In the name of God Amen I Thomas Hogben of Aldington in the County of Kent, yeoman being weake in body, but of sound and perfect memory and understanding (God be praised therefore) do make and ordain this my last will and Testament in writing in manner and form following (that is to say)
Imprimis I recommend my soule into the hands of Almighty God my maker trusting through the meritorious death and passion of my blessed Lord and Saviour Jesus Christ to receive the free pardon and forgiveness of all my sinns, and my body I leave to the earth from whence it came to receive a decent and Christian buriall according to the discretion of my Executrix hereinafter named, and as for the worldly estate which God of his mercy hath lent me I give and dispose of the same as followeth

Item I give and bequeath unto my Kinswoman Elizabeth Owen the wife of Richard Owen of Kenardington in the said County, Yeoman, her Executors and Administrators the sume of Twenty pounds of lawful money of Great Britain to be paid by my Executor hereinafter named within one year next after my decease

Item I give and bequeath unto my kinsman John Lucas (son of John Lucas late of New: Romney in the said County, Husbandman, deceased) the sume of Tenne pounds of like money to be paid unto him by my Executor herein after named at his age of one and twenty yeares,
and in case he dye before that age I give the said Tenn pounds unto my sonne Thomas Hogben

Item I give and bequeath unto Mary the Sister of the said Elizabeth Owen mow married to one at Lidd in the said County the sume of Five pounds of like money as aforesaid to be paid unto her likewise by my Executor herein after named within one year next after my decease,
And in case she the said Mary happen to die before her said Legacy shall become due and payable as aforesaid I give the same unto my Son John Hogben

Item I give and bequeath unto twentie of the poorest families which from time to time after my decease shall be inhabiting and dwelling in Aldington aforesaid one shilling to be paid to such family yearly after my decease forevr out of the Rent of my peece of Marshland called Shrewsberry lieing and being in Bilsington in the said County in my own occupacon by my Executor hereafter named untill my said Son Tho: Hogben shall have attained his age of one and twenty years And afterwards by the owners of the said Marshland on the four and twentieth day of March (Except it shall happen to fall on the Lords Day comonly called Sunday) and then to be paid on the next day after, yearly and every year as aforesaid at the discretion of them that ought to pay the same as aforesaid

Item I give and bequeath unto my said son Thomas Hogben and his heirs forever All that my Messuage or Tenement with the outhouses edifices and buildings lands and apptences [appurtenances] thereunto belonging wherein I now dwell scituate lieing and being in Aldington aforesaid and my said peece of Marsh land with thapptances [the appurtenances] (chargeable with the moneys payable to the said poor families as aforesaid)

Item I give and bequeath unto my said sonn John Hogben and his heires for ever All that my Messuage or Tenement with the outhouses buildings lands and apptences thereunto belonging containing by estimation sixteen acres more or less with thapptennes scituate lying and being in Aldington aforesaid at the lower end of Aldington forward and in my owne occupacon and in the occupacon of Henry Port

Item I give and bequeath and bequeath unto my loving wife Elizabeth Hogben All my Messuage or Tenement (built by my father or his order) with the Stable stall garden bean plantes and one peece or parcell of Meadow land thereunto belonging containing by estimacon four acres more or less with thapptences scituate lying and being in Aldington aforesaid and now or late in the tenure or occupacon of John Ashdowne or his assignes And all that my Messuage or Tenem[en]t stable garden hempland and one peece or p[ar]cell of pasture land containing likewise by estimacon four acres more or less with thapptences (formerly Thomas Keats?) scituate lying and being in Aldington aforesaid and now or late in the tenure or occupacon of John Gardner or his assignes To have and to hold unto my said wife and her assignes for and during so long time as she my said wife shall live and continue a widow and unmarried

and imediately after the decease or day of marriage of my said wife as aforesaid or either of them which shall first happen I give and bequeath the said Messuage and lands last menconed with thapptences unto my said Sonn Thomas Hogben and to his heires forever
And the said Messuage and lands with thapptences hereinbefore menconed to be in the occupacon of the said John Ashdowne or his assignes I give and bequeath unto my said Sonn John Hogben and his heires for ever imediately after the decease or such the day of marriage of my said wife as aforesaid or either of them which shall first happen

And my desire is that my said wife shall keep the said Messuages and the fences belonging to the said lands so given to her as aforesaid in Tenant like repair during so long time as she shall hold the same and not cutt downe any willow pollards stocks or trees growing in or about the same or comitt or do any wast or spoile in upon or about the same Tenements or lands,

in in case my said wife happen to marry againe, then I give and bequeath unto her my said wife five pounds of lawfull money of Great Britain to be paid unto her and her assignes in manner following (that is to say)
Fifty shillings out of the said Messuage and lands in the occupacon of the said John Ashdowne and the other Fifty shillings out of the Messuage and lands in the occupacon of the said John Gardner imediately after such her marriage as aforesaid by such p[er]son or psons to whom the same according to the true intent and meaning of this my will shall then properly belong

Item I give and bequeath unto my said sonn Thomas Hogben my best bed with all the furniture thereunto belonging to the best Chamber of my now dwelling house and of the Closett thereunto adjoyning and the bed with thapptences and other the furniture of the Chamber of my now dwelling house wherein I now usually lye, and all the furniture of the parlour of my said now dwelling house to be delivered (to) him by my Executor hereinafter named at his age of one and twenty yeares or day of marriage or either of them which shall first happen

Item I give and bequeath unto my said wife Elizabeth Hogben the use of all other my houshold goods whatsoever for and during so long time as she shall live a widow and unmarried as aforesaid, and afterwards to be disposed of by my Executor to and among my said two Sonns and the Survivor of them

And all my stock corn grain and hay and other goods not herein disposed of I order and appoint to be sould, and the money to be raised by the Sale thereof and of such other my goods my Executors shall thinke fitt to sell over and above what will be sufficient to pay my debts legacies funerall expences the probate of this my will and other incident charges, shall be putt out to interest
And my will and mind is that my said Executor shall receive the interest and profitts of the said several Messuages and lands given to my said Sons severally to my said Sonns as aforesaid and the interest of such moneys so to be put out as aforesaid and of all other moneys due or given to them as aforesaid and all other my moneys and p[er]sonall estate not herein before disposed and laid out for and towards the educacon and bringing up of my said sonns severally till they shall attaine their sevrall ages as aforesaid and as they shall attaine their sevrall ages as aforesaid and shall pay them their just dues as by a just accountt which he shall then give them shall then appear to be sevrally due to them
And my will is that such of my said Sonns shall be brought up with his owne estate and that the principle money so to be put out to interest as aforesaid shall be equally divided between them at their age aforesaid, and that in case either of my said sonns dye under the age aforesaid the share of him so dying to go to the Survivor of them

Item I make and ordaine my good friend Philipp Foord sole Executor of this my well desiring him to take care that I be buryed in the pew where I usually sitt in the parish Church of Aldington aforesaid and desiring him to keep all and singuler my said Messuage and lands in good repair and that he be paid and satisfied for his time and paines to be taken herein

And my will us that in case my said wife be not contented with what I have hereby given her but claim or sue for her dower out of my said Messuages and lands then she shall have no benefitt by this my will but that then the Messuages and lands given to my said Sonns after her decease or marriage as aforesaid shall goe to my said sonns sevrally as aforesaid and their heires, and that they shall imediately have the houshold goods given her as aforesaid, to be then imedately disposed of for their use as aforesaid

And lastly my will and mind is that in case both my said sonns happen to dye and depart this life before they or either of them shall attaine the age of one and twenty yeares without heires of their or either of their body or bodies lawfully begotten, that then all and singuler the said lands and Tenemts. and moneys given to my said sonns and remaining unpaid shall be and remaine unto my said Executor Philipp Foord his heires Executors and administrators forever to his and their owne proper use, chargable as aforesaid

In Witness whereof I the said Thomas Hogben have to this my last will and Testament contained in three sheetes of paper to each of the first two sheetes sett my hand and to this last sheete sett my hand and seale Dated the fifteenth day of Aprill in the yeare of our Lord one thousand Seven hundred and twelve
