bequeath the same unto my said Grand Son Richard Fletcher his Executors Administrators and Assigns. And whereas my Brother and others are jointly bound with me in a Bond for the payment of the sum of Six Hundred Pounds. Now I do hereby order and direct my said Trustees to pay the Interest thereof as the same shall become due and as money comes into their hands to pay the principal sum of Six Hundred Pounds. And I do hereby order that my said Trustees shall reimburse themselves and be fully allowed out of my said Estate and Effects all their Costs Charges and Expenses which they any or either of them or the Executors or Administrators of the Survivor of them shall be put into for or by reason or means of the said Trusts and that they shall not be answerable one for the other but each only for what he shall actually receive. And that they nor either or any of them shall be answerable for the loss of any money which shall happen without his or their wilfull neglect or procurement.
Item I give and bequeath unto my said wife all my Plate � Linen China
furniture and all my Household Goods of what nature or kind soever. And lastly I do hereby
nominate constitute and appoint them the said Simon Hill Richard Rogers of Woolwich
aforesaid Gentlemen and William Hussey of Bishopsgate Street London Gentlemen Executors
of this my Will and for their trouble in the Execution hereof I give unto each of them my said
Executors the sum of Ten Guineas and the yearly sum of Ten Pounds to them or him who shall
take the Trouble and Chiefly Act in the Execution of this my Will hereby revoking and making
void all former and other Will and Wills by me at any time heretofore made and do declare
this only to be my last Will and Testament. In witness thereof I the said John Hare to the four
first sheets have set my hand and to this last sheet my hand seal this Twenty Seventh Day of
October in the Thirty Second year in the Reign of our Sovereign Lord George the Second by
the Grace of God of Great Britain France and Ireland King Defender of the Faith and so
forth And in the year of our Lord One Thousand Seven Hundred and Fifty Eight John Hare

Will and Testament in the presence of us who by his desire and request and in his presence
and in the presence of each other have hereunto set and subscribed our names as witness

This Will was proved at London the tenth day of September in the year of our Lord One Thousand Seven Hundred and Fifty Nine before the Worshipful Arthur Collier Doctor of Laws Surrogate of the Right Worshipful Edward Simpson also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Simon Hill Richard Rogers and William Hussey the Executors named in the said Will to whom Administration was granted of all and singular other Goods Chattels and Credits of the deceased having been first sworn duly to Administrator.
