Item I give and bequeath unto the poore people of the parish of Eastry aforesaid and to the poore people of the parish of Woodesborow [Woodnesborough] in the said County the some of twenty Shillings that is to say, to each parish tenne shillings to be paid by my Executor and by him to be distributed amongst the said poore the Christide after my decease
Item I give and bequeath unto Anne my loveing wife my high Bedstedle with the Featherbed and all the Furniture and ‘ppurtenes [appurtenances] belonging as it now stands in the parlor in the house where I now dwell Allsoe I give unto her the sume of tenn poundes in money and my silver Cupp or tenn ponds worth of any other of my household stuffe as it shalbe apprized to be at her eleccon either to take tenn pouds in money or the value in goods as aforesaid to be aide or delivered to her by (my) Executor within two moneths next after m decease
Item I alsoe will and bequeath that my said wife shall have and receive and take to her owne use dureing her naturall life for her maintenance all the Rents issues and p[ro]fitts of all that my messuage lands and appurtenncs whatsoever hereto belonging Scituate lyeing and being in the parish of Preston next Wingham in the said County of Kent now in the occupacon of Thomas Solley or his Assignes she the said Anne my wife keeping the buildings thereof well repaired and paying and dischargeing all Quitt rents paable for and out of the same dureing the said tearme as they shall grow and become due
And alsoe paying yearely out of the same unto William Carelton my Uncle the sume of twenty shillings
by the yeare if he shall soe long live in liewe and satisfaccon of twenty shillings by the
yeare w[hi]ch I am to pay him by the will of Catherine Hatcher my late mother deceased
And alsoe she the said Anne my wife within two months next after my decease giveing unto my sonnes
such release of all her right and Title of Dower or widow right of or to all my other lands and Tenements as shalbe requiste to barr her from the same
Item I give unto Thomas and Henry Hatcher my Sonns and to the heires of their bodies lawfully to be
begotten forever All the aforesaid Messuages or Tenements Barne place yard lands and premises thereto
belonging with their appurtenncs menconed to be scituate lyeing and being
in Preston aforesaid in the occupacon of the said Thomas Solley, to have and to hold the
same premises unto my said sonns Thomas Hatcher and Henry Hatcher and to the heires of their bodies
as afores[ai]d forever imediatly from and after the death of the said Anne my now wife
And if my said sonns Thomas and Henry shall both of them dye without heires as aforesaid Then I give
and bequeath the said Messuages landes and premisses unto my sonne William Hatcher and unto the
heires of his body lawfully begotten forever
And if my said sonne William shall dye without heires as aforesaid Then I give and bequeath all the said Messuage lands and premisses unto
my eldest sonne Stephen Hatcher and unto his heires and Assignes for ever
Provided neverlesse and it is my true intent and meaneing and I doe hereby will that wch of my said sonns Thomas or Henry that shall dye before the other and my sonne soe dyeing shall leave issue lawfully begotten at the time of his death that the said issue shalbe Tennant in Comon in the said Lands and premisses with my said surviving Sone dureing his life and that my said Surviveing Sonne shall not take advantage of his being Joynt Tennant with my said sonne soe deceaseing in the said lands and premisses by his survivorship
Provided alsoe and it is meaneing and I doe hereby will that if my said sonne Thomas Hatcher shall at any time hereafter intermarry with and take
to wife : : : : : the now wife and relict of Robert Pordage late of Woodnesborrow aforesaid Yeoman, That then imediatly upon the
said marriage had and solemnized betweene them, the said said (sic) gift and bequest to my said sonne Thomas as to be Joynt Tennant with my said
sonne Henry in the aforesaid Messuage and lands in Preston shall cease to all intents and purposes
And then I doe give and bequeath all the said Messuages lands and premisses in Preston aforesd. immediatly after the decease of Anne my wife unto
my said sone Henry and to the heires of his body as aforesaid with remainders over as aforesaid
and in liewe and and (sic) consideracon thereof I doe then hereby give grant unto my said sonne Thomas one Annuity or yearely
rent charge of Tenn pounds per Ann[u]m to be issueing and goeing out and yearely to be received, perceived, had and taken of in and out of all the
said Messuage Barne place lands and pr[e]misses in Preston aforemenconed with their appurtenncs
To be had and holden yearely to be received had taken unto my said sonne Thomas and his assignes
dureing his nrall [natural] life at two of the former most issueing Feasts or tearmes of payment in the
yeare (That is to say) the feast day of the Annunciacon of the blessed Virgine Mary and St.
Michaell the Archangell by even and equall porcons halfe yearely to be paid the first payment
thereof to begin and be made upon the first of the said Feast dayes wch shall first and next happen after
the death of the said Anne my wife and [the next bit has been damaged, but it looks like: ‘the premisses(?)
aforesaid forever enbod... add and’] solemnized
And if it shall happen the said Annuity or yearely Rent charge shalbe behinde and unpaid unto my said sonne Thomas or his Assignes over or after any of the dayes of payment aforesaid on wch as aforesaid the same ought to be paid by the space of foureteene dayes, That then and soe often it shall and may bee lawfull to and for my said sonne Thomas or his Assignes into and upon the aforesaid Messuages Barne Place Lands and premisses or any parte thereof with their Appurtenncs to enter and distreine and and (sic) the distresse and distresses then and there found from thence take lead drive beare away impound withhold deteine and keepe untill the said Annuity or yearely rent charge of tenn pounds per Annum shall with all the Arre[a]rages thereof (if any) be unto the said Thomas Hatcher and his Assignes be well and truely satisfied contented and paid, anything herein conteyned to the contrary notwithstanding
Item I doe hereby nominate and appoynt my said sonne William Hatcher sole Executor of this my last will and Testament
And I doe hereby will and require that my said Executor shall the next Michalmas
day next after my decease Assigne and turne over unto my said two sonnes Thomas Hatcher and Henry
Hatcher the lease of the Farme at Fowlermeade wch I hold of Mr. William Cullen now in the occupacon
of the said William my sonne dureing all the tearme then in the said lease to come and unexpired together wth the possession thereof
And alsoe I will that he my said Executor shall then satisfie and deliver over unto the said Thomas and Henry my sonnes or the Survivor of them
soe much household stuffe for them to use and imploy in the said Farme as shall amount to the some of one hundred and twenty pounds of lawfull
money of England upon an indifferent appraisement thereof to be made by two men the one to be choosen by my said Executor and the other by my said
two sonnes Thomas and Henry if they be both liveing or by the Survivor if one of them be then dead if they my said sonnes William, Thomas and
Henry shall not themselves otherwise agree concerning the same
And if my said Executor shall not them conveniently spare soe much goods stock and corne as shall amount to the said some of one hundred and twenty
pounds Then I will what shalbe wanting thereof in goods to make up the said sume the same shall by my said Executor be made up and
then paid downe to them in money
Item I give and bequeath unto the said William Hatcher my sonne all those my foure peeces or parcells of land called Tenchland with their
Appurtenncs conteyning together by estimacon Twenty Acres more or lesse lieing and being in Woodnesborrow aforesaid To have and to hold the same
land called Tenchland unto my said sonne William Hatcher and to the heires of his body lawfully begotten for ever
In consideracon whereof and what is by me hereafter menconed to be given to my said sonne William I doe hereby will and bequeath that my said
sonne William shall and doe within eighteene moneths next after my decease well and truely pay or cause to be paid unto Margarett and
Susan Hatcher my daughters the full sume of sixe score pounds apeece of lawfull money of England and if they or either of them marry before the
expiracon of the said eighteene monethes then I will that one halfe of the porcon soe marrieing shalbe paid at her day of marriage and the other
halfe at the end of the s[ai]d eighteene moneths
And if either of my said daughters shall die before that time without issue then I will that soe much of
the porcon of her soe dieing as shalbe unpaid shalbe paid to the surviveing Sister in such manner
and at such time as she is to receive her owne porcon But if she soe dieing leave issue then the mothers parte to be paid to such issue
And if my said sonne William shall not pay unto my said two daughters Margarett and Susan their said porcons wch I as aforesaid have and doe hereby give and bequeath unto them according to the true intent and meaneing of this my will, that then it shall and may be lawfull for them the said Margaret and Susan or their Assignes to enter upon the said lands called Tenchlands and to hold and enjoy the same till out of the rents and profitts thereof they shalbe paid and satisfied their respective porcons given them as aforesaid
And if it soe be that my said sonne William shall die without heires of his body lawfully to be begotten as aforesaid then I give all the said lands called Tenchlands unto the said Thomas Hatcher and Henry Hatcher my sonnes and to the heires of their bodies lawfully to be begotten forever But if they the said Thomas and Henry shall both of them die without heires as aforesaid Then I give all the said lands called Tenchlands unto the said Stephen Hatcher my sonne his heires and Assignes for ever
Provided alwayes and my minde and will is that if the said lands called Tenchlands and my said lands
in Preston aforesaid shall happen to come and descend unto my said sonne Stephen and his heires
according to this my Will That then I will my said sonne Stephen his heires or Assignes within twelve
moneths next after the said lands shall descend to him or them as aforesaid shall pay or cause to be paid
unto Margaret Anne Katherine and Susann my foure Daughters the sume of one hundred pounds
apeece of lawfull money of England over and besides what is before given to them or
either or any of them by this my will if they be then liveing And if any of them be then dead and leave
issue then liveing then the mothers porcon soe dead to be paid to such issue
And if my said sonne Stephen his heires or Assignes shall neglect to pay the said foure hundred pounds
to my said foure Daughters if then liveing or the mothers porcon to the issue of
such of them as shealbe then dead and leaving issue then liveing, contrary to the true meaneing of this
my will That then it shall and may be lawfull to and for them and their Assignes to enter into and upon all or any the said lands in Woodnesborrow
and Preston with their appurtenncs and the same to hold and enjoy untill all of the Rents Issue and Profitts thereof they and every of them shalbe
paid and satisfied the said sume of one hundred pound apeece according to the true meaneing of this my will
And Whereas I the said Thomas Hatcher upon the marriage of the said Stephen Hatcher my eldest sonne have by Indenture bearing Date the tenth day
of December one thousand Six hundred fifty and seaven Setled upon the said Stephen to uses a Messuage and diverse lands lands (sic) in Woodnesborow
aforesaid and by wch Indenture the sume of two hundred pounds of lawfull money of England is to be paid to the Executors Administrators or
Assignes of me the said Thomas Hatcher within sixe moneths next after my decease as by the said Indenture amongst other things the same doth more
at large appeare
Now I doe hereby bequeath will and assigne that the said some of two hundred pounds shalbe paid unto my said Executor when and soe soone as the
same shalbe come due and payable by the said recited Indenture to the end he may be the better enabled to satisfie and pay unto my two daughters
Margaret and Susan their porcons allotted for him to pay as aforesd and to the end he die? the same
Item I alsoe give and bequeath unto the said William Hatcher my sonne and to his heires and Assignes for ever All that my Messuage with the Appurtenncs scituate and being in the parish of St. Peter in the Towne and Port of Sandw[i]ch now in the occupacon of the widow Chapman and others, he paying out of the same the sume of three pounds yearely unto Margaret my Sister dureing the tearme of her n[atu]rall life according to the will of the said Katherine Hatcher my late mother deceased and I will that my said Executor shall pay all such legacies and sumes of money as is due to be paid out of the same after the death of the said Margaret my Sister by the said Will of the said Katherine my late mother
Item I give and bequeath unto the said Stephen Hatcher my sonne and unto Katherine and Anne my daughters the sume of forty shillings apeece to be paid unto them by my said Executor within one moneth next after my decease
Item I give and bequeath unto Lawrance Hatcher, Thomas Hatcher and Elizabeth Hatcher my Grandchildren, sonne and daughter of the said Stephen and John Witherden my Grandchild sonne of my daughter Mary deceased to every of my said Grandchildren the sume of twenty shillings to be paid unto them respectively when they shall atteine their ages of one and twenty yeares
Alsoe I give and bequeath unto Henry Andrew and Thomas Andrew my grandchildren sonnes of my daughter Katherine to each of my said two Grandchildren the sume of tenn pounds of lawfull money of England to be paid unto them respectively as they atteine their ages of one and twenty yeares if they shall soe long live
Moreover I will and bequeath that my said Executor shall the Michalmas next after my decease assigne over unto Stephen Hatcher my sonne if he be then liveing my lease of tenn acres more or lesse of earrable [arable] and pasture Lands lyeing in Ash and Woodnesborrow or one of them with the possession of the same lands dureing the Residue of the tearme in the said lease then to come and unexpired wch lands with lands I hold of Mr. John Rucke now deceased
Item as for all other my goods Stocke moveables Household stuffe and personall estate whatsoever not before bequeathed my Debts legacies and Funerall expences satisfied, I give and bequeath the same unto William my sonne and Executor as aforesaid
And revoking all former wills by me made I doe hereby declare this to be my last will and Testament
and in Testimony whereof to this my will conteyned in sixe Sheetes of paper to the five first Sheetes my hand
and to the Sixt and last Sheet my hand and Seale have sett Dated the day and yeare first above recited
