First I doe will and give unto my loving wife Elizabeth for and during her naturall life the use and weareing of all my household goods plate and linnen which shall be in my now dwelling house at Saint Mary Cray aforesaid at the time of my decease and after her decease then or before if she please I doe give everyone of my three daughters Hellena Mary and Jane Hodsoll one feather bedd one feather bolster two blankets one coverlett and one pillow and after the decease of my said wife or in her lifetime if she please I doe give to every one of my four daughters Hellena Mary Elizabeth and Jane one chest or trunk or chest of drawers such as my wife pleaseth or such boxes as are used now by them respectively which I doe desire her to give them respectively and I doe give my son John Hodsoll all the rest and remainder of my goods and household stuffe whereof I have given my wife the use for her life (Except my plate and linnen) and for that I doe desire and appointe my said wife sometime before her death by some note or will in writeing under her hand to devise will and dispose of my plate and linnen to and amongst all my children to be living at her death according to her good pleasure and for want of her disposing thereof as aforesaid I doe give the same equally amongst all my children then living share and share alike
Item I doe give and devise unto my said wife Elizabeth and her assignes
for and during the terme of her naturall life all that my messuage Farme
and lands being about fifty acres now in the occupation of Thomas Carrier
which I formerly purchased of Mr Alexander Haddon the younger situate and
being in Saint Mary Craye aforesaid being about fifty acres of land and
orcharding
and alsoe all those my two parcells of land called Lyntons now
in the occupation of George Starte lying in Saint Mary Cray aforesaid
and alsoe the moiety or half part of my mansion house wherein I doe now dwell
and all the barnes stables dovehouse Outhouses Court yards gardens
orchards land meadow and pasture thereunto belonging now in my owne
occupation situate and being in Saint Mary Cray aforesaid provided
alwayes and my will and meaning is that in case my said wife shall after
my decease clayme or sue for her dower or widdow right of into or out of
my other lands or tenements that I am ever was or shall be seized of at
the time of my decease (Except only my messuage farme and lands called
Bakers lying in Stansted in the said County which I setled up on her
before our intermarriage for part of her Jointure which I doe hereby
ratifye and confirme unto her) that then she my sayd wife shall have noe
benefitt of this my will or any legacy or devise hereby given unto her
Item I doe give and devise unto my said son John Hodsoll all my goods
that shall be in his Chambers in Cliffords Inne in London and alsoe my
books and things in my study in my said dwelling house (Except money) to
be delivered to him by my said wife immediately after my decease
And whereas I did lend to Sir Charles Sedley Baronett since deceased the
sume of Five hundred and thirty pounds upon his Farme and lands called
Drayne? Farme in the occupation of Richard Wingate or his assignes and
upon certaine wood lands thereto adjoying then or late in the occupation
of John Knowe and now in the occupation of Sir John Sedley baronett his
assignes or undertenants situate lying and being in the severall parishes
of Woodland Wrotham and Ightham in the said County of Kent
And whereas I alsoe lent him more Fifty pounds upon an Indorsement on the backside of
the said Indenture of Mortgage and charged by the said Sir Charles Sedley
on the said Farme and woodlands being in all five hundred and four score
pounds all which money I lent and tooke security for the same in the name
of my good friend and kinsman Thomas Gratwick Esquire but all the said
money was and still is the proper money of my selfe as by the declaration
of the said Trust may appeare now I doe by this my will desire and
appointe my said Kinsman Mr Thomas Gratwick to assigne the said Mortgage
and indorsement and all the money that shall be therby due and payable at
the time of my decease unto my said wife and executrix or to such of my
daughters as my said wife shall nominate and appointe and for want of
such her nomination Then to my said daughter Elizabeth Hodsoll to goe and
be in part of her portion which I doe hereinafter give her and I doe
desire my said kinsman to be aiding to my said wife or daighter in the
recovery thereof in case any trouble shall arise (he being paid his
expences)
Item I doe give to every one of my four daughters Hellena Mary Elizabeth and Jane the sume of Six hundred pounds apeice of Lawfull money to be paid to them severally by my said executrix within three months next after my decease
Item I doe give and bequeath unto every one of my said four daughters the
sume of two hundred pounds apeice more of like money to be paid unto them
severally by my son John Hodsoll within one yeare next after my decease
and I doe hereby declare my will and mind to be that in case any loss
shall happen to be of any moneys that I shall have out at interest at the
time of my death That then he my said son John Hodsoll his heirs or
assignes shall answere and make good the same out of my reall Estate
hereinafter devised to him and them and by me Charged therewith and with
the payment of such moneys as I have herein before appointed him to pay
to my said daughters towards their portions and for the enabling him and
them soe to doe I doe give and devise unto him my said son John Hodsoll
his heirs and assignes for ever all that my messuage farme and lands
called Crowers Farme and all my woodgrounds with the appurtenances to the
said farme belonging situate and being in Kinsdowne in the said County of
Kent now in the occupation of my selfe and Thomas Stevens or of our
severall assignes and alsoe all those my messuages or tenements lands and
appurtenances to them severally belonging now in the severall occupations
of William Halse William Loade? and William Lenham or of their severall
assignes and alsoe all those severall parcells of arrable and one parcell
of wood heretofore in the occupation of John Letchford and now in the
occupation of ____ or his assignes and are all situate lying and being in
Meopham in the said County and alsoe all that my Tyle house and Tylekill
Lands and woodgrounds thereto now used and belonging containing by
estimation eighty and five acres more or less situate and being in Saint
Mary Cray aforesaid and now in the Joint Occupations of John Miller and
Thomas Mosyer the younger and alsoe all my Lands and woodgrounds which I
purchased of John Lloyd gent. and Elizabeth his wife lying in Saint Mary
Cray aforesaid now in the severall occupations of Thomas Carrier and
William Bigg or of their severall assignes
and my will and meaning is and
I do soe will order and appointe that in case he my said son John Hodsoll
his heirs or assignes shall neglect or refuse to pay unto my said
daughters or any of them their said severall legacies or sumes of money
hereby appointed for him to pay unto them or to pay and make good such
losses as may happen in my moneys now out or to be out at interest at the
time of my decease That then in either of the said cases it shall and may
be lawfull to and for my said daughters or any of them soe unpaid and for
their severall Executors Administrators and assignes respectively to
enter into and upon all and every of my said messuages farmes lands and
woodgrounds soe as aforesaid given to him my said son John Hodsoll his
heires and assignes for that purpose and for them respectively to have
hold and enjoy the same and to receive and take all the rents issues and
profitts thereof without impeachment of wast in tymber untill they and
every of them respectively shall be fully satisfied and paid all their
said severall legacies costs and damages (if any be) and alsoe interest
for the same after the rate of five pounds per Centum per annum until
payment thereof
Item I doe give and bequeath unto my sister Susan Woodden and her assignes for and during the terme of her naturall life one annuity or yearly rent of five pounds of lawfull money to be yearly had taken and received out of all my messuage called Paynes and out of the barne stable lands and appurtenances thereto belonging now in the occupation of Thomas Lane situate lying and being in the severall parishes of Ash and Stansted in the said County payable tax free at Michaelmass Christmass Our Lady day and Midsomer day quarterly by equall portions and if it be at any time unpaid by the space of Fifteen dayes after any of the said Feasts (although noe demand be made thereof) that then and soe often it shall be lawfull for her my said sister Susan Woodden and her assignes to enter into the said messuage and lands with their appurtenances and to distraine for the said Annuity soe behind and unpaid and the distresse and distresses there found to lead drive and carry away impound and keepe untill payment thereof and all costs and damages by her sustayned by the reason of the non payment thereof provided alwaies that if she sells or assignes the said Annuity or if she receives any Quarters payment of the said Annuity before it shall become due that then in both and either of the said cases the said Annuity shall cease and be void to all intents and purposes whatsoever (anything herein contained to the contrary notwithstanding)
Item I doe give devise and bequeath unto my three nephews Samuel Atwood clerke John Hodsoll of South Ash gent and William Hodsoll goldsmith brother of the said John Hodsoll their heires and assignes one annuity or yearly rent charge of Fifteen shillings of lawfull money to be yearly and every yeare (from and after my said wife�s decease) had taken received issueing and ging out of and in all my said messuage Farme and lands now in the occupation of the said Thomas Carrier situate and being in Saint Mary Cray aforesaid being about fifty acres which I have given to my wife for her life To have hold leavy receive and take the said Annuity or yearly rent of fifteen shillings unto them the said Samuel Atwood John Hodsoll and William Hodsoll their heires and assignes for ever payable on two feasts or dayes of payment in the yeare (that is to say) the feasts of All Saints and the Circumcision of our Lord Jesus Christ by equall portions and the first payment thereof to begin and be made on the feast day of All saints which shall next come after the decease of my said wife Elizabeth and not before and my will is that in case it shall happen that the said Annuity or yearly rent of Fifteen shillings or any part thereof shall be behind and unpaid by the space of seaven dayes next ensuing after either or any of the said feast dayes on which the same ought to be paid (being lawfully demanded at the said messuage) that then and from thenceforth it shall and may be lawfull to and for them the said Samuel Atwood John Hodsoll and William Hodsoll their heires or assignes and any of them into and upon my said messuage farme and lands charged with the payment of the said Annuity of fifteen shillings and thereto distraine for the same and the distress and distresses there found and taken lawfully from thence to beare lead drive have take and carry away impound detaine and keep untill they shall be fully satisfied and paid the said Annuity and all costs and charges by that occasion sustained upon speciall Trust and confidence nevertheless reposed in them the said Samuel Atwood John Hodsoll and William Hodsoll their heires and assignes that they and the survivor of them his heires and assignes shall and doe pay the said fifteen shillings yearly as soon as they or any of them shall receive the same unto the Churchwardens or Overseers of the poore of the parish of Saint Mary Cray aforesaid or to some or one of them for the time being for ever or else shall permitt and authorize such Churchwardens and Overseers to take and receive the same as it shall grow due of the Occupiers of the said messuage and lands chargeable therewith whole receipt shall be a good discharge for the same from time to time and I doe desire and appointe the said Churchwardens and Overseers for the time being or some or one of them with the said fifteen shillings to buy and distribute weekly on fifteen Sundayes in every yeare for ever beginning on the next Sunday which shall next come after the feast of All Saints and soe forward for fifteen Sundayes together following the said feast and next coming after my said wifes decease and not before) one dozen of wheaten penny loafes of bread to such poor people of Saint Mary Cray aforesaid and there inhabiting for the time being who shall be aged impotent and comers to the said parish Church to hear divine Service and sermons such as my said son John Hodsoll and his heires if inhabiting in Saint Mary Cray shall nominate and appointe from time to time
And all the rest and remainder of my messuages lands and tenements whatsoever and wheresoever and the reversion and reversions remainder and remainders thereof I doe give and devise unto my said son John Hodsoll his heires and assignes for ever Chareable with the said Annuity to my said sister Susan Woodden dureing her life and alsoe with an other Annuity granted to my neice Susan Woodden for her life out of my said farme and lands in the occupation of the said Thomas Lane
Item I doe give unto my said sister Woodden and to her daughter Susan
Woodden twenty shillings apeice
Item I doe give unto my cousin Gratwick Esquire and to my said nephews
Samuel Atwood John Hodsoll and William Hodsoll ten shillings apeice to
buy them rings to be paid within one month next after my decease by my
said Executrix
Item I doe give to the poor people that shall be inhabiting in Saint Mary
Cray at the time of my death the sume of Forty shillings if I shall be
buried in woolen and not otherwise to be distributed amongst them by my
wife and son John with the assistance of the Churchwardens within one
month next after my decease
Item I doe give my white horse to and amongst my daughters as they marry
their right in him to cease
Item I give to my son John and to every one of my daughters six pounds
apeice for mourning
Item I doe give to every one of my servants that shall be living with me
at the time of my death ten shillings and in case that my said wife shall
depart this life before this my will shall be performed then I doe make
my said son John Hodsoll Executor of this my will to performe the
remainder thereof
all the rest and remainder of my personall estate after my debts legacies and funerall expences shall be paid I doe give and bequeath unto my said wife and Executrix for her owne use and Lastly I doe revoake all former wills by me made contained in four sheets of paper In Witness whereof I have to every sheet of the said four sheets of paper sett my hand and to this last sheet I have alsoe sett my seale dated this eight and twentieth day of September in the ninth yeare of the reigne of our Soveraigne Lady Anne by the grace of God of Great Britaine France and Ireland Queen Defender of the Faith Anno domini 1710 Edm Hodsoll
And whereas I have lent upon a mortgage five hundred pounds and have
taken the mortgage in my name and my daughter Hellena�s name which money
I will shall be part of her legacy of six hundred pounds appointed to be
paid her by my executrix and then my Executrix shall pay her but one
hundred pounds more and I doe appointe this be taken as part of my will
and I doe ratifye this my will in every other matter and thing witness my
hand and seale this 20th day of December 1710 Edm Hodsoll memorandum that
this will and subscription was signed sealed and published by the said
Edmund Hodsoll for his last will and testament in the presence of us who
subscribed our names hereto as witnesses in his presence and at his
request
