I will order and direct that my just debts and funeral expences be first satisfyed and paid And whereas I am seiged? in Fee of and in two copyhold messuages or tenements together with the backsides edifices and buildings (holden of the Manor of Wrotham which I have surrendered to the use of my will) situate lying and being in Wrotham aforesaid in the said County of Kent heretofore in the tenure or occupation of John Newman and William Ward and now in my own possession and occupation Now by virtue thereof I give and devise the said two copyhold messuages or tenements backsides edifices and buildings thereunto belonging unto my brother William Hodsoll his heirs and assigns to the use of my said brother William Hodsoll his heirs and assigns upon the trusts and confidences herein after mentioned declared and expressed
Also I give and bequeath all my ready money securities for money household goods stock in trade and all other my Real and personal Estate of what nature or kind soever and where soever (that is not any ways settled on my wife Barbara) unto my brother William Hodsoll upon trust that he my said brother William Hodsoll his heirs executors or administrators do as soon as conveniently maybe after my decease cause my said household goods and furniture and stock in trade to be appraised and sold for the best price that he or they can get for the same and out of the clear moneys that shall be raised by the sale of my personal estate and of the sale of my copyhold lands or out of the rent and profits of the said copyhold lands untill the same shall be sold to place the same out upon Government Land or other securities in such manner as my said executor and the Trustee herein after named in their discretion shall think fit and convenient and to pay and apply the interest and produce thereof for and towards the maintenance and education of all and every the heirs of my body lawfully begotten and to be begotten during their and each of their respective minoritys
And I do hereby nominate and appoint my much esteemed friend James Trimball of Ash
next Wrotham aforesaid to be a trustee and Guardian over all and every my said children
during their and each of their respective minorities
And when they and either of them shall attain to the age of twenty one years if they be
sons to pay to such son his equal part and share of the moneys arising by the sale of my
personal estate and copyhold lands as aforesaid And to pay to all and every my daughter
and daughters their equal parts and shares of the money arising by the sale of my personal
estate and copyhold lands when they and each of them shall attain to their and each of
their respective age and ages of twenty one years or days of marriage which shall first
happen
And if any of my said children shall happen to depart this life before they attain to their respective ages of twenty one years or days of marriage that then the part and share of him her or them so dying to go to the survivors and survivor of them share and share alike if more than one and if but one such child then the whole principal sum to such only child
And if all and every my children depart this life before they attain to their respective ages of twenty one years or days of marriage that then I will order and direct that the said interest and proceed of the money arising by the sale of my personal estate and copyhold lands shall be paid unto my loving wife Barbara during the term of her natural life if she so long continue my widow but my will and mind is such and I do hereby declare the same to be that if my said wife Barbara shall marry again that from and immediately after her intermarriage the payment of the said interest unto my wife Barbara shall cease And then I do give and bequeath all the principal money arising by the sale of my personal estate and copyhold lands unto my said brother William Hodsoll
And I do hereby further order and appoint my Executor and trustee their respective heirs
executors and administrators out of the monies that shall come to his their or either of
their hands respectively or be by him them or any of them raised or received out of my
estate in the first place to reimburse himself and themselves respectively all such costs
charges and expences as he or they or any of them shall sustain or be part unto in the
Execution of this my will or any of the trusts hereby reposed in him them or any of them
or for any matter cause or thing whatsoever
And my will and desire also is that my said Executor and Trustee their respective heirs
executors administrators shall not be charged or chareable with or accountable or
responsible or liable to make good any loss that shall happen in the management and
disposal of my estate or any part thereof he or they respectively being bona fide and
according to the best of his and their discretion
And I do hereby nominate constitute and appoint my said brother William Hodsoll full
and sole Executor of this my last Will and Testament hereby revoking and declaring to be
void all former and other wills by me at any time heretofore made and declare this only to
be my last will and testament In Witness whereof I the said Thomas Hodsoll the testator
have to this my last Will and Testament contained in two sheets of paper have to the first
sheet hereof set my hand and to this last sheet my hand and seal the day and year first
above written Tho�s Hodsoll � Signed sealed published and declared by the said Thomas
Hodsoll the testator as and for his last Will and Testament in the presence of us who in
his presence and at his request have subscribed our names as witnesses thereto the words
(for money) in the twenty first line of the first sheet and the words (the best of) in the
twenty first line of the second sheet being first interlined

I Thomas Hodsoll of Wrotham in the County of Kent mercer and tallow chandler do this
eleventh day of April one thousand seven hundred and fifty make and publish this
codicill to my last will and testament in manner following (that is to say)
I give and bequeath unto my loving wife Barbara the sum of ten pounds of lawfull money of Great
Britain to buy her mourning
In Witness whereof I have hereunto set my hand and seal the

above named Thomas Hodsoll as a codicil to be annexed to his last Will and testament in
the presence of us

This will was proved at London (with a codicill annexed) the twenty eighth day of October in the year of our Lord one thousand seven hundred and fifty one before the Worshipfull John Bettesworth also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of William Hodsoll the brother of the deceased and sole Executor in the said will named to whom administration was granted of all and singular the goods chattels and credits of the said deceased being first sworn duly to administer.
