I devise and bequeath all that my
messuage or tenement with outbuildings Garden Ground and appurtenances thereunto
belonging situate in Dover Street in Folkestone aforesaid and now in my own
occupation and also all that messuage or tenement with the Yard Garden and
appurtenances adjoining the last mentioned premises and all other my real Estate
whatsoever and wheresoever situate with their rights members and appurtenances and
all my Estate and interest therein and also all my Personal Estate unto the said
Thomas Pain and Mark Sandford their heirs executors administrators and assigns
respectively upon trust to sell my real Estate by public Auction or private contract
subject to any conditions of sale which they may seem expedient and to convert and
get in my residuary personal Estate
And I do hereby declare that my said trustees
shall stand possessed of the money to arise from the sale and conversion of my said
real and personal estate and of all other monies which shall come to their hands under
or by virtue of this my will upon trust in the first place to pay all my just debts funeral
and testamentary expenses and the expenses of and attending the carrying of the trust
of this my Will into execution and after payment thereof upon trust to pay and divide
the residue of the said monies between all my children namely Ann, Hunt,
Margaret, James, Henry, Elizabeth, Rebecca, John, Thomas, Mary, Alice and
Eleanor in equal shares
I devise all real estates vested in me as trustee or mortgagee unto the said Thomas Pain and Mark Sandford and subject to the equities affecting the same respectively I empower the trustees for the time being of this my Will to give receipts for all monies and affects to be paid or delivered to such trustees or trustee by virtue of my Will and declare that such trustees shall exonerate the persons taking the same from liability to see to the application or disposition of the monies or affects therein mentioned I empower the trustees or trustee for the time being of my Will to compound or allow time for the payment of debt or debts due to my Estate and all accounts between me and any person or persons on such terms as my said trustees or trustee shall in their discretion think expedient and to refer any matters in difference to arbitration and I exempt every trustee of my Will from losses occurring without his own wilful default and authorise him to retain and allow his cotrustee or cotrustees all expenses incident to the Trusteeship and I do hereby declare that the said Thomas Pain notwithstanding his appointment as a trustee under this my Will shall be entitled to make the usual professional charges for any business he may do relative to the trusts herein contained
